2010 1 Abstract The so - called judicial activism and extensive mediation currently practiced and encouraged in China's judiciary have social and political significance in the transitional society. However social mobility and individualization will lead mediation once highly effective less functional and effective between noncommercial disputants. The merits of mediation in different regions and courts at different levels will vary and should be evaluated according to its marginal benefits relative to the merits of judgment and judges should be encouraged to maximize his / her talents and skills in solving disputes most effectively through either judgment or mediation. Economic analysis and judicial pragmatism rather than an ideological pre - commitment should govern China's judicial practices. 16
