12 Introduction Background 1. With the aim of improving the quality of life and the productivity level of the people of Jiangsu Province, and further promoting the development of the local economy through providing an improved water supply and wastewater system, the Construction Department of Jiangsu Province organized for the relevant water supply and wastewater treatment service and implementation agencies in Nanjing Municipality, Zhenjiang Municipality, Taizhou Municipality and Yancheng Municipality to adopt loans from The World Bank to participate in a project entitled The Jiangsu Province of China Water Supply and Wastewater Treatment Project, financed by The World Bank (P096296). 2. Upon project completion, a complete and comprehensive urban wastewater treatment system will be operated in Jiangsu Province, for which a system comprising wastewater collection, drainage, treatment, re-use and sludge utilization will be completely built and implemented, and through which the quality of the surface water of the urban area will be improved, the underground water will be effectively protected and, ultimately, the sustainable socio-economic development of the urban area will be further accelerated. Objectives of the Resettlement Action Plan 3. The experience of The World Bank indicates that involuntary resettlement under development projects, if unmitigated, often gives rise to severe economic, social and environmental risks, for example: production systems are dismantled; the affected persons (the APs) face impoverishment when their productive assets or income sources are lost; the APs are relocated to environments where their productive skills may be less applicable and the competition for resources greater; community institutions and social networks are weakened; kin groups are dispersed; and cultural identity, traditional authority, and the potential for mutual help are diminished or lost. 4. The Resettlement Action Plan (RAP) is designed according to the PRC s national and local laws and regulations and a series of provisions in the World Bank s operational policies OP4.12 Involuntary Resettlement. The objective of compiling this document is to set out an Action Plan to help APs improve their livelihoods and living standards, or at least to restore them to a relatively higher standard than pre-relocation or pre-project commencement levels, and make sure that the project will be beneficial to them. 1

13 Aims of the RAP 5. The objective of the RAP is to provide the APs with a resettlement restoration plan, to ensure that any losses they incur can be compensated for and that their living standards shall be improved or at least maintained at pre-project levels. A further aim is that any affected profitable production resources (including business shops and stores, enterprises and institutions), public property, infrastructure and cultural property, will also be improved or at least restored to pre-project levels. Scope of the RAP 6. The resettlement impacts caused by land acquisition and the demolition required by project construction have been identified. This RAP focuses on the plans for restoration and reconstruction. Those project-related resettlement impacts, which have been identified, are included in the body of the RAP. Those which have yet to be identified will be addressed in accordance with the policy procedures of Appendix 1 RPF for Jiangsu Province Water Supply and Wastewater Treatment Project. 7. The specific scope of the RAP includes the water supply or wastewater services construction of those cities and counties which have applied for World Bank loan projects in Nanjing Municipality, Zhenjiang Municipality, Taizhou Municipality and Yancheng Municipality, and Huangqiao Town Wastewater Treatment Systems Project. As the project design for the supporting facilities construction of the pipe networks within the towns or townships is not yet defined, the resettlement impacts are not yet clear. Since the caliber is small, the laying and construction activities can be flexible, and only involve temporary land occupation; therefore, the impacts of land acquisition and house demolition are minimal, and the compensation for resettlement has been included in the RPF. In respect of implemented and uncompleted associated projects,, the review appraisal for resettlement and rehabilitation shall be carried out; for projects which are not yet implemented, the resettlement impacts shall be included in the scope of the RAP, and the resettlement impacts of all associated projects will be included in the scope of the monitoring and evaluation tasks. Relevant Terms and Definitions Relevant Terms and Definitions in World Bank Operational Policies Eligibility for Benefits 8. Criteria for Eligibility. Displaced persons may be classified in one of the following three groups: 9. (a) those who have formal legal rights to land (including customary and traditional rights recognized under the laws of the country); 2

(b) those who do not have formal legal rights to land at the time the census begins but have a claim to such land or assets provided that such claims are recognized under the laws of the country or become recognized through a process identified in the resettlement plan (c) those who have no recognizable legal right or claim to the land they are occupying. 12. Persons covered under (a) and (b) are compensated for the land they lose and given other assistance. Persons who come under category (c) are provided with resettlement assistance 2 in lieu of compensation for the land they occupy, and other assistance, as necessary, to achieve the objectives set out in this policy. All persons included in (a), (b) or (c) are provided compensation for the loss of assets other than land. Compensation and Resettlement Measures 13. (a) The resettlement plan or resettlement policy framework includes measures to ensure that the displaced persons are: 14. (i) informed about their options and rights pertaining to resettlement; 15. (ii) consulted on, offered choices among, and provided with technically and economically feasible resettlement alternatives; and 16. (iii) provided prompt and effective compensation at full replacement cost 3 for losses of assets 4 attributable directly to the project. 17. (b) If the impacts include physical relocation, the resettlement plan or resettlement policy framework includes measures to ensure that the displaced persons are: 1 Such claims could be derived from adverse possession, from continued possession of public lands without government action for eviction (that is, with the implicit leave of the government), or from customary and traditional law and usage, and so on. 2 Resettlement assistance may consist of land, other assets, cash, employment, and so on, as appropriate. 3 "Replacement cost" is the method of valuation of assets that helps determine the amount sufficient to replace lost assets and cover transaction costs. In applying this method of valuation, depreciation of structures and assets should not be taken into account (for a detailed definition of replacement cost, see Annex A, footnote 1). For losses that cannot easily be valued or compensated for in monetary terms (e.g., access to public services, customers, and suppliers; or to fishing, grazing, or forest areas), attempts are made to establish access to equivalent and culturally acceptable resources and earning opportunities. Where domestic law does not meet the standard of compensation at full replacement cost, compensation under domestic law is supplemented by additional measures necessary to meet the replacement cost standard. Such additional assistance is distinct from resettlement assistance to be provided under the other clauses of para If the residual of the asset being taken is not economically viable, compensation and other resettlement assistance are provided as if the entire asset had been taken. 3

15 18. (i) provided assistance (such as moving allowances) during relocation; and 19. (ii) provided with residential housing, or housing sites, or, as required, agricultural sites for which a combination of productive potential, local advantages, and other factors is at least equivalent to the advantages of the old site (c) Where necessary to achieve the objectives of the policy, the resettlement plan or resettlement policy framework also includes measures to ensure that displaced persons are: 21. (i) offered support after displacement, for a transition period, based on a reasonable estimate of the time likely to be needed to restore their livelihood and standards of living; 6 and 22. (ii) provided with development assistance in addition to compensation measures described in (a) (iii), such as land preparation, credit facilities, training, or job opportunities. Relevant Definitions in the RAP 23. (i) The demolition body is the qualified unit that implements the demolition activities for the project, and which should been granted a license for house demolition before the implementation; 24. (ii) The demolition-subjected person is the owner of a house which is (to be) demolished; 25. (iii) The housed tenant is the unit or individual who has a legal rental relationship with a demolition-subjected person; 26. (iv) The demolition scope is the scope of the housing demolition that is determined by the housing demolition administrative department according to the license for the planned use of the land for construction and the documents of approval for state-owned land use rights; 27. (v) The demolition period is a deadline determined by the housing demolition license during which the demolition body must conduct and complete the demolition activities; 28. (vi) The removal period is a deadline during which the relocation of the demolition-affected people must be completed, which is agreed upon or adjudicated in the agreement of compensation and resettlement for demolition by the demolitionaffected people and the demolition body; 5 The alternative assets are provided with adequate tenure arrangements. The cost of alternative residential housing, housing sites, business premises, and agricultural sites to be provided can be set off against all or part of the compensation payable for the corresponding asset lost. 6 Such support could take the form of short-term jobs, subsistence support, salary maintenance or similar arrangements. 4

(vii) The transitional period is a deadline for relocation and rollback, which is agreed upon in the agreement of compensation and resettlement for demolition by the parties involved in the demolition or determined in the demolition bulletin issued by the housing demolition administrative department; 30. (viii) Illegal buildings are structures that are erected within the planned urban areas without a planned construction project permit or those that are not in line with the requirements stated in the permit; 31. (ix) House appendages are the buildings and structures attached to the main houses, such as outdoor toilets, door sockets, chimneys, septic tanks etc. 32. (x) Monetary compensation: during the compensation agreement for the demolition, the demolition-subjected people give up the property rights, and the demolition body pays compensation in the form of a disposable currency payment and according to the real estate market appraisal value of the demolished house. 33. (xi) A property rights transition is an action in which the demolition body assumes ownership of the construction or purchasing property rights of the house to be demolished in exchange for a fee determined by the real estate market appraisal value of subject house and the real estate market price of the exchanged house, which is given as compensation to the demolition-subjected people. 34. (xii) Replacement cost is the cost of materials and labor paid for rebuilding a house of an equivalent structure and quality standard as the demolished house over the previous year. 35. (xiii) A house closure notification is the written notice in which the municipal house demolition administrative department instructs other departments such as planning, public security, real estate, land, industry and commerce to suspend relevant procedures in accordance with the determined demolition scope. 5

17 Project Description Project Overview 36. Jiangsu Province of China Water Supply and Wastewater Treatment Project Financed by World Bank contains 3 sub-projects: water supply aggregation, wastewater services in cities and towns, institutional strengthening and capacity building. The main contents are shown as the following: 37. Sub-project 1 Water supply Aggregation: In order to heighten service efficiency and improve the quality and stability of town (or township) tap water, this component would support regional water supply system of cities to cover surrounding towns and townships. The project area includes Taixing City of Taizhou Municipality, Danyang City and urban area of Zhenjaing Municipality, and Yancheng Municipality. 38. Sub-project 2 Wastewater services in cities and towns: This component would support the implementation of wastewater services in several key cities and towns, including Huangqiao Town (in Taixing City), Nanjing Municipality, Zhenjiang Municipality and Danyang City. 39. Sub-project 3 Institutional Strengthening and Capacity Building: This component would support: an information management system; a focused program of institutional strengthening required to assist existing city and township tap water companies merging operations; a series of studies on relevant reformation subject. In addition, project implementation supports would be involved. 40. According to the different entities applying to loans for project, Jiangsu Province of China Water Supply and Wastewater Treatment Project Financed by World Bank can be divided into (i) water supply aggregation and wastewater service; (ii) small loan projects; (iii) project assistance. The total investment of this project is about RMB million, including USD million of World Bank loan. 41. Situation of project categories and loans for investment is shown as Table 0-1. This project involves 4 municipalities Nanjing, Zhenjiang, Taizhou, Yancheng, and 7 components: Nanjing Wastewater Treatment Plant and Sewerage Component, Zhenjiang Jinshan Waterworks Improvement Component, Zhenjiang Wastewater Treatment Plant and Sewerage Component, Danyang City Regional Water Supply Component, Danyang Shicheng Sewerage Improvement Component, Taixing Regional Water Supply and Wastewater Treatment Component, Yancheng City Regional Water Supply Component. Distribution of the 7 components is shown as Figure In addition, for pipelines project of within townships and towns, these townships and towns involved and project construction plan are not identified, of which 9 townships and towns will use small loans of WB to construct, the others will finance the construction by themselves. According to the types and regions of construction, the 7 components are mainly divided into 12 sub-components, of which 4 regional water supply sub-components and 8 wastewater treatment sub-components. The 12 sub-components are distributed in 5 cities, including Nanjing City, Zhenjiang City, Danyang City, Taixing City and Yancheng City. The impacts and service scope of this project are located in Jiangsu Province, mainly in the five cities applying for World Bank loan Components. Jiangsu Province, abbreviated Su, lies on the east coastal center of China s mainland, with the east longitude between ' and121 57' and the north latitude between 30 45' and 35 20', located at the downstream of the Yangtze River and Huai River. It is close to Yellow Sea on the east, adjacent to Zhejiang and Shanghai on the southeast, adjoins to Anhui on the west and meets Shandong on the north. Jiangsu Province has 13 municipal cities. The total area is thousand km 2, accounting for 1.06% of whole county area, and ranking as 24th in China. At the end of 2007, the population is million, ranking as fifth in China. The population density is 743 people/ km 2, ranking as first among various provincial areas of China. Project Benefited Areas 47. The urban zone and Pukou District is the main area benefited from Nanjing Wastewater Treatment Plant and Sewerage Component, especially the North and Northwest part of Nanjing City, and the Tiebei zone in Pukou District. 48. The western region of Zhenjiang is the area benefited from Zhenjiang City Regional Water Supply Component. The area of regional water supply is 900 km 2 ; the people using water will reach to 1.05 million. The areas benefited from Zhenjiang Wastewater Treatment Plant and Sewerage Component are the core area of the main city, Nanxucheng District, Dingmao Area and Jianbi Division Area (excluding Dagang chemical industry area). 49. Various towns and townships of Danyang are the main areas benefited from Danyang City Regional Water Supply Component. Development District of Danyang City is the area benefited from Danyang City Development District Wastewater Collection System Component. The service scope of Danyang Shicheng Sewerage Improvement Component is domestic wastewater and industrial wastewater of the 11

23 region in the west of Jiandu River Xihuan Road, in the north of Danwai Road, in the west of Beijing-Hangzhou Grand Canal and in the south of Beiwaihuan Road. 50. The regional water supply services scope of Taixing Regional Water Supply and Wastewater Treatment Component is the urban zone of Taixing City and various towns and townships in the City. The main service scope of wastewater collection is the area of Huangqiao Town, Taixing City. 51. The service scope of Yancheng City Regional Water Supply First Issue Component includes the core area of the main city and seven towns of Yandu District: Guomeng Town, Qinnan Town, Gewu Town, Panhuang Town, Beijiang Town, Shangzhuang Town and Longgang Town. The service area is 531 km 2, and the serviced people is 990 thousand. 52. Overall, after the construction of the project, the incremental water supply capacity is m 3 /d. The incremental wastewater treatment capacity is m 3 /d. The total service area increases to km 2, and the total serviced people is up to 5.71 million. 25 City. The areas affected by Zhenjiang Wastewater Treatment Plant and Sewerage Component mainly involve Runzhou District of Zhenjiang City and Xiangshan Town, Jianbi Town in Jingkou District. 56. The impact of Danyang Urban Regional Water Supply Component mainly involves Yunyang Town of Danyang City. The area affected by Danyang City Development District Wastewater Collection System Component is in Development District, and only involves temporary land occupation. The impacts of Danyang Shicheng Sewerage Improvement Component involve Xinfeng Town in Dantu District, Jingkou District and Zhenjiang New District. 57. The impacts of Taixing Regional Water Supply and Wastewater Treatment Component involve Taixing Town, Huangqiao Town, Zhangqiao Town and Gensi Town in Taixing City. 58. The impacts of Yancheng Regional Water Supply Component involve Wuyou Town of Tinghu District and Guomeng Town, Qinnan Town, Gewu Town, Panhuang Town, Beijiang Town, Shangzhuang Town and Longgang Town in Yandu District. Local Socio Economic Profile Jiangsu Province 59. Jiangsu province has 13 municipal cities, 106 counties (cities, districts), incl. 27 county-level cities, 25 counties and 54 municipal districts. By the end of 2006, it has 1103 towns or townships, incl. 994 organic towns and administrative villages. 60. In 2007, the gross domestic product (GDP) of Jiangsu Province was RMB 2, billion and it increased by 14.8% over the previous year. The added value of primary industry in Jiangsu was RMB billion, increasing by 4.0% over the previous year; the added value of secondary industry was RMB 1, billion, increasing by 15.5%, in which the added value of industries was RMB 1, billion, increasing by 16.6%; the added value of tertiary industry was RMB billion, increasing by 15.9%. Per-capita GDP was RMB 33,689, converted into US 4,430 dollars according to the exchange rate of the same year. 61. At the end of 2007 the resident population of Nanjing City was million, accounting for 5.7% of the total population of whole country; the ratio of urban population to rural population was 51.9:48.1, and the ratio of males to females was And the natural increase of population was 2.3. At present, the average area of towns and townships in the Province was km 2, and the average population is 53.5 thousand. At the end of 2007 urban and rural jobholders of whole province was million. The annual per-capita disposable income of urban residents was RMB 16,378, up by 16.3% over the previous year; the annual per-capita net income of rural residents was RMB 6,561, increasing by 12.9% in the last year. 62. The population of Jiangsu is mainly Han and it accounts for 99.64% of the total population in the province. There are not many ethnic minority people, there was

26 thousand persons, made up of 55 ethnic minorities, of which the population of Muslim is the largest, approximately accounting for 52% of the total population of ethnic minorities, other ethnic minorities whose population is larger than ten thousand are Miao, Mongolian, Manchu and Tujia. 63. Through field surveys and interviews within project impact scope, and visiting the local Religious Affairs Bureau, there is no ethnic monitory community in affected areas, and none of APs of ethnic monitories have been found in various cities for the moment. So, the project won t impact on these ethnic monitories. Nanjing Municipality 64. Nanjing (NJ) City, abbreviated Ning, lying in the hilly mountains of Ningzhen on the lower reaches of the Yangtze River, is the capital of Jiangsu Province. It is a famous ancient capital and historic cultural city. Nanjing is the political, cultural and economic center of Jiangsu Province, and it is an important central city on lower reaches of the Yangtze River. The total area of whole municipality is 6516km 2, of which the area of the city is 926 km 2. Its jurisdiction areas cross the north and south both banks of the Yangtze River, including Xuanwu, Baixia, Qinhuai, Jianye, Gulou and Xiaguan six city areas, Yuhuatai, Qixia, Pukou, Liuhe and Jiangning five suburbs, and Lishui and Gaochun two counties. 65. In 2007, the GDP of Nanjing was RMB billion and it increased by 15.6% over the previous year using comparative prices. In its GDP, the added value of primary industry in Nanjing was RMB 8.6 billion, increasing by 2.6% over the previous year; the added value of secondary industry was RMB billion, increasing by 16.0%; the added value of tertiary industry was RMB billion, increasing by 16.0%. The gross financial revenue of Nanjing was RMB billion, up by 27.1% over the previous year with the same requirements. 66. At the end of 2007 the resident population of Nanjing City was million, and the total population of registered permanent Nanjing residents was million, of which million people live in the city. Calculated on the number of the resident population, per-capita GDP was RMB 44,852, up by 11.5% over the last year; per-capita disposable income of urban residents was up to RMB 20,317, up by 15.8% over the previous year; per-capita net income of rural residents reached to RMB 8,020, up by 13.8%; per-capita house building area in the city is 30.03m 2, and the housing area of steel and brick-wood structures per person in the country is 45.8m 2. Zhenjiang Municipality 67. Zhenjiang (ZJ) City lies in the southwest of Jiangsu Province and lies on the south bank of the lower reaches of the Yangtze River, located at the top of Yangtze River Delta. It s adjacent to Nanjing in the west, Changzhou in the southeast, is close to the Yangtze River on the north, and is on the opposite side of the Yangtze River to Yangzhou and Taizhou. Zhenjiang Municipality has three cities: Danyang, Yangzhong and Jurong and four districts: Jingkou, Runzhou, Dantu and Zhenjiang 15

27 New District. The municipality has 41 towns and 10 streets; the total land area of is 3847km 2, incl hm 2 farmland and 132.2km 2 urban constructed areas. 68. In 2007, the GDP of Zhenjiang City was RMB billion and it increased by 15.5% over the previous year. The added value of primary industry in Zhenjiang was RMB 4.5 billion, increasing by 2.1% over the previous year; the added value of secondary industry was RMB 72.6 billion, increasing by 15.9%, of which the added value of industries was RMB 67.0 billion, increasing by 17.0%; the added value of tertiary industry was RMB 44.2 billion, increasing by 16.5%. The gross financial revenue of Zhenjiang was RMB billion, up by 34.4% in the last year. 69. In 2007, the total population of registered permanent Zhenjiang residents was million, increasing by 11.7 thousand in the last year, incl. male million and female million. It has four cities: Jingjiang, Taixing, Jiangyan and Xinghua and two districts: Hailing and Gaogang; the total area is 5,793 km 2. In 2007, the GDP of Taizhou was RMB billion and it increased by 15.7% over the previous year. The added value of primary industry in Taizhou was RMB10.24 billion, increasing by 4.4% over the previous year; the added value of secondary industry was RMB billion, increasing by 17.5%; the added value of tertiary industry was RMB billion, increasing by 16.0%. The gross financial revenue was RMB billion, up by 36.0% in the last year. 71. At the end of 2007 the total population of registered permanent Nanjing residents was million, decreasing by 0.6% over the previous. The urban population was thousand, increasing by 0.8%. Calculated on the number of resident population, per-capita GDP was RMB 26,093, increasing by 17.0%. 28 Yancheng Municipality 72. Yancheng (YC) City is located in the central plains in Northern Jiangsu. It s close to Yellow Sea on the east, adjacent to Huaiyang on the west, adjoins to Nantong City on the south and Lianyungang City on the north. In 1983, Yancheng was changed from district level to city level, and it implements the city-county administrative system. Yancheng City has two county-level cities: Dongtai and Dafeng, and five counties: Jianhu, Sheyang, Funing, Binhai and Xiangshui. The city has two districts: Yandu and Tinghu and Yancheng Development District. The total area of the city is 17 thousand km 2. It is the municipality with the most area and the second largest population in Jiangsu Province. 73. In 2007, the GDP of Yancheng was RMB billion and it increased by 15% over the previous year using comparative prices. The added value of primary industry in Nanjing was RMB 26 billion, increasing by 4% over the previous year; the added value of secondary industry was RMB 64.2 billion, increasing by 19.1%; the added value of tertiary industry was RMB 46.6 billion, increasing by 16.2%. The gross financial revenue of Yancheng was RMB billion, up by % in the last year with the same requirements. 74. At the end of 2007 the total population of registered permanent Yancheng residents was 8.08 million, of which 3.55 million live in urban, and the natural increase rate of population was 2.2.
