32 8 48 瑖瑧 The Effect of Source of Law and Recognition Path to Guiding Cases A Study on Guiding Cases of Private Law Issued by the Supreme People's Court LI Xue - cheng Abstract The Supreme Court's Rules on Case Guiding Opinions has established the system for case guidance however due to certain ambiguities there are still two questions to answer. Firstly whether the guiding cases have the same logic of judgment and legal effects as the case law in common law system further to say whether the guiding cases have the effect of source of law Secondly whether the function of guiding case is to control the discretion of judges or to construe from the interpretation of law From the perspective of civil law interpretation this paper aims to analyze the guiding cases of private law issued by the Supreme Court and to explicate that the guiding cases of private law have the function and value to confirm and discover legal rules. From the natural law perspective to discover the distinction between the law and laws this paper holds that the guiding cases of private law have the effect of source of law in Chinese private law. Finally from the perspectives of interpretation and legislation theories this paper proposes the recognition path and specific suggestions to the assertion that the guiding cases of private law can confirm and discover legal rules.
