1 2015 广东 21 世纪海上丝绸之路国际博览会展品出入境通关指引 Exit and Entry Clearance Guide for Exhibits in 2015 Guangdong 21 st Century Maritime Silk Road International Expo 广东 21 世纪海上丝绸之路国际博览会 ( 以下简称海博会 ) 将于 2015 年 10 月 29 日 10 月 31 日在厚街镇广东现代国际展览中心举行, 为方 便各国客商和有关人士出入境通关及检验检疫, 规范秩序, 根据 中华 人民共和国海关暂时进出境货物管理办法 ( 海关总署令第 157 号 ) 中 华人民共和国进出口商品检验法 中华人民共和国进出境动植物检疫 法 中华人民共和国国境卫生检疫法 和 中华人民共和国食品卫生 法 的规定, 特制定 2015 广东 21 世纪海上丝绸之路国际博览会展品 出入境通关指引 ( 以下简称 海博会通关指引 ), 以供参阅, 保障参展 品安全 及时 顺利参展及现场销售 Guangdong 21 st Century Maritime Silk Road International Expo (hereinafter referred to as Maritime Expo ) will be held in Guangdong Modern International Exhibition Center in Houjie Town during October 29-31,2015. To facilitate the exit and entry clearance and quarantine and inspection for the travelling traders from different countries and to establish the order, on the basis of Administrative Measures of the Customs of the People s Republic of China for Goods Temporarily Imported or Exported (Order of the General Administration of Customs NO. 157), Law of the People's Republic of China on Import and Export Commodity Inspection, Law of people's Republic of China on the Entry and Exit Animal and Plant

2 Quarantine, Law of People's Republic of China on Frontier Health and Quarantine and Law of the People's Republic of China on Food Hygiene, the Exit and Entry Clearance Guide for Exhibits in 2015 Guangdong 21 st Century Maritime Silk Road International Expo (hereinafter referred to as Clearance Guide ) is hereby enacted for reference to ensure that the exhibits could be admitted to the expo with safety, punctuality and success for the field sales. 一 入境参展品通关流程及管理规定 I. Clearance procedures and administrative regulations for entry of exhibits ( 一 ) 本 指引 所称进口展览品 ( 以下简称展览品 ) 系指 中华人民共和国海关暂时进出境货物管理办法 ( 海关总署令第 157 号 ) 第四十条规定的内容, 即 : 1. The imported exhibits (hereinafter referred to as exhibits ) quoted in this Guide indicates the contents prescribed in the Fortieth Article in Administrative Measures of the Customs of the People s Republic of China for Goods Temporarily Imported or Exported (Order of the General Administration of Customs NO. 157) as followed: 1. 展览会展示的货物 ; a. Goods exhibited in the expo; 2. 为了示范展览会展出机器或者器具所使用的货物 b. Goods used as model machines or appliances exhibited in the expo 3. 设置临时展台的建筑材料及装饰材料 ; c. Building and decoration materials for the temporary exhibition stands

3 4. 宣传展示货物的电影片 幻灯片 录像带 录音带 说明书 广告 光盘 显示器材等 ; d. Movies, slides, videos, audio tapes, specifications, advertisements, disks, display equipment or other materials used to promote and show the goods 5. 其他用于展览会展示的货物 e. Other goods exhibited in the expo. ( 二 ) 除我国缔结或者参加的国际条约 协定及国家法律 行政法规和海关总署规章另有规定外, 展览品进口时免于交验进口许可证件 免交进口关税和其它税费 进口展览品应当接受海关监管, 按照海关规定办理海关手续 2. Otherwise prescribed in the national law, administrative laws and regulations, regulations by the General Administration of Customs or international treaties that our country concluded or entered into, when the exhibits are under entry clearance, it is not required to hand over the import license for examination nor to pay any import tariff or other taxes. The imported exhibits shall be supervised by the Customs and Customs formalities shall be handled in accordance with the regulations by the Customs. ( 三 ) 中华人民共和国禁止进出境物品表 3. Prohibited Inbound and Outbound Articles List of the People's Republic of China 1. 禁止进境物品

Prohibited inbound articles (1) 各种武器 仿真武器 弹药及爆炸物品 ; All kinds of weapons, imitation weapons, ammunitions and explosives; (2) 仿造的货币及仿造的有价证券 ; Counterfeit currencies and negotiable securities; (3) 对中国政治 经济 文化 道德有害的印刷品 胶卷 照片 唱片 影片 录音带 录像带 激光视盘 计算机存储介质及其它物品 ; Printing materials, films, photos, records, movies, audio tapes, videotapes, laser discs, computer storage mediums or other articles that could do harm to the politics, economy, culture and moral codes in China; (4) 各种烈性毒药 ; Deadly poisons of all kinds; (5) 鸦片 吗啡 海洛因 大麻以及其它能使人成瘾的麻醉品 精神药物 ; Opium, morphine, heroin, marihuana or other addictive narcotic drugs and psychotropic drugs; (6) 带有危险性病菌 害虫及其它有害生物的动物 植物及其产品 ; Dangerous germs, pests or other harmful animals, plants and their derivative products; (7) 有碍人畜健康的 来自疫区的以及其它能传播疾病的食品 药品或其它物品

5 Food, medicines and other articles that do harm to the health of human beings and animals, come from epidemic areas or disseminate diseases; 2. 禁止出境物品 b. Prohibited outbound articles (1) 列入禁止进境范围的所有物品 ; Any article that is included in the list of the Prohibited Inbound Articles (2) 内容涉及国家秘密的手稿 印刷品 胶卷 照片 唱片 影片 录音带 录像带 激光视盘 计算机存储介质及其它物品 ; Drafts, printing materials, films, photos, records, movies, audio tapes, videotapes, laser discs, computer storage mediums or other articles whose contents involve the state secrets; (3) 珍贵文物及其它禁止出境的文物 ; Precious cultural relics and other prohibited outbound cultural relics; (4) 濒危的和珍贵的动物 植物 ( 均含标本 ) 及其种子和繁殖材料 Endangered and rare animals and plants (including their specimens) and their seeds and breeding materials. ( 四 ) 展览品的主管地海关为境内举办展览会所在地海关或者货物进出境地海关 通过转关运输方式进出境的展览品, 主管地海关为转关指运地或启运地海关 主管地海关负责对暂时进出境货物进行实际监管, 以及受理暂时进出境相关业务 4. The local managing Customs of the exhibits indicate those located in

6 the same region where the expo is held or those responsible for the entry and exit of the goods. For those inbound or outbound exhibits that undergo tran-customs transportation, their local managing Customs shall be the designated destination Customs or the departure Customs of the tran-customs transportation. The local managing Customs shall be responsible for the actual supervision over the goods temporarily imported or exported and shall take care of the relevant business related to the temporary entry and exit. ( 五 ) 开展或展览品进口 20 日前, 海博会 主办单位 ( 以下简称办展人 ) 或其代理人应当持以下批准文件和相关单据, 到主管地海关办理备案手续 5. The host unit of the Maritime Expo (hereinafter referred to as Sponsor ) or its agent shall bring the following approval documents and relevant documents to go through the filing formalities in the local managing Customs 20 days before the opening of the Expo or the entry of the exhibits. 1. 展览会备案登记表 ( 一式两份 ); a. Filing Registration Form for Exhibition (Made in duplicate) 2. 国家主管部门批准的文件 ; b. Documents approved by the national competent authorities 3. 有国家限制进口货物参展的, 需提供相应批准文件 ; c. Relevant approval documents shall be provided in the case that some of the exhibits are restricted imported articles; 4. 展会总体方案 ;

7 d. Overall scheme for the Expo 5. 展区平面图 参展商名录 ; e. Plan of the exhibition sections and List of the exhibitors; 6. 展品清单 ; f. List of the exhibits. 7. 展览用品清单 ( 展览会期间供消耗 散发的用品 ) g. List of articles for the exhibition (article to be expended and distributed during the Expo) ( 六 ) 展品进口时, 参展人或其代理人应持 展览会备案登记表 和 展品清单 等相关单据向主管地海关办理展览品进口申报手续, 参展人或其代理人应向主管地海关提交相当于税款的保证金或者海关认可的其他有效担保 ATA 单证册持证人应当提交真实有效的 ATA 单证册正本 准确的货物清单以及其他相关商业单据或者证明, 免于填制报关单 ATA 单证册项下展览品, 由中国国际商会向海关总署提供总担保 6. During the entry of the exhibits, the exhibitors or their agents shall bring the Filing Registration Form for Exhibition and list of exhibitions or other relevant documents to go through the declaration formalities for their exhibits in the local managing Customs. The exhibitors or their agents shall provide the local managing Customs with deposits as tax payment or other effective collaterals approved by the Customs. The holder of the ATA Carnet shall provide the true and effective original ATA Carnet, correct list of goods and other relevant commercial documents or certificates so that the Customs Declaration does not need filling in. Guarantee for the exhibits described in

8 the ATA Carnet will be provided by China Chamber of International Commerce for the General Administration of Customs. 进口展品报关流程 Declaration procedures for the imported exhibits 参展商向代理人提交展览品清单 Exhibitors provide the list of exhibits for their agents 代理人向海关申请办理展览品审批手续 Agents go through examination and approval formalities for the exhibits in the Customs 海关审批 Customs examination and approval 海关审核 收取保证金 Customs examination and approval; payment of deposits 海关将审核结果反馈代理人 参展商 Feedback of examination and approval results sent by Customs to the agents and exhibitors 展览品运输入境, 向海关报关 exhibits transportation and entry; declaration in the Customs 海关查验 放行 Customs check and examination, clearance 展览品进入展馆布展 Transport the exhibits to the Expo for exhibition ( 七 ) 展览品作为暂准进口货物, 除因正常使用而产生的折旧或者损耗外, 应当在进境之日起 6 个月内按照原状复运出境 因特殊情况需要延长期限的, 办展人 参展人应当在展期届满 30 日前持原批准部门同意延期的批准文件向主管地海关提出延期申请 7. Otherwise worn during the normal use, as articles temporarily imported, the exhibits shall be exported in their original state within 6 months after the entry date. If this term shall be prolonged due to some special situation, the sponsor and exhibitors shall bring the relevant approval

9 documents issued by the original approval authorities to apply for such extension in the local managing Customs 30 days before the closure of the Expo. 出口展品报关流程 Declaration procedures for the exported exhibits 展览品复出口报关 Export declaration for the exhibits 海关接单审核 Customs examination and approval 海关查验 放行 Customs check and examination, clearance 海关核销 records cancellation after verification by Customs 企业向海关申请退保证金 enterprises apply for deposits return from the Customs 海关审核后退保证金并结案 Customs return the deposits after examination and approval and approve the clearance. ( 八 ) 办展人 参展人应当于进境展览品办结海关手续后 30 日内向备案地海关申请展览会结案 8. The sponsor and exhibitors shall apply for the closure of the Expo in the filing Customs within 30 days after they have completed the formalities for their imported exhibits in the Customs. ( 九 ) 展览会期间供消耗 散发的用品 ( 以下简称展览用品 ), 由海关根据展览会的性质 参展商的规模 观众人数等惰况, 对其数量和总值进行核定, 在合理范围内的, 按照有关规定免征进口关税和进口环节税 :

As for the consumables or distributed goods (hereinafter referred to as articles for exhibition) in the Expo, the Customs will evaluate and confirm their quantity and total value on the basis of the nature of Expo and number of exhibitors and visitors. In addition, the Customs will also exempt the import tariff and import linkage tax to a reasonable extent according to relevant regulations: 1. 在展览活动中的小件样品, 包括原装进口的或者在展览期间用进口的散装原料制成的食品或者饮料的样品 ; a. Samples used in the Expo activities, including the samples of food or drinks that are imported with the original packaging or made of imported bulk raw materials during the Expo; 2. 为展出的机器或者器件进行操作示范被消耗或者损坏的物料 ; b. Materials consumed or damaged in the operation or demonstration of the exhibited machines or apparatuses; 3. 布置 装饰临时展台消耗的低值货物 ; c. Low value articles consumed during the decoration of the temporary exhibition stands; 4. 展览期间免费向观众散发的有关宣传品 ; d. Relevant advertisement articles distributed to the visitors free of charge during the Expo; 5. 供展览会使用的档案 表格及其它文件 e. Records, forms or other documents used in the Expo. 前款第 1 项所列货物, 应当符合以下条件 :

11 The articles listed in the first item of the previous article shall meet the following requirements: (1) 由参展人免费提供并且在展览期间专供免费分送给观众使用或者消费的 ; The articles shall be provided by the exhibitors free of charge and exclusively distributed to the visitors for use or for consumption during the Expo; (2) 单价较低, 作广告样品用的 ; The articles are of relatively low price and exclusive for the use as advertisement samples; (3) 不适用于商业用途, 并且单位容量明显小于最小零售包装容量的 ; The articles are not for commercial use and their unit capacity shall be obviously smaller than the minimum retail packaging capacity; (4) 食品及饮料的样品虽未按照本款第 3 项规定的包装分发, 但确实在活动中消耗掉的 Though the samples of food and drinks are not distributed in the packaging as prescribed in the 3 rd provision of this article, they have been actually consumed during the activities. 展览用品中的酒精饮料 烟草制品及燃料不适用有关免税的规定 Regulations on tax exemption are not applicable to the alcoholic drinks, tobacco products and fuels for exhibition. 展览用品属于国家实行许可证件管理的, 应当向海关交验相关证件,

12 办理进口手续 In the case that the articles for exhibition are under the management of relevant national licenses or certificates, such documents shall be provided for the Customs for examination and relevant entry formalities shall be handled. 第 1 项所列展览用品超出限量进口的, 超出部分应当依法征税 ; 第 2 项 第 3 项 第 4 项所列展览用品, 未使用或者未被消耗完的, 应当复运出境, 不复运出境的, 应当按照规定办理进口手续 If the quantity of the exhibits listed in the first item excels the limit, tax shall be paid by law for the excess part; the unused or unconsumed articles listed in the second, third or fourth item shall be exported back outbound, otherwise, relevant entry formalities shall be handled in accordance with relevant regulations. ( 十 ) 核销结案 10. Records cancellation after verification by the Customs and Customs clearance 展览会以暂时进口方式报关进口的展品是海关监管货物, 在展会结束后须到海关根据不同的展品流向办理后续结案手续 : The imported exhibits declared by the Expo in the form of temporary entry are articles supervised by the Customs. After the Expo, the Customs clearance formalities shall be dealt with according to different transportation destinations of the exhibits. 1. 在境内其他关区继续参展 :

13 展会结束后, 部分展品需运至其他关区参加展览会的, 办展人或其代理人需向现场海关申请并按照海关对转关运输的有关规定办理转关手续, 原征保证金退还 a. Exhibits to be used for other exhibitions in China: once the Expo is closed, some of the exhibits need transporting to the other exhibition venues. The sponsor or his agents shall go through the tran-customs transportation formalities in the Customs on the spot in accordance with the regulations on Customs transit. The paid deposits will be returned. 2. 复运出境 : 办展人或其代理人持展品退运清单到海关办理展览品复运出境 退运出口时报关单 监管方式 栏填报 展览品, 征免性质 栏填报 其他法定, 征免规定 栏填报 全免, 同时在报关单关联报关单号栏填报原进口报关单编号 b. Returned exhibits: for those exhibits that need transporting back outbound, the sponsor and his agents shall bring the list of the returned goods to handle the return export declaration formalities in the Customs. While dealing with the export declaration, fill exhibits in the column of supervision pattern, other statutory exemptions in that of nature of exemption and fill full exemption in the column of exemption regulation. In addition, the number of the original import declaration shall be filled in the column of associated declaration number. 3. 转为正式进口 : 提前向现场海关申请, 并填制报关单, 按照一般贸易方式报关 涉及国家许可证件管理的按要求向海关提交相应证件并办结纳税等各项海关监管手续, 在报关单关联报关单号栏填报原进口报

14 关单编号 c. To change into formal entry: An application shall be filed with the Customs on the spot beforehand, and a customs declaration form shall be filled out to handle customs declaration by way of general trade. As for products subject to state license management, the corresponding license shall be submitted to the Customs as per relevant requirements and various customs supervision procedures (such as tax payment, etc.) shall be completed. The number of the original import declaration form shall be filled in the Related Declaration Form No. column of the declaration form. ( 十一 ) 海关驻场监管须知 11. Notice about entry of the Customs into the Expo 进境展览品在非展出期间应当存放在海关指定的监管场所, 未经海关批准, 不得移出 因特殊原因确需移出的, 应当经海关批准 Imported exhibits shall be stored in the supervision place designated by the Customs during the entire duration when they are not exhibited, and may not be moved out without approval of the Customs. If they need to be moved out due to special reasons, approval of the Customs must be obtained. 展览会办展人 参展人或其委托代理人应当于展览品开箱前通知海关到场查验, 海关查验时, 展览品所有人或其委托代理人应当在场, 并负责搬移 开拆 重新封货包装等协助查验的工作 Before unpacking of the exhibitors, the sponsor, exhibitor or his agent shall inform the Customs for examination and inspection. During examination and inspection by the Customs, the owner of the exhibitors or

15 his agent shall be on the scene to assist with the said inspection by performing such tasks as moving, opening, repacking and sealing, etc. 二 入境参展品检验检疫方式及工作流程 II. Inspection and quarantine method and procedures for the imported exhibits ( 一 ) 检验检疫方式 1. Inspection and quarantine method 东莞出入境检验检疫局对东莞口岸入境的展品实行口岸报检直接放行, 展馆现场临时监管仓或中转仓实施集中查验的方式, 或由参展商申请在口岸现场完成检验检疫工作 Dongguan Bureau of Entry-Exit Inspection and Quarantine will apply the following inspection and quarantine methods for the exhibits that enter the ports in Dongguan: application for inspection and quarantine and then direct clearance; centralized examination of the temporary supervisory or transit warehouses of the exhibition venue; or the exhibitors apply for spot inspection and quarantine directly in the ports. 2. 对从东莞之外的口岸入境的原柜原封展品, 须进行检疫查验的, 入境口岸检验检疫机构负责对运输集装箱箱体外表实施检疫查验, 其他检验检疫工作由东莞出入境检验检疫局负责 ; 对来自动植物疫区或传染病高风险地区的集装箱, 在入境口岸实施检验检疫及必要的防疫消毒处理 ;

16 Where exhibits entering from a port outside Dongguan in their original containers with the seal unbroken must be subject to quarantine inspection, the inspection and quarantine organization in the port of entry shall be responsible for performing quarantine inspection to the surface of the container, while other quarantine and inspection work shall be handled by the Dongguan Bureau of Entry-Exit Inspection and Quarantine. As for containers coming from an animal or plant epidemic area or high risk area for infectious diseases, relevant inspection and quarantine as well as necessary epidemic prevention and disinfection treatment shall be performed at the port of entry. 3. 对入境后在口岸卸货再装运至东莞口岸且须查验的展品, 入境口岸检验检疫机构对整件展品外包装实施查验, 须作检疫处理的, 按有关规定实施处理, 其他检验检疫工作由东莞出入境检验检疫局负责 For exhibits to be unloaded and re-transported to a port in Dongguan after entry, the inspection and quarantine organization at the port of entry shall inspect the outer packing of the whole exhibit if such inspection is required; if the same shall be subject to quarantine treatment, relevant stipulations shall be followed. All other inspection and quarantine work shall be taken charge by the Dongguan Bureau of Entry-Exit Inspection and Quarantine ( 二 ) 东莞口岸入境展品检验检疫工作流程 ( 见如下示意框图 )

19 Enter the exhibition hall N Sale of exhibits Disposal of exhibits after Expo Overall destruction Exported or destroyed Export application For repurposed use which is approved by the inspection and quarantine authority ( 三 ) 入境展品的报检和监督管理 Application for inspection and quarantine of the imported exhibits and the supervision and management over them 1. 展品是指参加展会 依法申报的出入境物品以及展会用品, 由参展商代理人在入境时向口岸检验检疫机构报检, 提交参加展会备案表 相关证明文件和展品清单 提单 / 运单等 a. The exhibits mean those exported or imported articles for exhibition and articles used in the Expo that have been declared by law. The agents of the exhibitors shall apply for inspection and quarantine for the exhibits to the inspection and quarantine authority of the ports during the entry of the articles. For the application, the Filing Form for Expo Participation, relevant certificates or documents, list of the exhibits and bill of lading or bill of freight shall be submitted. 2. 展品运抵展馆现场的监管仓或中转仓进行集中查验 b. The exhibits shall be transported to the supervisory or transit warehouses of the exposition venue for centralized examination. 3. 对非销售的展品可免予品质检验, 涉及放射性检测的重金属矿产品 石材产品等除外

20 c. The quality inspection for the exhibits not for sale is not necessary, except for the mineral products containing heavy metals and stone products. 4. 展品为动植物及其产品的, 报检时须附有输出国官方出具的动物检疫证书或植物检疫证书 属于需要办理检疫审批的, 还须提交国家质检总局或广东出入境检验检疫局审批签发的 中华人民共和国进境动植物检疫许可证, 或农业 林业部门签发的检疫审批单 d. If the exhibits involve animal and plants or their products, Animal or Plant Quarantine Certificate issued by the exporting country shall be provided in the application for the inspection and quarantine for the exhibits. In the case that examination and approval of quarantine shall be applied, the Entry Animal and Plant Quarantine License of The People's Republic of China issued by General Administration of Quality Supervision, Inspection and Quarantine of the People s Republic of China or Guangdong Entry-Exit Inspection and Quarantine Bureau after their examination and approval, or the Approval of Import / Export Special Articles for Verification of Health and Quarantine issued by Ministry of Agriculture or Ministry of Forestry of the People's Republic of China shall be provided. 5. 展品为检疫审批范围内的进境动植物源性食品的, 须提交总局批复并授权广东出入境检验检疫局签发的 国际展会检疫许可函 和展品清单 e. If the exhibits involve entry animal or plant-derived food which falls in the range of examination and approval of quarantine, the Quarantine License for International Exhibition approved by the General Administration

21 of Quality Supervision, Inspection and Quarantine or issued by Guangdong Entry-Exit Inspection and Quarantine Bureau by authorization and the list of exhibits shall be submitted. 6. 展品涉及转基因标识目录范围的动植物产品, 须书面声明是否含有 转基因 成分, 如含转基因成份须提供农业部出具的 转基因生物安全证书 f. If the exhibits involve animal or plant products that fall in the catalogue with GM labeling, written declaration shall be provided to indicate whether the products contain any transgenic constituents. If the products do contain transgenic constituents, the Safety Certificate of Genetically Modified Organisms issued by the Ministry of Agriculture shall be provided. 7. 展品中涉及试销的进口食品化妆品, 需提交已加注广东出入境检验检疫局意见的 展会试销进口食品化妆品免予加贴中文标签申请表 ; 不涉及试销的进口食品化妆品展品, 应提交加盖公司公章的保证展品只作试尝 试用或展览用途的保函 g. If the exhibits involve imported food or cosmetics for trial sale, Application Form for Chinese Labeling-free on Imported Food and Cosmetics for Trial Sale in Exhibition with the attachment of Opinions of Guangdong Entry-Exit Inspection and Quarantine Bureau shall be provided; otherwise, the Letter of Guarantee with seal of the company affixed thereto declaring that the articles involved are only used as food samples, trial products or exhibits shall be provided.

The following articles are included in the catalogue of products of compulsory certification:electric wires, circuit switches, devices protecting or connecting electric appliances, low-voltage apparatuses, low power motors, electric tools, electric welding machines, household appliances and similar devices, audio and video apparatuses, information technology devices, lighting electrical apparatuses, telecommunication terminal equipment, motor vehicles and their safety accessories, tires for motor vehicles, safety glass, agricultural machinery products, latex products, medical apparatus and instruments, fire products, security and protection products, decoration products, Wireless local area network (LAN) products and toys. If the exhibits are packed with wooden materials, such packaging materials shall meet the standard (No. 15) prescribed in the Plant Quarantine Measures of International Plant Protection Convention (IPPC). (3) 对于已获得准入资格且需办理 进境动植物检疫许可证 的展品, 参展商在展品入境 30 天前报请广东出入境检验检疫局进行检疫审批 申请时须提交展品清单和有关参展证明文件, 由广东出入境检验检疫局审批 有关审批流程如下 : For exhibits that have been given the entry approval and for which an Entry Animal and Plant Quarantine License must be obtained, the exhibitor shall apply for the examination and approval of quarantine for these exhibits with the Guangdong Entry-Exit Inspection and Quarantine Bureau 30 days before the entry. During such application, the list of exhibits and relevant certificates of exhibition participation shall be provided. The procedures for the aforesaid examination and approval are displayed below:

30 (5) 对未获得准入且来自无进口禁令 非动植物疫情流行国家或地区的有关动植物产品, 由参展商或其代理商向质检总局申请办理特许审批, 经质检总局批准后, 有关动植物产品可入境参展, 展后不得内销, 全部退运或销毁 With regard to animal or plant products that have not been given the entry approval and come from a country or area where there is no import ban, and no animal or plant epidemic, the exhibitor or its agent may apply to the General Administration of Quality Supervision, Inspection and Quarantine for special permission. Upon approval, relevant animal or plant products may be imported for the exhibition. After the Expo, they may not be sold in China or must be returned or destroyed. 4. 特殊物品的卫生检疫审批办理 d. Examination and approval of health quarantine for special articles 微生物 生物制品 血液及其制品 人体组织等特殊物品 Microorganisms, biological products, blood and its products, human tissues or other special articles. 参展商或其代理人在展品交付装运前至少提前 7 个工作日, 向广东出入境检验检疫局卫生处提出申请办理卫生检疫审批 生物制品和血液制品可凭展会组织部门的证明文件及展会结束后全部退运出境的保证办理审批, 人体组织及其制品 微生物等特殊物品除上述资料外还须提供省级卫生主管部门的相关证明文件方可办理审批 Exhibitors or their agents shall apply for the examination and approval of health quarantine in the Health Office of Guangdong Entry-Exit

31 Inspection and Quarantine Bureau at least 7 working days before the delivery and shipment of the exhibits. In the case of biological products and blood products, the exhibitors could apply for the examination and approval with the presence of relevant certificates issued by the organizing department of the Expo or a Letter of Guarantee stating that all of the exhibits will be returned and exported after the closure of the exhibition; in the case of the human tissues and their products, microorganisms or other special articles, in addition to the abovementioned documents that shall be presented, relevant certificates or documents issued by the provincial health authorities shall be also provided to complete the application for examination and approval. ( 五 ) 展品的展后处理 5. Disposal of exhibits after the exhibition 1. 一般应在会展结束后 20 个工作日内向东莞出入境检验检疫局办理入境展品的核销手续 a. Application for record cancellation after verification of the entry exhibits to Dongguan Bureau of Entry-Exit Inspection and Quarantine shall be made within 20 days after the closure of the exhibition. 2. 复出境的入境展品凭会展备案书 入境展品清单 通关证明或 ATA 单证册项办理核销 因发生损耗 丢失 被窃 损耗或毁坏等情形而不能复出境或放弃的入境展品, 审核相关情况说明材料后核销 b. Record cancellation after verification will be handled for the re-exported entry exhibits with the presence of Records of Exposition, list of entry exhibits, Clearance Certificate or ATA Carnet. If the entry exhibits fail

32 to be re-exported or shall be abandoned due to the wear, loss, steal, damage or other situations, the record cancellation after verification could be completed after examination about relevant situation and materials. 3. 参展商放弃的涉及食品 化妆品, 动物 植物 动植物产品 ( 含动植物源性食品 ) 类的入境展品应送到指定场所作销毁处理 检验检疫机构审核报检单位填写的入境展品核销表, 核实无误后, 对销毁过程作必要的监督 c. The entry exhibits abandoned by the exhibitors that involve food, cosmetics, animals and plants or their products (including animal and plant-derived food) shall be moved to the designated places and then destroyed. The inspection and quarantine authority shall examine and approve the Form of Record Cancellation after Verification for Entry Exhibits filled out by the applicant for inspection and quarantine. After the confirmation of the information thereof, such authority shall supervise over the destruction of these abandoned exhibits. 4. 展会结束后拟在国内销售 使用的展品, 报检单位须统计后填写入境商品核销表递交东莞出入境检验检疫局 东莞出入境检验检疫局审核无误后签章 报检单位凭签章后的核销表在东莞出入境检验检疫局重新报检 d. In terms of exhibits that are expected to be sold or used domestically after the closure of the exhibition, the applicant for inspection and quarantine shall fill out the Form of Record Cancellation after Verification for Entry Commodities after statistics and submit such form to Dongguan Bureau of

33 Entry-Exit Inspection and Quarantine and the latter will affix signature and seal of the bureau to the form after examination. The applicant for inspection and quarantine will re-apply for inspection and quarantine in Dongguan Bureau of Entry-Exit Inspection and Quarantine with such signed and sealed document. 涉及 CCC 认证的展品若需在国内销售 使用, 应做好认证申请工作并取得认证文件号, 在获得认证文件号之前, 不能在国内销售 使用 If the exhibits involving China compulsory certification (CCC) are expected to be sold or used domestically, application shall be made for the certification and relevant certification document number shall be acquired. Before the acquisition of such document number, the relevant exhibits shall not be sold or used domestically. 5. 入境展品在展会结束后如需回运的, 免予检验, 报检单位须统计后填写入境展品核销表递交东莞出入境检验检疫局 e. If the entry exhibits shall be returned and exported after the closure of the exhibition, they could be free of inspection. The applicant for inspection and quarantine shall fill out the Form of Record Cancellation after Verification for Entry Commodities after statistics and submit such form to Dongguan Bureau of Entry-Exit Inspection and Quarantine. ( 六 ) 人员携带物出入境检验检疫管理规定 6. Regulation on inspection and quarantine management over personal entry or exit articles

34 根据国家质检总局第 146 号令 出入境人员携带物检疫管理办法 的规定 : According to the No. 146 Order of General Administration of Quality Supervision, Inspection and Quarantine --- Measures for Quarantine Management over Personal Entry or Exit Articles 1. 出入境人员携带下列物品, 应当申报并接受检验检疫机构检疫 : a. Any individual who carries the following articles inbound or outbound shall make declaration and receive the quarantine from the inspection and quarantine authority: (1) 入境动植物 动植物产品和其他检疫物 ; Entry animals and plants or their products or other quarantine articles; (2) 出入境生物物种资源 濒危野生动植物及其产品 ; Entry or exit biological and species resources, endangered wild animals and plants or their products; (3) 出境的国家重点保护的野生动植物及其产品 ; Exit wild animals and plants or their products that are under national important protection; (4) 出入境的微生物 人体组织 生物制品 血液及血液制品等特殊物品 ; Exit and entry microorganisms, human tissues, biological products, blood and its products or other special articles; (5) 出入境的尸体 骸骨等 ;

35 Exit or entry bodies and skeletons; (6) 来自疫区 被传染病污染或者可能传播传染病的出入境的行李和物品 ; Exit or entry luggage or articles that come from epidemic areas or carry infectious diseases; (7) 国家质检总局规定的其他应当向检验检疫机构申报并接受检疫的携带物 Other articles that shall be declared to the inspection and quarantine authority and shall receive quarantine as prescribed by General Administration of Quality Supervision, Inspection and Quarantine. 2. 出入境人员禁止携带下列物品进境 : b. Entry of the following articles carried by inbound or outbound personnel is prohibited: (1) 动植物病原体 ( 包括菌种 毒种等 ) 害虫及其他有害生物; Pathogens of animal or plant (including bacterial or virus species), pests or other harmful organisms; (2) 动植物疫情流行的国家或者地区的有关动植物 动植物产品和其他检疫物 ; Relevant animals, plants or their products or other quarantine articles coming from epidemic countries or regions of epizooty or epiphytotic; (3) 动物尸体 ; Animal bodies; (4) 土壤 ;

36 Soil; (5) 中华人民共和国禁止携带 邮寄进境的动植物及其产品名录 所列各物 ; Articles listed in the Catalogue of the People s Republic of China on Prohibited Entry Animals and Plants and Their Products through Carriage or Posting: (6) 国家规定禁止进境的废旧物品 放射性物质以及其他禁止进境物 Entry waste articles and radioactive materials prohibited by the country or other prohibited entry articles. ( 七 ) 法律责任 7. Legal Liabilities 对不如实申报或逃避检验检疫监管的, 或造成疫情疫病扩散等严重后果的, 检验检疫机构依据有关法律法规追究其法律责任 检验检疫工作人员应严格履行职责, 违法 失职的依法给予行政处分, 构成犯罪的追究刑事责任 In the serious case that false information is provided in the declaration, or there is avoidance of the inspection and quarantine regulation, or the epidemic diseases are spread out, the inspection and quarantine authority can hold the relevant party accountable by laws and regulations. The inspection and quarantine personnel shall strictly comply with their job responsibilities; otherwise, they will be given disciplinary sanctions for their illegal activities
