Since t he criminal law has prescribed ext remely severe statutory penalty, especially the minimum statutory penalty, for the crime of kidnapping, consti2 tutive elements of the crime of kidnapping should be interpreted as restrictively as possible, so as to ensure that the determination of the crime is proportional to the severe statutory penalty of the crime. The subjective aim of t he crime of kidnapping is to extort a huge sum of ransom or to achieve other major illegal objectives. The objective act of the crime is limited to the taking of hostage by violent means and extorting money or property by taking advantage of a third party s concern for the hostage s safety. The rights violated by such crime include not only the hostage s right to person, but also the self - determination of a third party. There should be room for dis2 continuation of crime between the act of kidnapping and the act of extortion. 44
