3 美國敗訴後,DSB 在 2012 年 4 月通過上訴機構報告 ; 美國並於同年 5 月通知 DSB 其有意願執行 DSB 的建議與裁決 ; 而美國敗訴後之合理執行期間為 15 個月, 也就是於 2013 年 7 月 24 日前美國必須改正其國內對於丁香菸的歧視法案然而美國於合理期間屆至時仍未修改之, 印尼遂於 2013 年 8 月 12 日要求 DSB 13 依 DSU 第 22.2 條授權對美國採取暫停減讓, 即貿易報復 14 不過, 美國於 2013 年 8 月 22 日提出本案因有 DSU 第 22.6 條規定之情形, 因而主張相關的暫停減讓安排, 應交付仲裁程序處理然而, 在仲裁程序進行中, 美國與印尼於 2014 年 6 月 23 日要求不發布 (circulate) 仲裁判斷 ; 雙方並在同年 10 月 3 日通知 DSB 已達成一相互同意的解決方案 (mutually acceptable solution), 本項爭端已終局獲得解決, 印尼並向 DSB 撤回其請求 DSB 授權報復之要求 15 最後, 於同年 10 月 8 日, 首席仲裁人通知 DSB 已無需就此項爭端發布仲裁決定 (decision) ( 三 )MOU 內容簡介本案 MOU 之主要內容係美國與印尼協議使美國得維持其對風味菸 ( 薄荷菸除外 ) 採取的措施印尼之所以同意以 MOU 內容取代其在 WTO 下所可能取得對美國實施之報復措施, 係因印尼認為透過該 MOU 之內容, 其所可能獲得的利益遠比 5 千 5 百萬美元的報復總值要來得高 Understanding on Rules and Procedures Governing the Settlement of Disputes, art.22.2: If the Member concerned fails to bring the measure found to be inconsistent with a covered agreement into compliance therewith or otherwise comply with the recommendations and rulings within the reasonable period of time determined pursuant to paragraph 3 of Article 21, such Member shall, if so requested, and no later than the expiry of the reasonable period of time, enter into negotiations with any party having invoked the dispute settlement procedures, with a view to developing mutually acceptable compensation. If no satisfactory compensation has been agreed within 20 days after the date of expiry of the reasonable period of time, any party having invoked the dispute settlement procedures may request authorization from the DSB to suspend the application to the Member concerned of concessions or other obligations under the covered agreements. 14 Understanding on Rules and Procedures Governing the Settlement of Disputes, art.22.6: When the situation described in paragraph 2 occurs, the DSB, upon request, shall grant authorization to suspend concessions or other obligations within 30 days of the expiry of the reasonable period of time unless the DSB decides by consensus to reject the request. However, if the Member concerned objects to the level of suspension proposed, or claims that the principles and procedures set forth in paragraph 3 have not been followed where a complaining party has requested authorization to suspend concessions or other obligations pursuant to paragraph 3(b) or (c), the matter shall be referred to arbitration. Such arbitration shall be carried out by the original panel, if members are available, or by an arbitrator15 appointed by the Director-General and shall be completed within 60 days after the date of expiry of the reasonable period of time. 4 該 MOU 之其他內容則包含 17 :(1) 美國承諾關於對印尼的普遍化優惠關稅制度 (Generalized System of Preference, GSP) 18 中, 給予印尼絕緣生火配線裝置產品 (insulated ignition wiring sets) 的免關稅優惠 ;(2) 關於印尼對礦物產品制定之相關進口限制措施, 美國將延期對其提起 WTO 訴訟 ;(3) 美國在制定非恣意與非歧視性的新措施之前, 將不會禁止印尼的雪茄進口至美國 ( 因部分丁香菸業者將丁香菸以雪茄的形式銷往美國 );(4) 美國也會協助印尼改善智慧財產權的保護與執行, 幫助印尼國內建立更好的智慧財產權體制 ; 而兩國也同意在丁香菸案成功解決後, 將會在既有的印美貿易與投資架構協議 (Indonesia-US Trade and Investment Framework Arrangement, TIFA) 下更進一步廣泛正面地加強彼此經貿關係二 WTO 爭端解決機制之二項重要目標 : 鼓勵會員合意解決爭端與確保會員享有 WTO 協定下之權利 - 兼論本案 MOU 在爭端解決體系中之定位如同前述, 本案經由美國與印尼雙方合意達成之 MOU, 其內容使已被 DSB 宣告違法的措施得以繼續維持, 如此是否符合 DSU 之規定? 換言之, 在 DSU 中是否有相關規定足以支持這樣的爭端處理結果? 基於本案 MOU 係透過雙方合意而達成, 且本案 MOU 之內容使已被 DSB 宣告違法的措施得以繼續維持, 而似乎侵害了會員在 WTO 協定下之權利, 因此, 在探討本案 MOU 合法性之時, 本文以下將先指出 DSU 之二項重要目標 : 鼓勵會員合意解決爭端與確保會員享有 WTO 協定下之權利, 以及與此二項目標相關之 DSU 條文, 並檢視本案之 MOU 是否符合該些 DSU 條文 ( 一 ) WTO 爭端解決機制之目標 19 按 DSU 第 3.2 條規定 : WTO 之爭端解決制度係提供多邊貿易體系安全性及可預測性之重要因素會員咸認此制度旨在維護其於內括協定下之權利義務, 17 Indonesia and the United States Agree to Stop Clove Cigarette Case, supra note 6; Indonesia Announces Deal with US on Clove Cigarettes Trade Dispute, ICTSD, Vol.18, No. 43, Dec. 18, 2014, available at -trade-dispute (last visited Jan. 7, 2015); U.S., Indonesia end clove dispute, POLITICO, Oct. 6, 2014, available at (last visited Jan. 7, 2015). 18 此係已開發國家對開發中國家出口產品給予的普遍不歧視非互惠之優惠關稅, 有助於開發中國家增加出口工業化與經濟發展 19 Understanding on Rules and Procedures Governing the Settlement of Disputes, art.3.2: The dispute settlement system of the WTO is a central element in providing security and predictability to the multilateral trading system. The Members recognize that it serves to preserve the rights and obligations of Members under the covered agreements, and to clarify the existing provisions of those agreements in accordance with customary rules of interpretation of public international law. Recommendations and rulings of the DSB cannot add to or diminish the rights and obligations provided in the covered agreements. 17

5 並依國際公法之解釋慣例, 釐清內括協定之規定 DSB 之建議及裁決, 不得增減內括協定所規定之權利義務此條文所揭櫫者, 係使多邊貿易體系具備穩定性與可預測性, 提供一個快速獨立有效率以及規則導向的系統解決 WTO 體系下的爭端, 亦係 DSU 之終極目標 20 在此項終極目標之下,DSU 尚有多項衍生之重要目標與功能, 諸如確保會員之權利與義務透過解釋釐清爭端當事國之權利與義務以當事國同意之解決方案較為優先等 21 由於本案的 MOU 係透過雙方合意而達成, 且本案 MOU 之內容使已被 DSB 宣告違法的措施得以繼續維持, 故, 與本案最為相關之 WTO 的爭端解決機制之重要目標主要為鼓勵會員合意解決爭端與確保會員享有 WTO 協定下之權利, 是以下先列出與此二目標相關之 DSU 條文 WTO 爭端解決體系十分鼓勵會員合意解決爭端觀察 DSU 中有關鼓勵會員合意解決爭端之條文可知, 該些條文多同時強調該項合意必須同時地確 22 保會員在 WTO 下之權利或義務被落實如 DSU 第 3.7 條規定 : 爭端解決機制旨在以有利方式解決爭端, 爭端當事國應儘可能以合意且符合內括協定規定之方式達成協議另外, 在 DSB 建議或裁決之執行階段, 爭端當事國雙 23 方在達成補償協議時, 按 DSU 第 22.2 條規定 : 該會員因他會員之請求, 應於合理期間屆滿前, 與提起爭端解決程序之任一當事國進行諮商, 以尋求雙方 24 可以接受之補償此時並應遵守 DSU 第 22.1 條規定 : 補償係自願性, 倘承諾給與, 應符合內括協定之規定 20 WTO, A HANDBOOK ON THE WTO DISPUTE SETTLEMENT SYSTEM 2 (2004), available at (last visited Jan. 7, 2015). 21 Id. at Understanding on Rules and Procedures Governing the Settlement of Disputes, art. 3.7: Before bringing a case, a Member shall exercise its judgement as to whether action under these procedures would be fruitful. The aim of the dispute settlement mechanism is to secure a positive solution to a dispute.a solution mutually acceptable to the parties to a dispute and consistent with the covered agreements is clearly to be preferred. In the absence of a mutually agreed solution, the first objective of the dispute settlement mechanism is usually to secure the withdrawal of the measures concerned if these are found to be inconsistent with the provisions of any of the covered agreements. The provision of compensation should be resorted to only if the immediate withdrawal of the measure is impracticable and as a temporary measure pending the withdrawal of the measure which is inconsistent with a covered agreement. The last resort which this Understanding provides to the Member invoking the dispute settlement procedures is the possibility of suspending the application of concessions or other obligations under the covered agreements on a discriminatory basis vis-à-vis the other Member, subject to authorization by the DSB of such measures. 23 Understanding on Rules and Procedures Governing the Settlement of Disputes, art.22.2, supra note Understanding on Rules and Procedures Governing the Settlement of Disputes, art.22.1: Compensation and the suspension of concessions or other obligations aretemporary measures available in the event that the recommendations and rulings are not implemented within a reasonable period of time. However, neither compensation nor the suspension of concessions or other obligations is preferred to full implementation of a recommendation to bring a measure into conformity with the covered agreements. Compensation is voluntary and, if granted, shall be consistent with the covered 18

6 由上述條文可知,WTO 爭端解決體系雖十分尊重爭端當事國之意志, 鼓勵爭端當事國能共同尋求相互滿意的解決方案, 此種解決方案係較佳較優先之爭端解決方案 ; 然而同時也要求會員應恪守會員在 WTO 協定下之權利與義務因此, 本案 MOU 是否符合 WTO 爭端解決機制要求會員於合意解決爭端之同時, 亦應同時確保會員在 WTO 下權利或義務被落實之要求, 不無疑義儘管如此, 本文以下仍將繼續檢視本案 MOU 是否得落入 DSU 之其他規定中 ( 二 ) 檢視本案 MOU 是否落入 DSU 之其他規定基於本案 MOU 係經雙方合意而達成, 因此本文檢視 DSU 有關透過雙方合意尋求解決方案之其他條文, 分述如下 : 1. DSU 第 4.3 條 25 在諮商階段, 按 DSU 第 4.3 條規定 : 如依內括協定提出諮商請求, 除當事國另有合意外, 被指控國應於收到請求後十日內答覆, 並於三十日內以善意進行協商, 以期獲致雙方滿意之解決如會員未能於收到請求後十日內答覆, 或三十日內展開諮商, 或於其他合意之期間內為之者, 則請求諮商之會員得逕要求成立小組然而, 對照本案, 本案之程序已進入執行階段之後期, 即交由仲裁庭處理相關授權報復事宜, 而 DSU 第 4.3 條係規範諮商階段, 故其非屬第 4.3 條所欲規定爭端當事國得透過諮商達成雙方合意的解決方案 2. DSU 第 5 條 DSU 中有關斡旋調解及調停之規定為第 5 條, 雖該條無直接明文雙方合意或類此之用語, 然因斡旋調解及調停在性質上亦屬須經爭端當事國之同 26 意始得採取之爭端解決方式, 此可見 DSU 第 5.1 條之規定 : 如爭端當事國同意, 得自行約定採取斡旋調解及調停之程序因此, 以下本文將檢視斡旋調解及調停中之相關規定 agreements. 25 Understanding on Rules and Procedures Governing the Settlement of Disputes, art.4.3: If a request for consultations is made pursuant to a covered agreement, the Member to which the request is made shall, unless otherwise mutually agreed, reply to the request within 10 days after the date of its receipt and shall enter into consultations in good faith within a period of no more than 30 days after the date of receipt of the request, with a view to reaching a mutually satisfactory solution. If the Member does not respond within 10 days after the date of receipt of the request, or does not enter into consultations within a period of no more than 30 days, or a period otherwise mutually agreed, after the date of receipt of the request, then the Member that requested the holding of consultations may proceed directly to request the establishment of a panel. 26 Understanding on Rules and Procedures Governing the Settlement of Disputes, art.5.1: Good offices, conciliation and mediation are procedures that are undertaken voluntarily if the parties to the dispute so agree. 19

7 27 按 DSU 第 5.3 條規定 : 任一爭端當事國得隨時請求斡旋調解及調停, 並得隨時開始或終止一經終止斡旋調解及調停程序, 指控國得要求設立小組 28 DSU 第 5.4 條規定 : 如斡旋調解及調停於收到請求諮商後六十日內為之, 指控國必須俟屆滿六十日後, 方得要求成立小組, 惟如爭端當事國均認為斡旋調解及調停無法解決爭端時, 指控國於六十日期間內得要求成立小組 DSU 29 第 5.5 條規定 : 小組成立後, 如爭端當事國同意, 亦得繼續進行斡旋調解及 30 調停程序 DSU 第 5.6 條規定 : 秘書長得依其職權, 提議展開斡旋調解及調停, 以協助會員解決爭端由第條可知, 此二條文係在規範小組成立前之斡旋調解及調停程序 ; 而第 5.5 條係在規範小組程序進行中同時進行之斡旋調解及調停 ; 第 5.6 條則在規範由秘書長提議展開之斡旋調解及調停 ; 就此, 對照本案之 MOU, 其並非發生於小組成立前或成立時之階段, 亦非由秘書長提議展開, 而係由美國與印尼自行主導, 因此非 DSU 第 5 條所欲規範之對象 3. DSU 第 22.1 條第 22.2 條在 DSB 建議或裁決之執行階段, 按 DSU 第 22.1 條 : 補償及暫停減讓或其他義務, 係於建議或裁決未能於合理期間內執行情況下之暫時性措施惟建議之充分執行使採行之措施符合內括協定, 應優先於暫停補償及減讓或其他義務補償係自願性, 倘承諾給與, 應符合內括協定之規定 DSU 第 22.2 條 : 若有關之會員未能使與內括協定不一致之措施符合內括協定或未能於依第 21.3 條所規定之合理期間內遵行建議及裁決時, 該會員應其他會員之請求, 應於合理期間屆滿前, 與提起爭端解決程序之任一當事方進行諮商, 以尋求雙方可以接受之補償 27 Understanding on Rules and Procedures Governing the Settlement of Disputes, art.5.3: Good offices, conciliation or mediation may be requested at any time by any party to a dispute. They may begin at any time and be terminated at any time. Once procedures for good offices, conciliation or mediation are terminated, a complaining party may then proceed with a request for the establishment of a panel. 28 Understanding on Rules and Procedures Governing the Settlement of Disputes, art.5.4: When good offices, conciliation or mediation are entered into within 60 days after the date of receipt of a request for consultations, the complaining party must allow a period of 60 days after the date of receipt of the request for consultations before requesting the establishment of a panel. The complaining party may request the establishment of a panel during the 60-day period if the parties to the dispute jointly consider that the good offices, conciliation or mediation process has failed to settle the dispute. 29 Understanding on Rules and Procedures Governing the Settlement of Disputes, art.5.5: If the parties to a dispute agree, procedures for good offices, conciliation or mediation may continue while the panel process proceeds. 30 Understanding on Rules and Procedures Governing the Settlement of Disputes, art.5.6: The Director-General may, acting in an ex officio capacity, offer good offices, conciliation or mediation with the view to assisting Members to settle a dispute. 20

8 然而, 對照本案, 因本案之程序已進入執行階段之後期, 即交由仲裁庭處理相關授權報復事宜, 非屬補償協議之階段, 故第 22.2 條規定雙方得透過諮商以尋求雙方均可接受之補償, 亦無法規範本案之情形 ; 何況, 補償乃係由敗訴國提供控訴國之暫時性優惠, 例如降低關稅, 並有最惠國待遇原則之適用, 而使其他非控訴國亦享有此項優惠 31, 而本案 MOU 之內容是否為暫時性? 其他國家是否得依最惠國待遇原則享有美國在 MOU 中給予印尼之利益? 其解恐非屬肯定三結論觀察本案 MOU 之內容並檢視 DSU 之相關條文後可知, 本案 MOU 雖係基於雙方合意而達成, 然該 MOU 之內容使美國得維持其已被 DSB 宣告違法的風味菸禁令 ; 且關於印尼對礦物產品制定之相關進口限制措施是否合於 WTO 規定, 美國亦將延期對其提起 WTO 訴訟 ; 此似乎與 DSU 追求確保會員在 WTO 協定下之權利與義務之目的有所扞格 ; 且本案 MOU 目前似乎尚無法於 WTO 爭端解決體系中找到定位此外, 更有指出, 在原先 DSU 設計下, 不論已開發或開發中國家皆被平等對待, 然而本案 MOU 之處理方式, 使會員之間可以透過政治與經濟權力, 或甚至其他形式的處理方式, 以換取欲追求之利益 ; 經濟實力較小的國家雖然勝訴, 卻無能促使已開發國家遵守 WTO 義務 32, 使得條文化法制化的 WTO 多邊貿易體系, 似乎並非那麼地以規則為導向 33 ; 再者, 若此種爭端解決結果被允許或維持, 那麼 WTO 條文中規定的義務, 將如何被實現? 況且, 不論係本案 MOU, 或係美國與巴西高地棉案之 MOU, 均對於參與爭端解決程序之第三國造成程序浪費以上均使 WTO 爭端解決體系在理論上與實務上面臨危機 34 雖然目前 WTO 爭端案件的執行情形尚屬良好, 大約 80-85% 的案件都獲得執行 35, 但 2014 年 10 月以來美國連續二起以維持已被 DSB 宣告違法措施之 MOU 內容終局解決爭端之情形, 使吾人值得思考 WTO 爭端解決體制鼓勵會員合意解決爭端與確保會員在 WTO 協定下之權利與義務二目標之權衡關係, 究竟為何? 以及如何能更妥適的達到 DSU 制度設計之終極目標, 即 : 維 31 WTO, supra note 20, at Michelle Limenta, After Kretek Quarrel With US, What Future for WTO Dispute Settlement, JAKARTA GLOBE, Oct. 14, 2014, available at (last visited, Jan. 7, 2014). 33 Simon J.
