The paper al so discusses t he role of supervisio n and rest rictio n, basic human right s, judicial justice and independence and legal aut hority and other concept s in t he concept ual system of the socialist rule of law" and provides a theoretical expo sition of t heir relationship wit h governance by t he rule of law, law enforcement for t he people, fairness and justice, serving t he overall sit uation and t he leadership of t he Party, stressing t he agreement between t he theory of t he rule of law" and policy and p ractice. ( 8) Trends towards Humanization in Contemporary International La w Zen g L i ngli an g 89 Humanization is a new concept and value orientation of international law as it should be, and is finding ever greater exp ressio n in act ual internatio nal law. Co ntemporary internatio nal law devotes it self on the one hand to establishing and imp roving a peacef ul and develop mental order of co2existence and cooperation between states. On t he ot her, it commit s it self to establishing and maintaining a humanized order t hat takes the individual and t he human race as it s f undamental values. The humanizatio n of internatio nal law embodies co ntinuo us p rogress. It has greatly enriched t he content of international law, not only promoting the modernization of t he classic depart ment s of internatio nal law, but al so giving rise directly to a series of new branches of international law. It has also impacted on the foundation of right s and obligations in international law, i. e., t he principle of reciprocity. It is true t hat wit hout treaties between nations and t he internatio nal p ractices agreed to by all natio ns, t he p heno meno n of t he humanizatio n of internatio nal law wo uld not be po ssible ; and wit ho ut cooperatio n bet ween natio ns, t he much2 vaunted values of humanizing international law would not become a reality. ( 9) The Ne w Dualistic Society : a Ne w Research Perspective on Social Transition in China L i u Pi n g 104 The new dualistic society refers to t he social struct ure in which t he social mechanisms of t he t raditio nal planned system coexist wit h marketized social mechanisms. It offer s a new understanding of the progress of Chinaπs reforms and a new perspective for t he analysis of Chinaπs social t ransformatio n. The old indust rial base societ y is not o nly t he logical starting point for exploring t he new dualistic society, but also t he primary subject of research on t he new dualistic society. It is not an economic, technological or industrial concept, but a way of understanding t he characteristics of a distinctive social st ruct ure. The essence of t he new dualistic societ y is t he existence of t he organizational modes and cult ural patterns of two different kinds of social life t hat relate to particular p ropert y right s. A co ntinuing st ro ng political system is not o nly t he precondition for the generation of a dualistic society but also the condition for integrating t he two kinds of social mechanisms. The act ual p resence and f unctio ning of t his system is t he pivotal factor in understanding Chinaπs market2oriented t ransformatio n and Chinese experience. The new social struct ure and it s develop mental trends after more than two decades of reform and opening up are a realistic base for t he construction of a harmonious society in China. ( 10) How Can We Go Beyond the Case?
