Prof. ZhangW eiren from Tai2 wan, holds that the p roposition of Khadi justice raised byw ebber has no basis, and the Chinese traditional justice does not fall into the category of Khadi justice. According to the w riter of this thesis, the p roposition of Khadi justice is correct and Chinese traditional justice basically belongs to the Khadi justice. How to comment on the Chinese traditional judicial system and concep ts involves both the issues concerning the law s in ancient and modern China and other countries and the fundamental direction of contemporary Chinese rule of law. The contemporary Chinese rule of law should be divided into three dim ensions: peop le s livelihood, de2 mocracy, and popular sentiments, which respectively correspond to the econom ic system, political field and Chinese culture. The first two are m ainly about the issue of ancient time and that of modern time, and the main task is to build the modern system. W hile the third is about the issue concerning China and western countries, mainly restoring the Chinese tradition culture. Nowadays the m arketing econom y, democratic gov2 ernment, and Chinese tradition and culture are in p rogress and w ill be necessary to the modernization of the le2 gality of China and the modernization of China.
