A Survey and Recon sidera tion of the Investiga tion Superv ision System : Ba sed on a Positive Study ZUO W ei2m in, ZHAO Kai2nian (Law Schoo l, Sichuan University, Chengdu 610064, China) Abstract:A positive study of the supervision over crim inal investigation show s that the investigation power has not been actually controlled. W hile exercising supervision, peop le find that the supervision lacks authority and no effective measures are taken. Moreover, the supervision is exercised m erely on case reco rds. During the judicial reform, the p rosecution tried to intervene in the investigation, thus to achieve som e results, which are, however, of controversy. This author m aintains that the reason why the investigation power is not effectively contro lled lies in the fact that the notion of supervision of investigation highlights control of crim es rather than p rotection of human rights. The institution that exercises the supervision has no power to regulate illegal investigation acts or restrain personnel who breach investigation p rovisions. Furthermore, the check2up index of the supervision is not reasonable. W hile imp roving the supervision system, we should center on p rotection of hum an rights, develop the superviso ry power in accordance w ith the pattern of contro l and strengthen the authority of the supervisory power.
