105,,,,,,,,,,,,,,,,,,,,,,,,,,,,, Abstract :Legal scholars often make the research of the issue of the judicial justice under the system of a set of opposite conceptions, such as resultant justice and procedural justice, substantive justice and formal justice. However, the judicature is such an independent space of law that it is not proper to be separated in conceptions above - mentioned. J udicial justice means the achievement of the general jus2 tice and fairness in the administration of justice, thus it is actually a whole systems recognized by social ethics universally and a set of justice procedures accepted by the single participant in the procedure. These systems and procedures embody the rationality of intercourse, making it get the legitimacy and authority, thus to function as a settlement of social disputes. Therefore, judicial justice is a result af2 fected by many essentials comprising authority, ethics, system and procedure. Its achievement asks for the base of social ethics recognition, on which to establish the systems and procedures and to make the judicature acquire legitimacy. 105 67,,73 23
