1 RULES AND REGULATIONS 1. ELIGIBILITY The UOB Painting of the Year competition (the Competition ) is organised by United Overseas Bank (Malaysia) Bhd ( UOBM ). The Competition is open to all Malaysian citizens and residents. Participation in the Competition is free-of-charge. For participant who is 18 years of age or below, the parent or legal guardian of the participant must consent to his/her participation in this Competition in the entry form and agree to the rules and regulations. 2. THE COMPETITION The Competition is divided into two categories: (1) Emerging Artist and (2) Established Artist. a. The Emerging Artist category is open to aspiring artists who are pursuing an arts education; are taking their first steps to a career in art; or simply paint for pleasure. b. The Established Artist category is open to experienced professionals with an established portfolio of work. They must have shown their paintings in solo or group exhibitions (excluding school graduation shows); be represented by a gallery; or have achieved recognition through art awards. c. There are no age restrictions for either the Emerging Artist or Established Artist category. Participants may enter their artwork in only one of the two categories. Each participant may submit a maximum of three (3) entries for one category. Paintings in acrylic, batik, Chinese brush, collage, crayon, ink, mixed media, oil, watercolour or any other media are accepted. Paintings submitted must be original and should not have been created more than two years prior to the submission date. Participants should not submit works that have been offered for sale, published, or publicly exhibited. UOBM may, at its sole and absolute discretion, make exceptions for works by full-time art students which have been exhibited at their respective school graduation shows but which have not been offered for sale, published, or exhibited in any other form. Paintings submitted should be two-dimensional. Paintings over 180 centimetres in height or width (inclusive of their frames) will not be accepted. Paintings submitted as a series to make up a single artwork should not exceed three (3) individual pieces that make up the whole artwork, or if conjoined, are to be submitted as a triptych (3-panel artwork). The total dimensions of all the three (3) individual pieces combined that constitutes the whole artwork and/or the triptych (if conjoined) should not exceed 180 centimetres in total height or width. 3. THE AWARDS 3.1 The awards for the two categories set out in Clause 2.1 above are as follows: ESTABLISHED ARTIST CATEGORY * UOB Painting of the Year Award US$25,000 * Gold Award US$10,000 * Silver Award US$8,000 * Bronze Award US$5,000 UOB Southeast Asian Painting of the Year Award This regional prize is awarded to the most outstanding of the four (4) UOB Painting of the Year Award country winners. US$10,000 Fukuoka Asian Art Museum Residency Programme One (1) of the four (4) UOB Painting of the Year Award country winners will be selected for a residency programme at the Fukuoka Asian Art Museum. The recipient will be selected through an interview process conducted by the judges of the Competition. * One (1) award recipient per country. EMERGING ARTIST CATEGORY *Most Promising Artist of the Year Award *Gold Award *Silver Award *Bronze Award * One (1) award recipient per country. US$3,000 US$2,500 US$1,500 US$1, SUBMISSION OF ENTRIES 4.1 All submissions must be accompanied by an official entry form and a write-up on each painting. Only one entry form is required per participant. Photocopies of the form will be accepted. 4.2 Each submission must have a completed label (provided with the entry forms) attached to the top right-hand corner on the back of the painting. All information must be clearly written in block letters on the labels. 4.3 Paintings that have not dried completely will not be accepted. 4.4 Paintings and entry forms are to be submitted: By Hand: Curate, LG1-1, SENI Mont Kiara, 2a Changkat Duta Kiara, Mont Kiara, Kuala Lumpur Submission dates: 2-5 October 2015 (4 days) Time: 10am-4pm. By Post: Curate, LG1-1, SENI Mont Kiara, 2a Changkat Duta Kiara, Mont Kiara, Kuala Lumpur Submission dates: before 5 October If the entry is submitted by hand, it will be deemed received by UOBM upon issuance of an acknowledgement of receipt. If the entry is submitted by post, it will be deemed received by UOBM on the day that UOBM receives the entry. 4.6 UOBM will not be liable in any manner to the participants should any entry be lost, missing or damaged in the post. All entries must reach UOBM latest by 5 October 2015 to be eligible to participate in the Competition. 4.7 A proxy may submit an entry on a participant s behalf. The proxy must provide a signed authorisation letter (in UOBM s format which is in the entry form) from the participant and a copy of the participant s passport or identity card. 4.8 UOBM reserves the right to reject the submission and/or the entry in the event that the proxy fails to provide the duly executed authorisation letter in UOBM s format and/or a copy of the participant s passport or identity card. 5. JUDGING 5.1 Entries will be judged by a panel of local and/or overseas artists/ art connoisseurs/ art critics/ curators or other creative professionals appointed at the discretion of UOBM. The decision of the judges is final. No correspondence will be entered into on this subject before, during, and/or after the Competition. 5.2 Artworks will be judged based on these criteria: message, creativity, composition and technique. 5.3 UOBM reserves the right not to award any of the awards stated in Clause 3.1 above should the entries fail, in the judges opinion, to meet the required standards. 6. ANNOUNCEMENT OF RESULTS 6.1 All award winners will be notified by phone by 23 October All awards (except the UOB Southeast Asian Painting of the Year Award and the Fukuoka Asian Art Museum Residency Programme) will be presented to all winners at an award ceremony in Kuala Lumpur and the winners will be notified on the venue, date and time by phone on or before 23 October The UOB Southeast Asian Painting of the Year award winner will be announced at an award ceremony in Singapore in November RETURN OF ENTRIES With the exception of the award-winning entries which will be exhibited, all other entries must be collected between 23 to 26 October 2015 from Curate, LG1-1, SENI Mont Kiara, 2a Changkat Duta Kiara, Mont Kiara, Kuala Lumpur, between 10am and 4pm daily. Entries which are not collected by 4pm on 26 October 2015 shall become the property of UOBM and may be disposed of in whatever manner UOBM deems fit. A proxy may collect an entry on a participant s behalf. The proxy must provide a signed authorisation letter (in UOBM s format which is in the entry form) from the participant and a copy of the participant s passport or identity card. UOBM reserves the right not to allow the proxy to collect the entry in the event that the proxy fails to provide the duly executed authorisation letter in UOBM s format and/or a copy of the participant s passport or identity card. 8. COPYRIGHT/ INTELLECTUAL PROPERTY 8.1 All submission materials submitted to UOBM in accordance with these rules and regulations must be the original works of the participant. The participant must also be the owner of all submitted materials. 8.2 All award-winning entries including the documents and materials submitted to UOBM, shall be the sole property of UOBM. UOBM reserves the right to retain all winning artworks and any supporting documentation. Participants are advised to photograph their submissions for their own records prior to submission. 8.3 All winners shall grant UOBM and members of the UOB Group (including but not limited to United Overseas Bank Limited and its subsidiaries and associated companies) ( UOB Group ) an unlimited worldwide, royalty-free and exclusive licence to exhibit, archive and reproduce images of their winning entries (including, but not limited to brochures, calendars, catalogues, greeting cards and websites). 8.4 Each participant undertakes to indemnify UOBM and its officers and agents and hold UOBM and its officers and agents harmless from and against any and all liability, loss, damage, costs and expenses in relation to any claim or action brought against UOBM or its officers and agents arising out of a breach of the warranty and representation set out in Clause 8 herein. 9. ACCEPTANCE OF RULES AND REGULATIONS 9.1 Submission of entries signifies the participants acceptance of the rules and regulations of the Competition. While all possible care will be taken of the entries submitted, UOBM assumes no responsibility for any loss of or damage to the entries before, during, and/or after the Competition. 10. DISCLOSURE AND USE OF PERSONAL DATA 10.1 By submitting an entry to UOBM, the participants and/or the award winners consent to UOBM disclosing the Personal Data (as defined below) and photographs of the participants and/or the award winners for (i) publishing in any mass media or marketing materials for advertising or publicity purposes; and (ii) any other purpose in relation to the Competition which is considered by UOBM to be in UOBM s interest, or the interest of the UOB Group, in any manner as and when UOBM deems necessary without further notice to the participants and/or the award winners The participants and/or the award winners agree that UOBM s branches, agencies, representative offices, affiliated, associated or related corporations, and their respective officers, servants or agents, whether situated in or out of Malaysia, and the UOB Group are permitted to process the participants and/or the award winners Personal Data. The term process shall include but is not limited to, collecting, recording, holding, storing, using and/or disclosing Personal Data may include, but is not limited to, the participants and/or the award winners name, age, address, occupation and contact details The purpose for which UOBM collect the Personal Data ( Purpose ) includes the following: a. to establish the participants and/or the award winners identity and background; b. for communications with the participants and/or the award winners on any matters pertaining to the Competition, including but not limited to queries on the entry form, details on the award ceremony and notification to the winners on the awards; c. to contact the participants and/or the award winners to discuss any future exhibitions, publicity events related to their artworks and other art events; d. to create a UOB Painting of the Year alumni mailing list to update alumni members on activities relating to any future similar campaigns or competitions; e. to meet the disclosure requirements of any law binding on UOBM and the UOB Group; f. for any other purpose that is required or permitted by any law, regulations, guidelines and/or relevant regulatory authorities The participants Personal Data will be collected from the information the participants have provided to UOBM in the entry form and any other documents provided in relation to the Purpose The participants need to provide UOBM with the Personal Data UOBM requests from the participants, failing which UOBM may refuse to accept the participants registration/entry in the Competition The participants and/or the award winners agree and consent that UOBM may transfer the Personal Data outside of Malaysia. All Personal Data held by UOBM and the UOB Group will be accorded a reasonable level of protection against any loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or deletion. 11. GENERAL 11.1 These rules and regulations shall be governed by laws of Malaysia and the participants hereby agree to submit to the non-exclusive jurisdiction of the courts in Malaysia and consent to service of process by mail or in any other manner permitted by the laws of Malaysia A waiver (whether expressed or implied) by UOBM of any of these rules and regulations or of any breach of or default by a participant in performing any of its obligations under these rules and regulations shall not constitute a continuing waiver and that waiver shall not prevent UOBM from acting on any subsequent breach of or default by the participants under these rules and regulations UOBM shall not be responsible nor shall accept any liabilities of any nature and however arising or suffered by the participants and/or any third parties resulting directly or indirectly from the Competition UOBM reserves the rights at any time to add, delete, suspend or vary the Competition and these rules and regulations, wholly or in part, at its absolute discretion, by way of posting on UOBM s website or in any other way deemed suitable by UOBM.

2 竞赛规则 2015 年大华银行 年度之画 竞赛 1. 参赛资格 1.1 大华银行 年度之画 竞赛 ( 以下简称 竞赛 ) 的主办单位为大华银行 ( 马来西亚 ) 有限公司 ( 以下简称 马来西亚大华银行 ) 若参赛画作在邮寄途中遗失或遭到损坏, 马来西亚大华银行将不会以任何方式对参赛者承担责任 所有参赛画作须最迟于 2015 年 10 月 5 日呈交至马来西亚大华银行, 以获参赛资格 参赛者可委任其代表以成交参赛画作, 唯其代表须附上参赛者的授权书 ( 随报名表格提供 ) 以及参赛者的身份证或护照副本 如果参赛者的代表无法提供已填妥的授权书或参赛者的身份证或护照副本, 马来西亚大华银行保留不接受该画作的权利 1.2 此竞赛开放给所有马来西亚公民及居民参加 参赛者不须支付费用 岁或以下的参赛者必须获得父母或合法监护人在报名表格上列明许可, 并同意接受竞赛的所有条件与规则 2. 竞赛详情 2.1 竞赛分为两个组别 : 新锐画家组和资深画家组 a. 新锐画家组开放给正在进修美术教育且有艺术抱负, 正要迈入艺术事业的画家, 或是纯粹为乐趣而作画的画家参加 b. 资深画家组开放给经验丰富且拥有成熟作品系列的专业画家 他们必须曾经在个展或群展中展出画作 ( 不包括学校毕业画展 ) 由画廊代理其作品, 或曾获得美术奖项的表彰 c. 新锐画家组或资深画家组皆无年龄限制 参赛者只能将画作报名参加两个组别之中的其中一组 每位参赛者只能以最多三件画作报名一个组别 5. 评选 5.1 参赛画作将由本地及 / 或海外画家 / 艺术鉴赏家 / 艺术评论家 / 策展人或马来西亚大华银行自行决定下委任的其他专业创意工作者组成的评审团进行评选 评审的决定为最终决议 在竞赛之前 期间及 / 或之后, 恕不受理有关此方面的异议 5.2 画作的评选标准如下 : 传达的讯息 创意 构图和技巧 5.3 若评审团认为没有何人参赛画作能达到规定的标准, 马来西亚大华银行保留不颁发预定奖项的权利 6. 竞赛结果通知 6.1 所有得奖者将在 2015 年 10 月 23 日前接获电话通知 6.2 所有奖项 ( 除了大华银行东南亚 年度之画 奖及福岗亚洲美术馆驻馆创作计划名额 ) 会通过一项颁奖典礼颁发给所有得奖的优胜者 得奖者将最迟于 2015 年 10 月 23 日通过电话获知颁奖典礼的地点 日期和时间 6.3 大华银行东南亚 年度之画 奖的优胜者将在 2015 年 11 月于新加坡举行的颁奖典礼上揭晓 参赛者可利用塑胶彩 ( 丙烯 ) 蜡染 中国毛笔 拼贴 蜡笔 油墨 混合媒介 油彩 水彩或其他任何媒介进行创作 参赛画作必须为原创画作, 而且从完成至呈交日期不可超过两年 参赛者不可呈交曾被贩售 发表 或公开展出的画作 马来西亚大华银行可完全根据其独立判断, 破例接受艺术科系学生曾在各自学校毕业展览中展出, 但未经贩售 发表 参加以往竞赛或以其他任何形式展出的画作 参赛的画作必须为平面 此竞赛恕不接受高度或宽度超过 180 厘米 ( 包括其画框 ) 的画作 7. 参赛画作归还程序 7.1 除了参展的得奖画作之外, 所有其他的参赛者必须在 2015 年 10 月 23 日至 26 日, 上午 10 时至下午 4 时之间到 Curate, LG1-1, SENI Mont Kiara, 2a Changkat Duta Kiara, Mont Kiara, Kuala Lumpur 领回其画作 未在 2015 年 10 月 26 日下午 4 时前领回的参赛画作将归马来西亚大华银行所有, 并以马来西亚大华银行认定为合理的任何方式处置 7.2 参赛者可委任其代表以领回参赛画作, 唯其代表须附上参赛者的授权书 ( 随报名表格提供 ) 以及参赛者的身份证或护照副本 7.3 如果参赛者的代表无法提供已填妥的授权书或参赛者的身份证或护照副本, 马来西亚大华银行保留不让其代表领回参赛画作的权利 2.9 由一系列画作组成的单一参赛画作最多只能包含三 (3) 件画作, 或以三幅相连的形式参赛 组成整体画作及 / 或三幅相连画作 ( 接合后 ) 的所有画作的总高度或总宽度不可超过 180 厘米 3. 奖项 3.1 两个组别的奖项如下 : 资深画家组 * 大华银行 年度之画 奖 25,000 美元 * 金奖 10,000 美元 * 银奖 8,000 美元 * 铜奖 5,000 美元 大华银行东南亚 年度之画 奖 10,000 美元这项区域奖项将颁发给四位代表其国家的大华银行 年度之画 奖得主之中表现最突出的一位画家 福岗亚洲美术馆驻馆创作计划四位大华银行 年度之画 奖的各国得奖画家之中将有一位可获选加入福岗亚洲美术馆的驻馆创作计划 获选者将经由大华银行 年度之画 竞赛评审所主持的面谈过程中选出 * 每个国家一名得奖者 新锐画家组 * 大华银行年度最具潜力画家奖 3,000 美元 * 金奖 2,500 美元 * 银奖 1,500 美元 * 铜奖 1,000 美元 * 每个国家一名得奖者 4. 呈交参赛画作 4.1 所有参赛画作必须附上一份正式的报名表格及一份画作简介文书 每位参赛者只须缴交一份报名表格 ( 可复印 ) 4.2 每件参赛画作背面的右上角必须贴上一个标签 ( 随报名表格提供 ) 标签上的所有资料必须以大写字体清楚书写 4.3 主办单位将不接受尚未全干的画作 4.4 画作和报名表格必须呈交至 : 手提呈交 : Curate LG1-1, SENI Mont Kiara 2a Changkat Duta Kiara, Mont Kiara, Kuala Lumpur 呈交日期 : 2015 年 10 月 2 日至 5 日呈交时间 : 上午 10 时至下午 4 时邮寄呈交 Curate, LG1-1, SENI Mont Kiara 2a Changkat Duta Kiara, Mont Kiara, Kuala Lumpur 呈交日期 : 2015 年 10 月 5 日之前 4.5 手提呈交的参赛画作将在马来西亚大华银行发出接收确认书后视为正式接收 邮寄呈交的参赛画作将在马来西亚大华银行收件当日被视为正式接收 8. 著作权 / 知识产权 8.1 所有依照本竞赛规则呈交给马来西亚大华银行的参赛画作必须为参赛者的原创画作 参赛者也必须是所呈交画作的版权拥有者 8.2 所有呈交至马来西亚大华银行的得奖画作, 包括所有文件及材料的拥有权将完全归属马来西亚大华银行 马来西亚大华银行有权保留所有得奖画作及相关文件 我们建议参赛者在呈交前为其参赛画作拍摄照片作为记录保存 8.3 所有得奖者将授予马来西亚大华银行以及大华银行集团的成员 ( 包括但不限于新加坡大华银行 其子公司和联营公司 )( 以下简称 大华银行集团 ) 全球无限制 免版税和独家权力以展示 存档和复制其得奖画作的图像 ( 包括但不限于简册 月历 商品目录 贺卡和网站 ) 8.4 每位参赛者将承担任何赔偿责任, 并免除马来西亚大华银行 其职员及代理人所有因违反此保证而带来的相关责任 损失 损害以及任何索赔或诉讼的成本和费用 9. 接受竞赛条件与规则 9.1 呈交参赛画作意味着参赛者已接纳竞赛的条件与规则 虽然马来西亚大华银行将尽其所能保护参赛画作, 但将不承担任何参赛画作在竞赛前 竞赛期间及 / 或竞赛后所产生任何损失或损坏的责任 10. 个人资料的公开及应用 10.1 通过提交参赛画作于马来西亚大华银行, 参赛者及 / 或得奖者同意并允许马来西亚大华银行公开参赛者及 / 或得奖者的个人资料和照片供以下用途 :(i) 配合任何广告或宣传活动所出版的所有传媒及市场营销文案与资料 ; 和 (ii) 任何与竞赛相关并基于本银行或大华银行集团的权益范围内, 所有马来西亚大华银行认为有必要的时候和途径 恕不另行通知参赛者及 / 或得奖者 10.2 参赛者及 / 或得奖者同意并允许无论在马来西亚范围之内或以外的大华银行集团和所有马来西亚大华银行分行 代理机构 代表办事处 附属 联属或相关机构, 以及其管理人员 员工或代理人, 处理参赛者及 / 或得奖者的个人资料 处理 的诠释包括, 但不限于收集 记录 持有 储存 使用及 / 或公开 10.3 个人资料 可以包括, 但并不限于参赛者及 / 或得奖者的名字 年龄 地址 职业和详细联系方式 10.4 马来西亚大华银行收集个人资料的目的 ( 目的 ) 包括以下所述 : a. 以辩识各参赛者及 / 或得奖者的身份及背景 ; b. 与参赛者及 / 或得奖者之间保持联系, 以传递所有与竞赛相关的事宜, 包括但不仅限于有关参赛表格 颁奖仪式的各项查询, 以及通知得奖者有关奖项和奖品的详细信息 ; c. 联络参赛者及 / 或得奖者以讨论与他们的各别画作相关的任何展览和宣传活动或其他艺术活动等 ; d. 设立一份大华银行 年度之画 竞赛的赛友通讯碌, 为曾参与这项竞赛的赛友们提供任何类似竞赛或有关活动的资讯 ; e. 予遵守大华银行集团有关资料公开的任何具法律约束力之条规 ; f. 应用于任何由任何法律 规章 条规及 / 或相关的监管机构允许或所规定的目的 所有参赛者的个人资料都是通过参赛者向马来西亚大华银行提呈的参赛报名表格及任何其他文件中采集 参赛者必需向马来西亚大华银行提供各项所需的个人资料, 否则马来西亚大华银行有权拒绝接受参赛者的报名 / 参于次此项竞赛. 参赛者及 / 或得奖者同意并允许马来西亚大华银行把参赛者的个人资料转供至马来西亚以外的区域 所有由马来西亚大华银行及本集团持有的个人资料将会被赋予合理的保障, 以确保免于遭受任何损失 滥用 修改 无意或未经授权的存取或公开 更改或删除 11. 其他项目 11.1 此项竞赛的条件与规则将受马来西亚的法律管辖, 参赛者在此同意遵从马拉西亚法院之非专属管辖权, 并且同意通过邮件或依据其他任何马来西亚法律所允许的方式履行所有过程所需的责任 11.2 任何马来西亚大华银行豁免 ( 明示或暗示 ) 的竞赛条件与规则, 或违反竞赛条件与规则的参赛者, 将不构成任何持续性的豁免, 而该豁免将不阻止马来西亚大华银行对违反竞赛条件与规则的参赛者采取行动的权力 11.3 马来西亚大华银行将不承担任何参赛者或相关人士因参赛而直接或间接承受的任何责任和损失 11.4 马来西亚大华银行保留在任何时刻添加 删除 暂停或修改全部或部分此项竞赛及竞赛条件与规则的权力, 并通过上载于马来西亚大华银行网站或任何其他被马来西亚大华银行视为合适的方式发布 * 若此文件与英文版本有任何偏差, 应以英文版本为准

3 SYARAT & PERATURAN Pertandingan 2015 UOB Painting of the Year 1. KELAYAKAN Pertandingan UOB Painting of the Year ( Pertandingan ) dianjurkan oleh United Overseas Bank (Malaysia) Bhd ( UOBM ). Pertandingan ini terbuka kepada semua warga dan penduduk Malaysia. Penyertaan di dalam Pertandingan ini adalah percuma. Ibu bapa atau penjaga yang sah bagi peserta yang berumur 18 tahun atau ke bawah mesti memberikan keizinan kepadanya untuk menyertai Pertandingan ini dalam borang permohonan dan bersetuju dengan syarat and peraturannya. 2. PERTANDINGAN Pertandingan ini terbahagi kepada dua kategori: Pelukis Baru dan Pelukis Mapan. a. Kategori Pelukis Baru terbuka kepada pelukis beraspirasi yang mempelajari seni; baru sahaja menceburi kerjaya dalam bidang seni; atau sekadar melukis demi hobi. b. Kategori Pelukis Mapan terbuka kepada profesional yang berpengalaman dengan portfolio karya seni yang mapan. Mereka pernah mempamerkan karya seni secara solo atau kumpulan (tidak termasuk pameran graduasi); pernah mewakili galeri; atau telah menerima pengiktirafan melalui anugerah seni. c. Tiada had umur bagi kedua-dua kategori Pelukis Baru dan Pelukis Mapan. Peserta hanya boleh menyertakan karyanya ke dalam satu daripada dua kategori tersebut sahaja. Bilangan maksima karya yang boleh dihantar oleh setiap peserta adalah tiga (3) sahaja. Karya dalam bentuk akrilik, batik, berus Cina, kolaj, krayon, dakwat, cat minyak, cat air atau media campuran adalah diterima. Karya yang disertakan mestilah asli dan tidak dihasilkan lebih daripada dua tahun sebelum tarikh karya. Para peserta tidak boleh menyertakan karya yang pernah ditawarkan untuk jualan, diterbitkan, atau dipamerkan secara terbuka. UOBM boleh menggunakan kaedah pertimbangan dan kuasa mutlaknya untuk membuat pengecualian untuk karya-karya oleh pelajar seni sepenuh masa yang pernah dipamerkan di sekolah masing-masing semasa pameran konvokesyen tetapi belum pernah ditawarkan untuk jualan, diterbitkan, atau dipamerkan dalam sebarang bentuk. Karya yang dihantar mesti berbentuk dua dimensi. Karya yang melebihi 180 cm ketinggian atau kelebarannya (termasuk bingkainya) tidak akan diterima. Karya tunggal yang dipersembahkan secara bersiri tidak boleh melebihi tiga (3) panel yang berasingan. Sekiranya keseluruhan karya tersebut dicantumkan, ianya hendaklah dihantar dalam bentuk triptych (karya 3 panel). Ukuran keseluruhan bagi kesemua panel berasingan apabila dirapatkan tidak boleh melebihi ketinggian atau kelebaran 180 cm. 3. ANUGERAH 3.1 Anugerah bagi kedua-dua kategori adalah seperti berikut: KATEGORI PELUKIS MAPAN *Anugerah UOB Painting of the Year US$25,000 *Anugerah Emas US$10,000 *Anugerah Perak US$8,000 *Anugerah Gangsa US$5,000 Anugerah UOB Southeast Asia Painting of the Year US$10,000 Hadiah serantau ini dianugerahkan kepada peserta yang terbaik di antara empat pemenang anugerah UOB Painting of the Year dari setiap negara Program Residensi Muzium Seni Asia Fukuoka Seorang daripada empat pemenang anugerah UOB Painting of the Year dari setiap negara akan dipilih untuk menyertai program residensi di Muzium Seni Asia Fukuoka. Pemenang anugerah ini akan dipilih melalui satu proses temu duga oleh panel hakim Pertandingan UOB Painting of the Year. * Seorang pemenang daripada setiap negara. KATEGORI PELUKIS BARU *Anugerah Most Promising Artist of the Year *Anugerah Emas *Anugerah Perak *Anugerah Gangsa * Seorang pemenang daripada setiap negara. US$3,000 US$2,500 US$1,500 US$1, PENGHANTARAN KARYA 4.1 Semua karya mesti disertakan dengan borang karya rasmi dan ulasan bertulis bagi setiap karya. Hanya satu (1) borang penyertaan perlu dihantar bagi setiap peserta. Salinan borang juga diterima. 4.2 Setiap karya mesti disertakan label (yang disediakan dengan borang penyertaan) yang dilekat pada sudut atas kanan di belakang karya. Semua maklumat mesti ditulis dengan jelas dalam huruf besar pada label tersebut. 4.3 Karya yang masih belum kering sepenuhnya tidak akan diterima. 4.4 Karya dan borang karya hendaklah dihantar ke: Hantar Sendiri: Curate LG1-1, SENI Mont Kiara, 2a Changkat Duta Kiara, Mont Kiara, Kuala Lumpur Tarikh Penghantaran: 2-5 Oktober 2015 (4 hari) Masa: 10am 4pm Melalui Pos: Curate, LG1-1, SENI Mont Kiara, 2a Changkat Duta Kiara, Mont Kiara, Kuala Lumpur Tarikh Penghantaran: Sebelum 5 Oktober Jika karya dihantar sendiri, ianya akan dianggap diterima oleh UOBM selepas diserahkan resit pengakuan. Jika karya dihantar melalui pos, ianya dianggap diterima oleh UOBM pada hari UOBM menerima pos tersebut. 4.6 UOBM tidak akan bertanggungjawab kepada para peserta dalam apa cara sekalipun jika mana-mana karyanya hilang, tersalah letak atau rosak semasa dikirim. Semua karya mesti sampai ke UOBM selewat-lewatnya pada 5 Oktober 2015 untuk layak menyertai Pertandingan ini. 4.7 Peserta boleh melantik wakil untuk menghantar karya bagi pihaknya. Wakil tersebut mestilah menyediakan surat kebenaran (yang disediakan dengan borang penyertaan) daripada perserta dan salinan kad pengenalan atau pasport peserta. 4.8 UOBM berhak menolak penyertaan karya sekiranya wakil peserta tidak menyediakan surat kebenaran yang sah dan/atau salinan kad pengenalan atau pasport peserta. 5. PENGHAKIMAN 5.1 Kesemua karya akan dihakimi oleh sebuah panel yang terdiri daripada pelukis, pakar seni, pengkritik seni, kurator tempatan dan/atau luar negara atau mana-mana karyawan kreatif yang dilantik khas oleh UOBM. Keputusan hakim adalah muktamad dan tidak boleh dipertikaikan. Sebarang persoalan mengenai perkara ini tidak akan dilayan sebelum, semasa dan/atau selepas Pertandingan. 5.2 Karya seni akan dihakimi berdasarkan kriteria berikut: mesej, kreativiti, komposisi dan teknik. 5.3 UOBM berhak tidak memberikan mana-mana anugerah yang telah ditetapkan jika tiada karya dapat memenuhi piawaian yang diperlukan pada pendapat para hakim. 6. PENGUMUMAN KEPUTUSAN 6.1 Semua pemenang anugerah akan dimaklumkan melalui telefon sebelum 23 Oktober Kesemua anugerah (kecuali Anugerah UOB Southeast Asian Painting of the Year and Program Residensi Muzium Seni Asia Fukuoka) akan disampaikan kepada semua pemenang di suatu majlis penyampaian anugerah di Kuala Lumpur dan para pemenang akan dimaklumkan mengenai tempat, tarikh dan masa melalui telefon sebelum 23 Oktober Pemenang anugerah UOB Southeast Asia Painting of the Year akan diumumkan di suatu majlis penyampaian anugerah di Singapura pada bulan November PEMULANGAN KARYA 7.1 Selain karya pemenang yang akan dipamerkan, semua karya yang lain mesti diambil balik pada Oktober 2015 di Curate, LG1-1, SENI Mont Kiara, 2a Changkat Duta Kiara, Mont Kiara, Kuala Lumpur, dari jam 10 pagi hingga 4 petang. Karya yang tidak diambil balik pada jam 4 petang, 26 Oktober 2015 akan menjadi milik UOBM yang mungkin akan menghapuskannya dengan cara yang dianggap wajar oleh UOBM. 7.2 Peserta boleh melantik wakil untuk mengambil balik karya bagi pihaknya. Wakil tersebut mestilah menyediakan surat kebenaran (yang disediakan dengan borang penyertaan) daripada perserta dan salinan kad pengenalan atau pasport peserta. 7.3 UOBM berhak tidak mengembalikan karya peserta sekiranya wakil peserta tidak menyediakan surat kebenaran yang sah dan/atau salinan kad pengenalan atau pasport peserta. 8. HAK CIPTA / HARTA INTELEKTUAL Semua karya yang dihantar ke UOBM mengikut syarat dan peraturan ini mestilah karya asli peserta. Peserta tersebut juga mesti merupakan pemilik bagi semua karya yang dihantar. Semua karya yang memenangi anugerah termasuk dokumen dan bahan-bahan yang dihantar kepada UOBM akan menjadi hak milik UOBM. UOBM berhak menyimpan semua karya yang memenangi anugerah dan segala dokumentasi sokongan yang lain. Peserta dinasihatkan untuk mengambil gambar karya mereka untuk tujuan rekod peribadi sebelum dihantar ke UOBM. Kesemua pemenang diwajibkan memberi izin kepada UOBM dan ahli UOB Group (termasuk, tetapi tidak terhad kepada United Overseas Bank Limited, subsidiarinya dan syarikat bersekutunya) ( UOB Group ) untuk mempamerkan, mengarkib dan menghasilkan semula imej-imej karya mereka yang menang (termasuk, tetapi tidak terhad, kepada brosur, kalendar, katalog, kad ucapan dan tapak web) tanpa had dan bayaran royalti. Setiap peserta bersetuju untuk melindungi dan melepaskan tanggungjawab UOBM dan para pegawai dan ejennya daripada dan terhadap mana-mana dan semua liabiliti, kehilangan, kerosakan, kos dan perbelanjaan yang berkaitan dengan sebarang tuntutan atau tindakan yang dikenakan terhadap UOBM atau para pegawai dan ejennya yang timbul disebabkan pelanggaran perjanjian ini. 9. PENERIMAAN SYARAT DAN PERATURAN 9.1 Penghantaran karya menandakan penerimaan syarat dan peraturan Pertandingan ini. Walaupun semua karya akan dijaga dengan selamat, UOBM tidak akan bertanggungjawab terhadap sebarang kehilangan atau kerosakan kepada karya sebelum, semasa dan/atau selepas Pertandingan. 10 PELEPASAN DAN PENGGUNAAN DATA PERIBADI 10.1 Dengan menghantar borang penyertaan kepada UOBM, peserta dan/atau pemenang anugerah memberi kebenaran kepada pihak UOBM untuk melepaskan Data Peribadi dan gambar peserta dan/atau pemenang untuk (i) menerbitkannya di media massa atau dalam bentuk bahan pemasaran seperti pengiklanan dan publisiti; dan (ii) apa jua tujuan berkait dengan Pertandingan yang dianggap oleh UOBM sebagai berkepentingan buat UOBM mahu pun anggota UOB Group, dalam apa cara pun mengikut keperluan UOBM pada bila-bila masa tanpa memaklumkan peserta dan/atau pemenang anugerah Peserta dan/atau pemenang anugerah bersetuju untuk membenarkan cawangan, agensi, pejabat wakil, serta korporasi-korporasi yang berkaitan dengan UOBM, termasuk pegawaipegawai, kakitangan dan agennya di dalam atau luar Malaysia, dan juga anggota UOB Group untuk memproses Data Peribadi peserta dan/atau pemenang anugerah. Konsep memproses meliputi tetapi tidak terhad kepada kegiatan mengumpul, merekod, menyimpan, menggunakan dan/atau melepaskan data Data Peribadi termasuk dan tidak terhad kepada nama, umur, alamat, pekerjaan dan butiran perhubungan peserta dan/atau pemenang anugerah Tujuan UOBM mengumpul Data Peribadi ( Tujuan ) termasuk yang berikut: a. untuk menentukan identiti dan latar belakang peserta dan/atau pemenang anugerah; b. untuk berkomunikasi dengan peserta dan/atau pemenang anugerah berkenaan hal-hal Pertandingan, termasuk dan tidak terhad kepada pertanyaan dalam borang penyertaan, maklumat terperinci tentang majlis penyampaian anugerah dan notifikasi kepada pemenang anugerah; c. untuk menghubungi peserta dan/atau pemenang anugerah untuk membincangkan pameran dan acara publisiti yang berkaitan dengan karya seni mereka dan acara seni yang lain; d. untuk membuat senarai alamat pos bagi alumni UOB Painting of the Year untuk memaklumkan ahli alumni tentang aktiviti yang berkaitan dengan kempen atau Pertandingan yang serupa pada masa hadapan; e. untuk menepati peraturan pelepasan data mengikut undang-undang yang bersabit dengan UOBM atau UOB Group; f. untuk apa sahaja tujuan lain yang dikehendaki atau dibenarkan oleh undang-undang, peraturan, garis panduan dan/atau pihak berkuasa yang berkaitan Data Peribadi peserta dikumpul daripada maklumat yang dibekalkan oleh peserta kepada UOBM dalam borang penyertaan dan dokumen-dokumen lain yang diserahkan untuk Tujuan tersebut Peserta diwajibkan membekalkan Data Peribadi kepada pihak UOBM mengikut syaratnya, dan sekiranya tidak berbuat begitu, UOBM berhak menolak pendaftaran peserta untuk menyertai Pertandingan Peserta dan/atau pemenang anugerah bersetuju dan memberi kebenaran kepada UOBM dan UOB Group untuk menghantar Data Peribadinya ke luar Malaysia. Semua Data Peribadi yang dipegang oleh UOBM dan UOB Group akan diberi perlindungan wajar daripada kehilangan, salah guna, modifikasi, akses tidak sah atau tidak sengaja, pendedahan, perubahan atau terpadam. 11. PERKARA AM 11.1 Syarat dan peraturan ini akan tertakluk kepada undang-undang Malaysia dan peserta bersetuju untuk tertakluk kepada bidang kuasa tidak eksklusif mahkamah-mahkamah di Malaysia dan memberi izin kepada penyerahan proses melalui pos atau lain-lain cara yang dibenarkan oleh undang-undang Malaysia Pengecualian (sama ada secara tersurat atau tersirat) oleh UOBM bagi mana-mana syarat and peraturan atau bagi mana-mana pelanggaran atau keingkaran seseorang peserta dalam melakukan mana-mana tanggungjawabnya di bawah syarat and peraturan ini tidak meliputi penerusan pengecualian.
