4 (Energy and Construction Risk)-Consequential Financial Loss Exclusion (104) 美亞保字第 0118 號函備查 承保範圍同主保險契約承保範圍之約定 不保事項 It is agreed that this Policy does not apply to any direct or indirect financial loss resulted from the loss of use of any property arising out of: A defect, deficiency, inadequacy or dangerous conditions in Product or A sudden and accidental Property Damage to Product after it has been put to its intended use. All other terms, conditions, and exclusions of the policy shall remain unchanged. 茲經雙方同意, 本保險不承保任何由於下列原因導致財產無法使用而引起的直接或間接的經濟損失 : 產品或被保險人從事的被保險業務本身存在瑕疵 缺陷 不當之處或危險狀況 ; 或者, 產品或被保險人從事的被保險業務在按其預定目的使用後, 突發的意外事故對其造成物質損壞 短期費率表同主保險契約之約定

5 (Energy and Construction Risk)-Damage to Principal s Existing Property Endorsement (104) 美亞保字第 0119 號函備查 承保範圍 It is understood and agreed that the coverage to this Policy includes the Insured s legal liability for any damage to property owned by (insert name of principal) and arising during and/or as a result of the performance of the contract where such liability is not the result of the sole negligence of (insert name of principal). The indemnity under this extension shall not exceed (insert limit per Occurrence and in the aggregate.) 6 (Energy and Construction Risk)-Damage to Principal s Existing Property Exclusion (104) 美亞保字第 0120 號函備查 承保範圍同主保險契約承保範圍之約定 不保事項 This Policy does not cover liability directly or indirectly caused by, arising out of or in any way connected with Property Damage to the existing property of any principal of the Insured including any resulting consequential loss, loss of use, loss of profit, loss of production or business interruption. All other terms, conditions, and exclusions of the policy shall remain unchanged. 茲經雙方理解並同意, 本保險合約不承保直接或間接由於被保險人的業主的任何現有財產發生財產損害所導致的 引起的或與之有關的賠償責任, 包括任何間接損失 功用喪失 利潤損失 產能損失或營業中斷 短期費率表同主保險契約之約定

7 (Energy and Construction Risk)-DIC & DIL of Local Policies Endorsement (104) 美亞保字第 0121 號函備查 承保範圍 This Policy is a Master Policy for an international Comprehensive General Liability Programme where local Liability policies or their equivalent (hereinafter referred to as Underlying Policy(ies)) have been issued by AIG, or other insurance companies accepted and approved by AIG. It is agreed that in respect of the Schedule of Underlying Policies below, this Policy will provide: 1. Difference in Conditions (DIC); and 2. Difference in Limits (DIL) cover between this Policy and the Underlying Policies. 茲經雙方理解並同意, 如本保險項下任何在中華民國台灣註冊成立的保險公司還有中華民國台灣境外的保險公司 ( 包括但不限於本公司分子公司 ) 簽發的任何相同或者類似的責任保險 ( 具體以本條款附件所列為准, 以下統稱 基本保險合約 ) 為其提供保障, 則其在本保險合約項下享有的保障按如下規定執行 : 1. Where this Policy provides legal liability cover that is broader than the coverage afforded by the Underlying Policies, cover shall apply in respect of claims covered hereunder which are not covered by the Underlying Policies subject to the Deductible stated in the Schedule. 2. Where this Policy provides legal liability cover for Limits of Liability that is greater than the limits of liability afforded by the Underlying Policies, this Policy shall also provide cover for the difference that may exist between the limit specified in the Underlying Policies and the Limits of Liability afforded under this Policy. 1. 如本保險合約提供的法律責任風險承保範圍較任何基本保險合約約定的承保範圍更寬, 則本公司按照本保險合約規定對該被保險人提供該基本保險合約所不提供的保障, 但須扣除保險單所載的免賠額 ; 2. 如本保險合約提供的法律責任風險保障的賠償限額高於任何基本保險合約約定的賠償限額, 則本公司僅以本保險合約項下的保險賠償限額減去該基本保險合約項下的責任限額後的餘額為限, 對超過該基本保險合約項下的責任限額的部分向該被保險人提供法律責任風險保障 Provided that the Limits of Liability specified in the Schedule is the maximum Limit of Liability of all policies forming part of this Comprehensive General Liability Programme and the Limits of Liability shall be reduced by an amount equal to the indemnity recoverable under any Underlying Policy.

8 In the event that the aggregate limit of liability of an Underlying Policy is reduced or exhausted solely due to the payment of claims, this Policy will, subject to its terms, Conditions & Exclusions, continue in force as excess of the reduced primary limit, or in the event of exhaustion, continue in force as the primary insurance. 9 (Energy and Construction Risk)-Energy Exclusion (104) 美亞保字第 0122 號函備查 承保範圍同主保險契約承保範圍之約定 不保事項 Notwithstanding anything to the contrary contained in this Policy, it is hereby understood and agreed that this Policy shall not apply to any actual or alleged liability for: 不論本保險合約是否存在任何相反規定, 茲經雙方理解並同意, 本保險不承保下列任何一項引致的實際或被指稱的賠償責任 : 1. LOSS OF WELL OR HOLE 1.1 loss of or Property Damage to any well or hole: which is being drilled or worked over by or on behalf of the Insured; in connection with which the Insured has provided services, equipment or materials; 1.2 any cost or expense incurred in, or incidental to redrilling or restoring any such well or hole or any substitute well or hole. 1. 鑽井或鑽孔的損失 1.1 下列任何鑽井或鑽孔所發生的損失或財產損害 : 被保險人或其代理人於鑽掘進行中或已完成 ; 被保險人已提供服務 設備或材料有關的任何鑽井或鑽孔 ; 1.2 重新鑽孔或恢復任何鑽井 鑽孔或替代性鑽井 鑽孔過程中所發生的任何費用支出或其他雜項 2. IN-HOLE EQUIPMENT loss of or Property Damage to any drilling tool, pipe, collar, casing, bit, pump, drilling or well servicing machinery or any other equipment while it is below the surface of the earth in any well or hole: 2.1 which is being drilled or worked over by or on behalf of the Insured; 2.2 in connection with which the Insured has provided services, equipment or materials. 2. 井下設備下列任何鑽井或鑽孔內的任何鑽孔工具 管線 鑽環 管套 鑽頭 泵 打鑽 修井設備或其他設備在位於地表以下期間所發生的損失或財產損害 : 2.1 被保險人或其代理人於鑽掘進行中或已完成 ; 2.2 被保險人已提供服務 設備或材料的任何鑽井或鑽孔 3. 10 any costs or expenses incurred in, or incidental to: 3.1 controlling or bringing under control any wells or holes; 3.2 extinguishing fire in or from any wells or holes; 3.3 drilling relief wells or holes, whether or not the relief wells or holes are successful. 3. 控制成本在下列過程中所發生的任何費用支出或其他雜項 : 3.1 控制任何鑽井或鑽孔 ; 3.2 撲滅任何來自鑽井或鑽孔內外的火災 ; 3.3 打鑽減壓井或減壓孔, 無論是否打鑽成功 4. REMOVAL OF DEBRIS any costs or expenses incurred in, or incidental to: 4.1 the raising, removal or destruction of any wreckage, debris or obstruction, however caused, whether or not the property of the Insured, and whether or not such raising, removal or destruction is required by law, contract or otherwise; 4.2 the removal or recovery of any drilling tool, pipe, collar, casing, bit, pump, drilling or well servicing machinery or any other equipment while it is below the surface of the earth in any well or hole. 4. 殘餘物清理在下列過程中所發生的任何費用支出或其他雜項 : 4.1 提升 清除或毀壞任何原因造成的殘骸 殘餘物或障礙物, 不論該殘骸 殘餘物或障礙物是否為被保險人財產, 亦不論該提升 清除或毀壞系根據法律 協定或其它方面的規定而為之 ; 4.2 清理或回收在任何鑽井或鑽孔內的任何鑽孔工具 管線 鑽環 管套 鑽頭 泵 打鑽或修井設備或其他設備 5. SUB-SURFACE OPERATIONS Property Damage to, loss of or loss of use of property resulting from subsidence caused by sub-surface operations of the Insured. 5. 地面下作業由於被保險人的地下作業導致地表沉降所引起的財產損害 損失或使用價值損失 6. UNDERGROUND RESOURCES loss of or Property Damage to sub-surface oil, gas, water, or other substance or material, or the cost or expense of reducing to physical possession above the surface of the earth any oil, gas, water, or other substance or material, or the cost or expense incurred or rendered necessary to prevent or minimize such loss or Property Damage. 6. 地下資源地下原油 天然氣 地下水或其他物質材料發生的損失或財產損害, 或回收溢漏至地面上的任何原油 天然氣 地下水或其他物質材料而發生的費用支出, 或為防止或減少前述損失或財產損害而發生的必要費用支出 7. CO-OWNER Property Damage to any co-owner of a working interest with respect to such working interest.

11 7. 共有任何經營權益共有人的經營利益所遭受的財產損害 As used in this exclusion, the term "co-owner of a working interest" means any person or entity working with the Insured, a co-owner, joint venturer or mining partner in mineral properties who participates in the operating expense of such properties or revenues therefrom, or who has the right to participate in the control, development or operation of such properties. 在本項責任免除條款中, 經營權益共有人 指任何分攤或分享礦區經營費用或收益的, 或有權參與控制 開發或經營該礦區的被保險人 共有人 合營方或礦區採礦合作方 It is further understood and agreed that any consequential loss caused by, arising out of or in any way connected with any of the above exclusions is also excluded under this Policy. 12 (Energy and Construction Risk)-Excess Auto Liability Endorsement (104) 美亞保字第 0123 號函備查 承保範圍 Sublimit: <INSERT SUB-LIMIT > 分項賠償限額 : 每一事故及累積賠償限額為 元 Vehicle Covered:Owned, Non-Owned & Hired Autos It is hereby agreed and understood that Notwithstanding Exclusion 2.1.the coverage afforded by this policy shall be in excess of the terms and conditions of the current motor vehicle policy or policies carried by the named insured. 15 (Energy and Construction Risk)-Full Electromagnetic Fields Exclusion (104) 美亞保字第 0124 號函備查 承保範圍同主保險契約承保範圍之約定 不保事項 The Policy does not cover: 1) Liability arising out of, resulting from, caused by or contributed to by electromagnetic fields, provided that such liability results from or is contributed to by the pathological properties of electromagnetic fields; or 2) The costs of abatement or mitigation of (i) electromagnetic fields, or (ii) exposure to electromagnetic fields. 茲經雙方理解並同意, 本公司在本保險合約項下不承保下列責任或費用 : 1. 任何因電磁場輻射致病特性所引起的或以其為原因而產生的賠償責任 ; 或 2. 任何為減弱或消除電磁場或電磁輻射影響而產生的費用 This exclusion also includes: a) Any supervision, instructions, recommendations, warnings or advice given or which should have been given in connection with the above; and b) Any obligation to share damages with or repay someone else who must repay damages because of such liability and c) Defense Cost. 17 (Energy and Construction Risk)-Marine Liability Exclusion (104) 美亞保字第 0125 號函備查 承保範圍同主保險契約承保範圍之約定 不保事項 This Policy does not cover any legal liability arising out of or in any way connected with Bodily Injury and/or Property Damage arising out of any marine liability which would include but not be limited to the following list: 本保險不承保因任何涉及海上責任所致身體傷害和 / 或財產損害有關的任何法律賠償責任, 前述海上責任包括但不限於 : Charterers Liability Safe Berth Liability Stevedores Liability Towers Liability Jones Act Coverage Ship Repairers Legal Liability Foul Berthing Demurrage 租船人責任安全船席責任裝卸工人責任拖救責任瓊斯法案保險範疇船舶修理人法律責任妨害停泊延期停舶費 Terminal Operator Liability Wharfingers Liability Protection and Indemnity including Collision Ship Builders Liability U.S. Longshoreman and Harbour Workers Transit Liability Pilotage Marine Employers Liability 碼頭營運責任碼頭所有責任保護補償含碰撞責任船舶建造人責任美國碼頭工人及海港工人運輸責任領航海事僱傭人責任 It is further agreed that this Policy shall not apply to any Bodily Injury and/or Property Damage arising out of: 1. Liability arising out of the ownership, operation, maintenance, fueling, loading or unloading of any watercraft or for any watercraft that maybe in the Insured s care, custody or control; or 2. Liability arising from Bodily Injury to any Passenger on any watercraft operated by, or on behalf on the Insured or for any passengers property; or 3. Damage to or destruction of any dock, pier, harbour, bridge, buoy, lighthouse, breakwater structure, beacon, cable or to any fixed or movable object or property for which the Insured may be held liable; or

18 4. Liability for cost or expense of, or incidental to, the removal of the wreck of any vessel; or 5. International maritime coverage. All other terms, conditions, and exclusions of the policy shall remain unchanged 茲經雙方進一步同意, 本保險不承保以下各項 : 1. 因所有 操作 維修 加油 裝卸任何處於被保險人照顧 監管 控制的船舶導致身體傷害和 / 或財產損害所引起的賠償責任 ; 2. 被保險人或其代理人操作的船舶導致任何乘客遭受身體傷害或財產損害所承擔的賠償責任 ; 3. 被保險人因船塢 碼頭 港口 橋樑 浮標 燈塔 防浪堤 指向標 引路號誌 電纜或任何固定或可移動的物體或財產發生損害或導致身體傷害而依法應承擔的賠償責任 4. 被保險人應承擔的船舶殘骸清理費用或其他附加費用支出 ; 5. 因從事任何國際海運和航運業務所產生的以及根據國際海事公約和 / 或任何國際海事管理規定 ( 如國際海事組織, 英文簡寫 IMO ) 所承擔的國際海事賠償責任 短期費率表同主保險契約之約定

19 (Energy and Construction Risk)-Phased Hand-Over Exclusion (104) 美亞保字第 0126 號函備查 承保範圍同主保險契約承保範圍之約定 不保事項 This Policy does not cover liability directly or indirectly caused by, arising out of or in any way connected with Property Damage to any Product that has been completed and/or handed-over to any principal and/or put into operation by any principal. Provided that this exclusion does not apply during the testing/ commissioning period specified in the construction contract. All other terms, conditions, and exclusions of the policy shall remain unchanged. 茲經雙方理解並同意, 本保險合約不承保直接或間接因已完工 移交任何業主或任何業主已投入運營的產品發生財產損害所引起的 產生的或與之有關的責任 為避免疑義, 本項責任免除規定不適用於在工程建造合約載明的測試 / 試車期間內所發生的財產損害 短期費率表同主保險契約之約定

20 (Energy and Construction Risk)-Pollution Clean-Up Expenses Sub-Limit Endorsement (104) 美亞保字第 0127 號函備查 承保範圍 Item 1.2 of Section B Pollution Liability, is deleted and replaced as follows: 茲經雙方理解並同意, 刪除保險條款第一部分第二條第 ( 一 ) 款項下第二段有關污染清理費用保險責任的全部規定, 並以下文替代 : 1.2 any necessary and reasonable clean-up expenses arising out of any statutory requirement that the Insured controls the spread of Pollutants or to test for, monitor, clean up, remove, contain, treat, detoxify or neutralize or in any way respond to Pollutants or their effect. Provided that the cover provided by this Item 1.2 is sub-limited to a maximum of (insert sub-limit any one Occurrence and in the aggregate) any one Occurrence and in the aggregate any one Policy Period. All other terms, conditions, and exclusions of the policy shall remain unchanged. 被保險人根據司法管轄區域適用的環保法律法規的規定, 為控制污染物擴散, 或者對污染物進行測試 監測 清理 遷移 儲存 處理 除毒 中和或以任何方式對污染物採取應對措施而支出的必要且合理的清汙費用, 本公司按照本保險合約約定, 以下列分項責任限額為限向被保險人承擔相應的賠償責任 : 每次事故及保險期間累計 [ 填入每次事故及保險期間累計分項責任限額金額 ] 不保事項同主保險契約不保事項或除外責任之約定 短期費率表同主保險契約之約定

21 (Energy and Construction Risk)-Principal s Vicarious Liability Endorsement (104) 美亞保字第 0128 號函備查 承保範圍 This Policy is extended to indemnify any principal for that principal s vicarious liability for the negligent acts or omissions of the Insured arising out of the Insured s Business, but this Policy does not extend to the liability of any principal arising out of the sole negligence of such principal. Provided always that all such principals shall, whilst not being a party to this contract, observe, fulfil and be subject to the terms of this Policy in so far as they can apply as though they were the Insured. All other terms, conditions, and exclusions of the policy shall remain unchanged. 茲經雙方理解並同意, 本保險合約擴大承保被保險人因從事被保險業務過程中的過失行為或疏忽導致任何業主承擔連帶責任, 但本保險合約不承保任何由於業主的單獨過失所引起的賠償責任 作為本公司在本條款項下承擔任何保險責任的前提條件, 被保險人應促使上述業主如同其為被保險人一樣遵守 履行和執行本保險合約的各項規定 不保事項同主保險契約不保事項或除外責任之約定 短期費率表同主保險契約之約定

22 (Energy and Construction Risk)-Sanction Clause (104) 美亞保字第 0193 號函備查 承保範圍 It is hereby understood and agreed that the Insurer shall not be deemed to provide cover and the Insurer shall not be liable to pay any claim or provide any benefit hereunder to the extent that the provision of such cover, payment of such claim or provision of such benefit would expose the Insurer, its parent company or its ultimate controlling entity to any sanction, prohibition or restriction under United Nations resolutions or the trade or economic sanctions, laws or regulations of the European Union or the United States of America. 茲經雙方同意, 本公司對本保險契約遇有承保範圍內之毀損或滅失或該履行之保險給付責任, 如該保險給付導致本公司 本公司之母公司或最終控股公司違反聯合國決議之制裁 禁令或限制 ; 或違反經歐盟或美國所作貿易或經濟制裁 法規或法律規定等任何相關之規定時, 本公司不負任何賠償責任 All other terms, conditions and exceptions remain unchanged. 本附加條款所記載事項, 如與主保險契約條款抵觸時, 依本附加條款之約定辦理, 其他事項仍適用主保險契約條款之約定 不保事項同主保險契約不保事項或除外責任之約定 短期費率表同主保險契約之約定

25 (Energy and Construction Risk)-Underground Services Property Damage Exclusion (With Write-Back) (104) 美亞保字第 0129 號函備查 承保範圍 This Policy does not cover liability directly or indirectly caused by, arising out of or in any way connected with loss of or Property Damage to underground services (such as but not limited to water, gas, sewerage or fuel pipes, electric or telephone cables) or any other underground property or structure for the purpose of storing, conveying, transporting, transmitting or delivering of electricity, water, gas, fuel, telecommunications media, signals, radio or other waves unless: 茲經雙方理解並同意, 本保險合約不承保直接或間接因用於存儲 輸送 運輸 傳送或供應電 水 氣體 燃料 電信媒介 信號 無線電波或其它波形態的地下設施 ( 包括但不限於供水 供氣 汙水處理或燃料管道 電力或電信電纜 ) 或任何其它地下財產或結構體發生的損失或財產損害所引起的 產生的或與之有關的任何責任 但是, 如屬下列情形, 則本項責任免除條款不適用 : 1. prior to the commencement of any works, the Insured has inquired with all relevant public authorities or owners of such underground services, property or structure as to the exact location of such underground services, property or structure and takes all necessary action to avoid damage to such services, property or structure; and 2. any indemnity provided by the above proviso shall in any case be restricted solely to the direct cost of repair, replacement or reinstatement of such damaged services, property or structure and any loss of use or consequential loss of any kind is excluded. 27 (Energy and Construction Risk)-Vibration and/or Removal and/or Weakening of Support Extension (Total or Partial Collapse) (104) 美亞保字第 0131 號函備查 承保範圍 Notwithstanding Exclusion 9. of Section E General Exclusions, this Policy is extended to cover liability arising out of Property Damage to any property, land or building caused by vibration or by the removal or weakening of support or of Bodily Injury occasioned by or resulting from any such loss or damage. Provided always that: 1. We will indemnify the Insured in respect of liability for loss or damage to any property or land or building only if such loss or damage results in the total or partial collapse; 2. We will indemnify the Insured in respect of liability for loss or damage to any property or land or building only if prior to the commencement of construction its condition is sound and the necessary loss prevention measures have been taken; 3. If required, the Insured, before commencement of construction and at his own expense, prepares a report on the condition of any endangered property or land or building. We will not indemnify the Insured in respect of liability for: a) Loss or damage which is foreseeable having regard to the nature of the construction work or the manner of its execution; b) Superficial damage which neither impairs the stability of the property, land or buildings nor endangers their users; c) The costs of loss prevention or minimization measures which become necessary during the Policy Period. In respect of each and every occurrence of loss or damage covered under this clause we shall not be liable for the first % of the indemnity. All other terms, conditions, and exclusions of the policy shall remain unchanged. 茲經雙方理解並同意, 第 E 部份 一般除外條款之第 9 條予以刪除, 本保險擴大承保被保險人由於支撐物發生震動 移動或作用減弱造成任何財產 地面 建築物財產損害以及由其造成的身體傷害而依法承擔的賠償責任, 但須符合下列所有條件 : 1. 上述財產或建築物全部或部分倒塌, 或者地面塌陷 ; 2. 被保險人在施工前, 財產 地面或建築物處於完好狀態, 並採取了必要的損防措施 ; 3. 經本公司要求, 被保險人在施工前應自負費用向本公司提供書面報告, 說明任何面臨危險的財產 地面或建築物的狀況 在本條款項下, 本保險對下列事項不承擔任何賠償責任 :

30 (Energy and Construction Risk)-Waiver of Subrogation Endorsement (104) 美亞保字第 0132 號函備查 承保範圍 It is understood and agreed that the Company waives its rights of subrogation acquired against the organisation as named below: and its Affiliates, Subsidiaries and Associated Companies and the Officers, Directors and Employees of all of them for whom the Named Insured is providing services or performing operations by reason of any payment under this Policy, except that this waiver shall not extend to cover losses caused by acts of any such Principals or Contractors which are not connected with operations being conducted by the named Insured and covered by this Policy. It is further understood and agreed that this waiver of rights of subrogation shall not apply as respects liability arising out of the sole negligence of any Principal or Contractor. For the purpose of this clause, subsidiary, associated company, officer and director shall bear the meaning defined under regulation in R.O.C. Taiwan. However this insurance shall not apply as respects any liability arising out of the sole negligence of any Additional Insured.
