2 一出國目的 : 參加 ICANN 58 Copenhagen, Denmark 二會議行程 : 詳如會議網站三考察訪問心得 : ICANN 58 Copenhagen Meeting 前言此次 ICANN 58 Copenhagen Meeting 主要針對 IANA 移轉後之相關 ccnso 組織之相關社群議題並對 ICANN Accountability 進行討論, 本中心為 ICANN ccnso 之正式會員, 此行將以參與 ccnso 會議為主 ; 有關此次會議相關之討論包括 Chinese, Japanese and Korean Generation Panels Root Zone Label Generation Rules 之協調 ccnso 在 IANA 移轉後與 ICANN 之間關係的定位 ICANN Accountability 及 Post-IANA ICANN 立案所在地之司法管轄權對業務營運之影響另本中心亦為 ICANN Registry Technical Back-end 及 ICANN Accredited Registrar 也持續與 ICANN gtld 社群洽接相關事宜 ; 此行亦當面邀請 ICANN GAC 主席 Thomas Schneider 參加本年度 12 月本中心舉辦之 Taiwan Internet Forum 以下即針對 ICANN 立案所在地之司法管轄權 ccnso 會員與 ICANN 移轉後之間的關係及有關 Cross-Community Working - Framework for use of Country and Territory Names as TLDs 的 Interim Paper ( 過渡性報告 ) 等議題之參與觀察及建議 ICANN 立案所在地之司法管轄權 ICANN 自 Marrakech 將討論多時的 CCWG 之 Proposal 在經過各社群同意後, 正式完成所有 Transition Stewardship of Key Internet Functions 計畫書, 並於 2016 年 3 月 10 日正式通過, 由 ICANN 董事第 2 頁, 共 9 頁

3 會主席 Dr. Steve Crocker 提交給美國政府 NTIA 該計畫為因應美國政府計畫將 IANA ( 互聯網號碼分配機構 ) 技術功能管理權宜交給全權一個非政府的多利益共同體 (multi-stakeholders) 進行管理然而, 經美國政府同意 ICANN 所提交之計畫後,ICANN 仍以美國加州為法人立案地 ; 因此, 美國加州對於 ICANN 具有為司法管轄在此次 ICANN 會議所舉行的 Public Forum 中, 即有來自社群的發言, 對於 ICANN 的法人立案所在地及受美國加州之司法管轄問題, 向 ICANN Board 提問自從 ICANN 以一個非政府的多利益共同體 (multi-stakeholders) 方式進行管理後, 仍以加州為其法人登記立案所在地, 此舉引發許多網路社群不同的聲音 ; 為此, 在 ICANN 58 Copenhagen 會議前,ICANN 即進行了一份網路調查, 想瞭解是否加州立案的 ICANN 會對 Registry 或 Registrar 在業務執行面上會造成任何的影響 ICANN 董事會主席 Dr. Steve Crocker 在 Public Forum 回覆司法管轄權問題對於 ICANN 立案所在地及受美國加州之司法管轄問題 ICANN 董事會主席 Dr. Steve Crocker 在 Public Forum 正式回覆 Crocker 從網際網路的源起來談 ICANN 在加州的歷史成因, 網際網路從開放式的架構, 由全球網路社群參與, 才能讓網路互通互聯 ; 而不同的司法管轄權也不會影響 ICANN 服務全球網路社群的宗旨, 這也不是成立另一個 ICANN 與否的問題在開幕演說中, 丹麥文化部長 Mette Bock (Minister for Culture) 也呼應了 ICANN 董事會主席 Dr. Steve Crocker Bock 表示 : "Self-regulation is very near and dear to my heart, and we are 第 3 頁, 共 9 頁

4 pleased to see that the new accountability mechanism could be accommodated under Californian law so there was no need to consider another jurisdiction but, of course, ICANN would be most welcome in Denmark." 丹麥文化部長 Mette Bock 表示多利益共同體的網路治理重要性 Bock 指出 : 這是非常重要的對於 ICANN 社群持續致力於問責機制的議題上, 同時涵括尚待討論及須同意的九個領域的各種問題然而, 仍有相當多不同的議題, 無論是性別, 代表性, 地域代表性還是年齡這是必須解決的問題, 以確保將 ICANN 的合法性毫無疑問的成為真正的全球多利益共同體的機構我讚賞那些投入大量時間和精力的人參與多方利益共同體程序的人而丹麥也肯定地支持這種網際網路治理模式 (It is important that the ICANN community continues to work on accountability issues and conclude with the nine areas that remain to be discussed and agreed, among others, the question of diversity. Here there is still quite a way to go, be it gender, representation, geographical representation, or age. This is an issue that must be solved in order to secure that there's no doubt about ICANN's legitimacy as a true global multistakeholder organization. I recommend the work of all those who have devoted so much of their time and energy to engage with the multistakeholder processes. 5 cctld Managers Accountability ICANN 經美國政府同意以一個非政府的多利益共同體 (multi-stakeholders) 進行管理後, 因應 multi-stakeholders 管理模式的問責機制便成為 ICANN 社群聚焦討論的重點, 以確保 ICANN 內部組織結構與營運責任以確保多利益共同體的基本精神, 能得以隨著 IANA 移交後, 能由全體社群共治共享共管具體體現在 cctld 社群對於 ICANN 問責機制的討論, 具體的在此次 ICANN 58 Copenhagen 會議中進行討論回溯到 2005 年 12 月,ccNSO 通過了 ICANN 與 cctld 管理者之間的責任框架協商原則該原則旨在協助 cctld 管理者與 ICANN 間討論問責機制框架或以交換信的模式達成根據 ICANN 統計迄今為止, 已 70 個國家或地區頂級國碼域名 (cctld) 管理者已經和 ICANN 間簽署了一個問責制制或交換信 ( 請詳連結資訊而在 ICANN 獲美國政府同意以多利益共同體管理模式後, 即有一些國家或地區的頂級國碼域名 (cctld) 表示希望能進入一個與 ICANN 間的實體書面關係在繼 ICANN 57 海德拉巴會議後, 此次哥本哈根會議特別針對此議題進行討論根據 Guidelines for cctld managers Accountability Framework discussions with ICANN, 問責機制框架 (AF) 應該是一個簡單的聲明, 其中 ICANN 和 cctld 管理者間明確界定責任和責任領域之並在確保相互承諾彼此的基礎上, 確保持續穩定 DNS 的相互操作性 (interoperability) 第 5 頁, 共 9 頁

6 ICANN 原始揭櫫的問責機制框架圖 Source: ICANN 在討論中, 對於 ICANN 與 cctld 管理者之間的關係確立, 因涉及國碼之國家利益與代表性, 及網路治理的歷史源起所召示的由下而上之原則, 並尊重原 cctld 管理者之治理權限等因素, 對於政府涉入的部份, 指導原則指出如下 : With the exception of circumstances where a) the cctld is managed by the government of the country or b) the cctld managers is under contract to the government of the country or c) at the choice of the cctld manager, the AFWG does not believe that the entering into of an AF should need to involve consultation with the cctld managers government and it does not believe that an AF should contain any terms related to government. 除此之外, 在某些情況下,AF 包括確保 cctld 管理者在履行其職責時, 得適用於相關之法律規定, 並不受 ICANN 任何具歧視性或任意性之作法及在政策或程序上的約束這對頂級國碼域名來說, 保有相關管理權責與適當之權利第 6 頁, 共 9 頁

7 Use of Country and Territory Names 有關國家名稱之使用, 在 ICANN 當初開放 New gtld 時, 為保有各國政府對於屬於公共財產之國家名稱應由相關政府進行管理之原則下, 對於在第二層使用 2 字元或 3 字元之開放有所限定然而, 在社群討論中,gNSO 普徧性的傾向較自由化的方式來開放這些名稱與字元之使用而 ICANN Board 也經過討論後於去年 11 月 8 日即以下述的方式進行開放 : Whereas, Specification 5, Section 2 of the New gtld Registry Agreement requires registry operators to reserve two-character ASCII labels within the TLD at the second level. The reserved two-character labels may be released to the extent that Registry Operator reaches agreement with the related government and country-code manager of the string as specified in the ISO alpha-2 standard. The Registry Operator may also propose the release of these reservations based on its implementation of measures to avoid confusion with the corresponding country codes, subject to approval by ICANN. 但對於國家名稱於頂級 TLD 之使用, 在上次海得拉巴會議中即被充份的跨社群討論但對於 ICANN 與各國政府在有關國家名稱之使用上的關切程度與職責,GAC 的討論則備受關注 ; 其中,GAC 與 ccnso 進行會議時, 就 Cross-Community Working Group on Use of Country/Territory Names as TLDs (CCWG-UCTN) 的報告進行意見交換時, 即認為在 TLD 開放地理名稱不是僅為 New gtld 的新課題, 而需要經過跨社群的政策發展程序以納入更多的意見與討論因此, 上次 ICANN 會議中即預計於 ICANN 58 次會議前再針對 CCWG-UCTN 進行討論然而, 此次的 Cross-Community Working Group on Use of Country/Territory Names as TLDs (CCWG-UCTN) 的過度性建議書並未達成具體的共識或任何的解決方案, 並提出了三種版本的替代性方案 : Alternative A (A 替代方案 ) Future work should take place with the authority of a policy development process under ICANN s Bylaws, with a clearly drafted 第 7 頁, 共 9 頁

8 Charter or scope of work that sets out how conclusions and recommendations will inform that policy development process. This addresses a key deficiency of this CWG, as it has not been made clear how the group s work can or will be incorporated in policy-making pursuant to ICANN s Bylaws. 此方案著重於在 ICANN 的 Bylaws 下, 與相關當局的政策發展結合 Alternative B (B 替代方案 ) To ensure that the conclusions and recommendations of a CWG will at one point have the authority of a policy developed through the relevant processes under ICANN s Bylaws, future work should take place with a clear view on how this work at some point will reach the authority of a policy developed as or relates to and provides input to formal policy development processes. With regard to the subject matter, the use of country and territory names as TLDs CWG notes that this should be defined with respect to both the ccnso and GNSO Policy development processes. Due to the overlapping definitions used under existing policies, additional policy developed by one group, may impact and have an effect upon the policy developed by another group. Avoiding this issue may be achieved through a clearly drafted Charter or scope of work that sets out how these policy development processes will be informed. This addresses a key deficiency this CWG has encountered, as it has not been made clear how the group s work can or will be incorporated in policy-making pursuant to ICANN s Bylaws. 此方案著重於應將相關當局的政策發展結合並注入於正式政策的發展程序中 Alternative C (C 替代方案 ) Future work should clearly align with ICANN policy development processes, and should have a clearly drafted Charter or scope of work that sets out how conclusions and recommendations will inform ICANN policy development. 此方案著重於應明確與 ICANN 政策發展結合並應確定工作章程或範圍第 8 頁, 共 9 頁

9 上述三個替代方案, 依 ICANN 表示, 以較少多數傾向於方案 C 對這些替代方案, 無論哪一種結構是首選, 然而, 最主要的議題仍在於使用國家和地區名稱作為 TLD 都與 ccnso 和 GNSO 在政策制定流程和協調的範圍上有關建議事項因應 ICANN 社群在多利益共同體的網路治理模式下, 之前 gnso 已在 New gtld 開放第二層國碼之註冊上取得社群認同因此, 未來在 TLD 頂級國碼有關國家名稱及相關地理名稱之使用議題, 應建立中心立場並與我國 GAC 代表就使用上有相同之意見, 以維護國碼.tw/. 台灣之價值及在我國相關屬公共財產財的國家與地理名稱應受我國當局管理 ICANN 在多利益共同體的網路治理模式下經過討論與共識決定方式決定相關政策, 就以目前持續討論之有關國家名稱及相關地理名稱之使用議題, 建議本中心應持續參與 ICANN 會議進行議題之掌握, 以維護現有.tw/. 台灣國碼域名註冊者之權益目前.tw/. 台灣國碼域名與 ICANN 之間關係以三方合約之方式彼此認可相互維運.tw/. 台灣國碼域名 ; 如同此次 ICANN 58 Copenhagen 開幕時,Crocker 從網際網路的源起來談 ICANN 在加州的歷史成因, 網際網路從開放式的架構, 由全球網路社群參與, 才能讓網路互通互聯因此, 建議繼續維持雙方已建立之穩定的既有關係, 並以 DNS 穩定與安全維運為持續努力之方向 ICANN 的下一次會議將於 2017 年 6 月日於 Johannesburg, South Africa 舉行有關 ICANN58 次會議相關資訊, 請參考第 9 頁, 共 9 頁
