Under this institu2 tional arrangement, invest - finance podium is a result of fiscal opportunism of local government. In the background of inter2 national financial crash, the responsive measures taken by the central government further aggravate the former imbalance of institutional arrangement. A s a result, fiscal opportunism breaks out thoroughly and the risk from invest - finance podium ri2 ses. So the fundamental measure should be to change the imbalance of institution. A Rev iew of the L eg isla tion M odel of Article 2 ( Genera l Article) of the Tort Law of the People s Republic of Ch ina From A Com para tive Law Perspective ( 46) W ang Guanxi ( Guanghua Law School, Zhejiang University, Hangzhou ) Abstract: The basic p roblem of the general article of the TortLaw of the Peop le s Republic of China is that the distinc2 tion between rights and interests is not clear. That article is very difficult to enforce. The French model does not distinguish between rights and interests. It grants judges a right to decide the type and scope of damages in term s of the matter of facts. The Japanese model never clearly distinguishes between rights and interests. The German and Taiwanese models do distin2 guish between rights and interests, and they are both p roperty - p rotection - oriented. The German and Taiwanese models have established their screeningmechanism s through determ ining whether someone has infringed other peop le s rights, viola2 ted the boni mores, or violated laws p rotective of other peop le, their distinction between rights and interests is based on the consideration of the costs and risks of a continually evolving society. The p rofessionalization of Chinese judges is still ongo2 ing, The French model is not comparatively stable when being app lied and interp reted. The Japanese model is not worthy to be adop ted. However, its experiences of the recep tion of western modern laws and the theories for develop ing are worth learning. A lthough the general article of German tort law is different from the Chinese one, understanding the German model will help determ ine the differences between rights and interests in p racticing Chinese tort law and then conduct reasonable screening. The audiences of verdicts consist of three types: the lawsuit parties, the legal p rofessional community, and the public. The ideal situation is that the verdicts are accep ted by all the three audiences, if not, the legal p rofessional community should be the main audience to bal2 ance the accep tability of verdicts. The ideal evaluation criterion to the accep tability of verdicts is the outcome fairness and p rocedural fairness. But in a realistic ongoing judgment with an unknown outcome, outcome fairness means that the judge believes the outcome would be fair, and convinces the audiences of his conclusion. The written sentence is the carrier re2 vealed discretion by the judge, so the evaluation criterion of accep tability of verdicts can be established by demonstrating the written judgment. The realistic criterion of accep tability of verdicts can be set from four respects: logic, law, fact, and p ro2 cedure. According to the author s arguments, what really count are not ethnic characteristics, rural - urban differences, life styles, p rofessions nor education levels, but institutional obstacles related to interests, rights or resource distributions, which result in the closeness and exclusionism of the community and thus lead to the segmentation between local residents and m igrants under the background of open market. Under the social adm inistration system based on residence registration, the majority of m igrant population just acts as the abstract market factor labor, but not as an integrated social member. The significance of residence registration reform and opening inside the society is just as important as opening - up to the world and econom ic system reform. W e could only build a culturally advanced modern society on the basis of elim inating the segmentation and closeness of internal social structure.
