34 a) b) c) d) e) f) g) 1. a) b) c) d) 2. 6 (1) (2) (1) (a) (b) Incident On the day of accident, a lorry crane operator (the deceased) drove a lorry crane to a car centre to pick up a forklift truck. While assisting in the rigging of the forklift, the deceased fell to the ground from the overhead guard of the forklift. As a result, he sustained a serious head injury and passed away later in the hospital. Circumstances 1. The place of accident was an open yard in a rural area. The area was used as a second-hand car sale centre where there was an unused forklift truck. The manager of the centre promised to let a contractor use the forklift for construction site tidying work. 2. On the day of the accident, the deceased and a co-worker were assigned to bring the forklift to the construction site. He drove a lorry crane to the centre where the forklift truck was stored with the intention of transporting it to the site of the tidying work. Upon reaching the centre, the deceased parked the lorry crane inside the centre. He extended the lorry s out-riggers and then operated the jib of the crane to a position just above the forklift truck which had been parked adjacent to the lorry crane. The crane jib with chain slings was positioned just above the overhead guard of the forklift. 3. The deceased and the co-worker proceeded to hook the chain slings to the anchor points of the forklift truck. Since there was no safe means to get to the top of the forklift truck, the co-worker jumped from a platform (i.e. the flatbed of the lorry crane) to get to the top of the forklift. At the top there was the overhead guard of the forklift truck. There were anchor points on the forklift. The first point was at the tail end. The remaining anchoring points were on the left and right sides of the mast top of the forklift. 4. While the co-worker was hooking chain slings onto the two points of the mast top, he sensed the deceased person also jumping from the platform to the top of the forklift truck. Immediately, he heard a loud boom sound behind him and found the deceased lying on the ground on the other side of the forklift truck. Findings and observations 1. The accident scene was a fencedoff open ground in rural area with several cars parked inside for sale. The lorry crane was parked at the entrance of the premises with its front facing the entrance. The lorry crane was of the Nissan brand. It was an ordinary truck with a hydraulic crane installed at the back of the platform. The hydraulic crane was of the FASSI brand. 2. There were wooden side-boards on three sides of the platform. The top of the side-boards (in an upright position) was about 168 cm from the ground. 3. The forklift truck was parked on the left side of the lorry crane. The left side-board was in an upright position. The horizontal distance between the forklift and the lorry

35 crane was about 65 cm. It was possible for workers to jump from the left side of the lorry crane to the top of the forklift truck. 4. The crane jib had already been extended and lowered to just above the overhead guard of the forklift. Some chain slings were found attached to the metal hook of the jib with two O-rings. One two-legged chain sling had been anchored to the mast top of the forklift. Another sling was anchored to the tail end of the forklift. However, two wrenches, instead of a suitable metal pin, were used for anchoring the tail end. 5. There was an overhead guard at the top of the forklift truck. The edge of the guard was 209 cm from the ground (i.e. the vertical height in case of any fall). The dimensions of the top of the overhead guard were 103 cm (length) x 104 cm (width). There was no suitable access to and egress from the overhead guard. Neither barrier nor guardrail was erected along the sides of the overhead guard. 6. Furthermore, an ordinary wooden pallet was found placed on the top of the overhead guard. The dimensions of the pallet were 110 cm (length) x 80 cm (width) x 14 cm (height). The pallet was made of three long wooden strips with two voids in between. 7. There was no ladder provided to get to the top of the forklift truck. The deceased jumped from the platform to the top of the forklift truck. In doing so, he fell to the ground and sustained a fatal head injury. 8. It was the first time that either the deceased or the co-worker had attempted to perform forklift lifting work. There was no supervisor present. 9. No eyewitness saw how the deceased person fell. It is believed that when he landed on the pallet, he lost balance and fell to the ground on the other side. 10. The occurrence of the accident was probably due to one or a combination of the following reasons: a) A ladder was not provided for getting to the top of the forklift truck; b) There was a limited area on the top of the overhead guard for two persons working; c) The presence of the pallet on the overhead guard; d) Fall from height protection was not provided; e) Proper working procedure for lifting work was not carried out; f) Inexperienced workers performed the lifting work without supervision; and g) Lack of suitable information, instruction, training and supervision for the work. Recommended preventive measures 1. A safe system of work for forklift lifting shall be provided and maintained for workers engaged in such work. The system shall include, but not be limited to, the following: a) A proper risk assessment shall be conducted and safety precautions devised before lifting work. b) Proper safe access to and egress from the place for rigging the forklift shall be provided. c) Suitable metal pins shall be used for anchoring the tail end of the forklift for the lifting work. d) Suitable fall protection equipment shall be provided for workers involved in the lifting work. 2. Suitable and adequate safety information, instruction, training and supervision shall be provided for workers engaged in the forklift lifting work. Applicable legislation Section 6 of the Occupational Safety and Health Ordinance: Employers to ensure safety and health of employees (1) Every employer must, so far as reasonably practicable, ensure the safety and health at work of all the employer s employees. (2) The cases in which an employer fails to comply with subsection (1) include (but are not limited to) the following: (a) a failure to provide or maintain plant and systems of work that are, so far as reasonably practicable, safe and without risks to health; (b) a failure to provide such information, instruction, training and supervision as may be necessary to ensure, so far as reasonably practicable, the safety and health at work of the employer s employees.
