32 101 9 123-155 Yu Da Academic Journal Vol.32, September 2012, pp. 123-155. 黨 管 幹 部 原 則 運 作 下 的 中 國 鄉 鎮 長 選 舉 制 度 改 革 : 困 境 與 變 通 柳 金 財 摘 要 中 國 鄉 鎮 長 選 舉 制 度 的 改 革 模 式 已 普 遍 引 起 關 注, 儘 管 推 動 鄉 鎮 長 直 選 尚 未 成 為 國 家 政 策, 但 這 意 謂 一 種 漸 進 主 義 式 的 草 根 民 主 政 治 發 展, 已 能 建 立 改 革 的 激 勵 機 制 及 為 基 層 民 主 制 度 創 新 提 供 空 間 改 革 鄉 鎮 長 選 舉 方 式 其 目 標 在 於 改 變 官 員 貪 腐 行 為 提 升 地 方 治 理 品 質 及 強 化 地 方 黨 國 權 力 合 法 性 基 礎 由 於 黨 國 體 制 的 改 革 態 度 游 離 與 立 場 猶 疑, 高 層 對 鄉 鎮 長 選 舉 改 革 尤 其 是 直 選 缺 乏 一 致 性 共 識, 阻 礙 鄉 鎮 長 直 選 的 全 面 性 發 展 本 文 試 從 黨 管 幹 部 此 一 組 織 原 則, 探 討 黨 國 體 制 介 入 鄉 鎮 長 選 舉 制 度 變 革 及 所 面 臨 的 發 展 困 境 ; 同 時, 黨 國 體 制 採 取 鄉 鎮 黨 委 公 推 直 選 的 替 代 性 改 革 方 式, 以 變 通 或 回 應 鄉 鎮 長 直 選 要 求 鄉 鎮 長 選 舉 制 度 改 革 最 大 阻 力 來 自 於 黨 國 體 制, 地 方 黨 國 恐 損 及 黨 領 導 地 位 的 鞏 固 政 策 支 持, 及 衝 擊 鄉 村 治 理 深 化 體 制 矛 盾 本 文 研 究 結 果 指 出 黨 管 幹 部 原 則 此 一 慣 性 深 深 束 縛 鄉 鎮 長 選 舉 變 革 發 展, 大 多 數 試 點 選 舉 並 未 能 跳 脫 黨 的 控 制, 公 推 直 選 鄉 鎮 黨 委 已 逐 漸 替 代 鄉 鎮 長 直 選 模 式 這 顯 示 中 共 已 以 黨 內 民 主 改 革, 作 為 替 代 鄉 鎮 基 層 民 主 變 通 改 革 方 案 在 可 預 見 未 來, 中 國 鄉 鎮 長 選 舉 制 度 變 革 與 直 選 發 展, 仍 是 步 履 蹣 跚 與 前 途 未 卜 關 鍵 字 : 鄉 鎮 長 選 舉 黨 管 幹 部 公 推 直 選 黨 內 民 主 * - 123 -
32 101 9 Reform on Electoral System of Township Head Under the Principles of the Party-controlled Cadres in China: Dilemmas and Modifications Chin-Tsai Liu * Abstract Mode of the electoral system reform of township head has generally been a cause for concern in China, despite promote direct election of the township has not yet become national policy, but this means that a gradualist style grass-roots democracy political development, has been able to create the incentives for reform and supply innovation for the space of grassroots democratic system. Reform township head election goal is to change the corrupt behavior of local officials, to improve the quality of local governance and strengthen the legitimacy of the power of the local party-state. Attitude free with the stance and hesitation of the party-state system on township mayoral electoral reform, and the lack of consistency consensus hinder the comprehensive development of the direct election of township head. This paper tries to explore the party-state system from an organizing principle of the party-controlled cadres, analyzing the influence from the interventional principle of township electoral system change and encounter dilemmas of development. Meanwhile, the mode of public nomination, direct election toward the secretary of townships party committee has been taken by the party-state system as alternative approach to reform, modify or respond to the township direct election requirements. The maximum resistance of the township electoral system reform was from the party-state system, local party-state fear of loss and the consolidation of the party leadership, policy support, and the impact of the deepening of rural governance system contradiction. The results of this study pointed out that the party-controlled cadres principle, this inertia deeply bound the township head election reform, most experimental elections failed to escape the control of the party. The mode of direct election of township party secretary has gradually replaced the direct election mode of township head. This shows that the CCP has chosen the reform of inner-party democracy as an alternative program to change grass-roots democracy. China's township electoral system reform and directly elected development are still faltering and uncertain in the near future.
