13 ABSTRACTS A cademic S urvey A Study of Household Enterprises Chu Xiaoping 51 (4) Postmodern Jurisprudence : An Inquiry into the Future of Rule by La w Xin Chunying 59 The author points out that Western postmodern jurisprudence began when the ideas and methods of postmodern philosophy entered the science of law and jurisprudence. In the face of the crises that have confronted the Western legal tradition since the mid 1900s, postmodern jurisprudence has chal2 lenged t he basic concept s of modern jurisprudence. It denies t he existence of rational individuals as le2 gal subjects, and negates the pessimistic description of legal development, the universal significance of the law, and the principle of legal neutrality. The author discusses the theoretical trends and method2 ological features of the three main schools of postmodern jurisprudence : feminist jurisprudence, the law and literary movements, and critical racial jurisprudence. The author suggests that we should give serious consideration to post modern jurisprudence, since it contains profound and incisive views on re2 ality, and has the courage to propose new questions and new concepts. It is not simply a rebel, but al2 so represents an attempt to inquire into the future of rule by law. (5) Legislation with Regard to Unfair Labor Practices Chang Kai 71 Legislation wit h regard to unfair labor practices is important in a market economy, and seeks to protect workers right s to form t rade unions and to standardize and balance labor relations. Such legis2 lation epitomizes t he sociological feat ures of labor laws. It is now imperative for China to enact legisla2 tion with regard to unfair labor practices. The statutory stipulation of the right to form a trade union, and t he ongoing legislative activities designed to improve t his right provide t he legal basis and environ2 ment for legislation on unfair labor practices in China. Such legislation should mainly spell out unfair labor practices on the part of employers, for example, discrimination,yellow dogcontracts, rejec2 tion of collective bargaining, and cont rol of and interference in t he t rade unions. Legislation on unfair labor practices should be matched by regulations governing t heir elimination. It seems advisable to have both administrative and judicial solutions, with the former playing the leading role. A labor com2 mittee consisting of representatives from the government, employers and the trade unions could act to remedy such unfair practices. (6) Several Theoretical Problems Related to Current Studies of Chinese Rural Clans Yang S hanhua L iu Xiaojing 83 Alongside t he modernization process in rural areas t here has emerged a rational t rend based on t he original pat riarchal st ruct ure of rural society. As social organizations, clans have a double role to play in current rural development. On the one hand, they are detrimental in terms of social stability, but, on the other, they try to encourage their members to adapt to existing social institutions and structures in order to ensure their continued survival. As a result of the inclusion of relations by marriage and fic2 titious kinship relations, modern clans are quite different f rom t he t raditional pat riarchal clans in terms of both membership and structure. The authors focus on clans in everyday life, clans in relation to events, and the practical institutional innovations of clan members. Clans in northern rural areas are quite different from those in southern rural areas in terms of their organizational form, the form of 205
