The industries with supported development contain four major sectors: the strategic emerging industries, the service industry, the manufacturing industry, and the marine industry. Commerce have jointly formulated the Provisional Measures for the Administration of Wholly Foreign-owned Medical Institutions in China (Shanghai) Pilot Free Trade Zone (hereinafter referred to as the "Provisional Measures"). Investors from Hong Kong, Macao and Taiwan may set up solely-funded medical institutions in China (Shanghai) Pilot Free Trade Zone (FTZ) with reference to these Provisional Measures. 暂 行 办 法 规 定, 设 置 的 外 商 独 资 医 疗 机 构 必 须 为 独 立 法 人, 最 低 投 资 总 额 2000 万 元 人 民 币, 且 经 营 期 限 为 20 年 申 请 设 置 外 商 独 资 医 疗 机 构 的 外 国 投 资 者 需 要 具 有 五 年 相 关 经 验, 且 要 求 能 够 提 供 国 际 先 进 的 医 疗 机 构 管 理 经 验 先 进 的 医 学 技 术 和 设 备 并 且 可 以 补 充 所 在 地 医 疗 领 域 的 不 足 According to the Provisional Measures, a wholly foreign-owned medical institution to be established must be an independent legal entity with the total investment of not less than 20 million yuan and the operating period of 20 years. And its foreign investors shall have relevant experience of five years, and shall be able to provide internationally advanced experience in management of medical institutions, advanced medical technologies and equipment. 以 访 问 互 联 网 中 国 上 海 门 户 网 站 的 试 验 区 投 资 办 事 直 通 车 网 页, 通 过 准 入 导 航 等 栏 目 查 看 办 理 流 程 及 材 料 清 单 第 二, 申 请 人 应 当 进 入 负 面 清 单 栏 目 进 行 比 对, 确 定 所 需 要 填 报 和 提 交 的 备 案 或 审 批 材 料 类 型 第 三, 在 进 行 互 联 网 一 表 申 报 时, 申 请 人 进 入 外 商 投 资 企 业 设 立 标 签 页 的 网 上 申 请 栏 目 进 行 申 请 信 息 填 写 第 四, 申 请 人 携 带 一 表 申 报 系 统 打 印 的 表 格 及 材 料 至 试 验 区 一 口 受 理 窗 口 现 场 提 交 第 五 即 各 部 门 审 核 ( 备 案 ), 在 收 到 一 口 受 理 材 料 后, 自 贸 区 管 委 会 工 商 质 监 和 税 务 部 门 利 用 政 务 外 网 的 公 网 平 台 进 行 同 步 审 核 或 备 案 According to Shanghai Administration for Industry & Commerce, the specific procedures for foreign-invested enterprises to apply for the establishment in the Shanghai Pilot Free Trade Zone are as follows: firstly, after obtaining the Notice of Advance Approval of Enterprise Name, the applicant may visit the page of "Express for Handling Matters in the Pilot Free Trade Zone" in China Shanghai government portal to view the procedures and the material list through the Access Navigation and other columns; secondly, the applicant should make a comparison after entering the Column "Negative List" to determine the type of materials required to be completed and submitted for filling or approval; thirdly, when making "Application Using One Form" on the internet, the applicant shall complete the application information in Column "Online Application" in the tab of "Establishment of Foreign-invested Enterprises"; fourthly, the applicant shall go to the window in the Pilot Free Trade Zone and submit the application form and relevant materials printed from the system of "Application Using One Form"; fifthly, review (filing) by various departments: the departments such as the Administrative Committee of Pilot Free Trade Zone, department for industry and commerce, department of quality supervision and tax department shall synchronously review or file those application materials using the public network platform in the external network for government administration. 上 海 自 贸 区 暂 禁 外 资 企 业 拍 卖 文 物 ( 来 源 : 北 京 商 报,2013 年 11 月 8 日 ) Shanghai Pilot Free Trade Zone Temporarily Bans the Auction of Cultural Relics by Foreign-Funded Enterprises (Source: www.bbtnews.com.cn, Nov. 8, 2013) 上 海 自 贸 区 挂 牌 一 个 多 月 后, 对 于 自 贸 区 内 是 否 应 允 许 外 资 拍 卖 行 独 立 拍 卖 文 物 艺 术 品 的 讨 论 仍 然 不 绝 于 耳 11 月 7 日, 中 国 拍 卖 行 业 协 会 会 长 张 延 华 明 确 表 示, 我 国 确 定 上 海 自 贸 区 内 目 前 不 会 对 外 资 拍 卖 行 开 放 文 物 拍 卖, 今 后 是 否 会 有 望 对 外 资 拍 卖 行 开 放 这 一 业 务 目 前 还 是 未 知 数 至 此, 外 资 借 助 上 海 自 贸 区 窗 口 进 驻 我 国 内 地 拍 卖 行 业 的 愿 望 彻 底 落 空 More than one month after the Shanghai Pilot Free Trade Zone was established, the disputes over whether the foreign-funded auction companies shall be allowed to independently sell the cultural relic artworks by auction in the Pilot Free Trade Zone or not are still lingering in our ears. On November 7, Zhang Yanhua, the president of the China Association of Auctioneers, made it clear that, for now in China, the foreign-funded auction companies shall not be granted with qualifications for auction of cultural relics in Shanghai Pilot Free Trade Zone, and it still remains uncertain whether the foreign-funded auction companies will be granted with such qualifications in the future. At this point, the 5
foreign-funded enterprises' hope to enter into the auction industry of Mainland China through Shanghai Pilot Free Trade Zone as the window proves thoroughly in vain. 山 东 首 批 外 资 小 额 贷 款 公 司 获 批 ( 来 源 : 商 务 部 研 究 院 信 息 咨 询 中 心,2013 年 11 月 14 日 ) First Batch of Foreign-invested Small Loan Companies in Shandong Approved (Source: www.mofcom.gov.cn, Nov. 14, 2013) 近 日, 青 岛 市 金 融 办 今 年 下 半 年 小 额 贷 款 公 司 试 点 资 格 中 标 结 果 公 示 结 束,18 家 中 标 企 业 中 包 含 2 家 外 资 企 业 这 意 味 着, 山 东 省 首 批 由 外 资 发 起 设 立 的 小 额 贷 款 公 司 获 批 筹 建 The bidding result announcement of pilot qualifications for small loan companies in the second half of this year by the finance office of Qingdao city have come to an end, and there are two foreign companies among 18 enterprises winning the bid.
