Our Client Ramaxel Technology Ltd. of Hong Kong Has Won The investigation (No. 337-TA-630) Both in ITC s Initial Determination and Final Determination On December 29, 2009, the U.S. International Trade Commission ( ITC ) determined that Ramaxel Technology Ltd. of Hong Kong, China, which was our client in this investigation, has not violated section 337 of the Tariff Act of 1930, 19 U.S.C. 1337, in investigation of In the Matter of CERTAIN SEMICONDUCTOR CHIPS WITH MINIMIZED CHIP PACKAGE SIZE AND PRODUCTS CONTAINING SAME (III) (No. 337-TA-630), and terminated this investigation. So far, our client Ramaxel Technology Ltd. of Hong Kong has won this investigation both in ITC s initial determination and final determination. 337 Investigations in the U.S. Recent Section 337 Complaints On December 29, 2009, Nokia Corporation and Nokia Inc. filed the U.S International Trade Commission (ITC) with a Complaint requesting that the Commission conduct an investigation under section 337 of the Tariff Act of 1930, as amended regarding Certain Electronic Devices, Including Mobile Phones, Portable Music Players, and Computers. The proposed respondent is Apple Inc. 337-related Commission Notices (1) On December 30, 2009, The U.S. International Trade Commission (USITC) decided to institute an investigation of certain liquid crystal display devices and products containing the same.
The investigation is based on a complaint filed by Samsung Electronics Co., Ltd. of Seoul, Korea, on December 1, 2009. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain liquid crystal display devices products containing same that infringe patents asserted by Samsung. The complainant requests that the USITC issue an exclusion order and cease and desist orders. The USITC has identified Sharp Corporation of Japan, Sharp Electronics Corporation and Sharp Electronics Manufacturing Company of America as the respondents in this investigation. (2) On December 30, 2009, The U.S. International Trade Commission (USITC) decided to institute an investigation of certain DC-DC controllers and products containing the same. The investigation is based on a complaint filed by Richtek Technology Corp. of Hsinchu, Taiwan, and Richtek USA, Inc., on December 2, 2009. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain DC-DC controllers and products containing the same that infringe patents asserted by Richtek. The complainants also assert misappropriation of trade secrets. The complainants request that the USITC issue an exclusion order and a cease and desist order. The USITC has identified upi Semiconductor Corp., Taiwan, Advanced Micro Devices, Inc., Sapphire Technology Limited, Hong Kong; Diamond Multimedia, Inc., and XFX Technology, Inc., as the respondents in this investigation. (3) On December 30, 2009, The U.S. International Trade Commission (USITC) decided to institute an investigation of certain authentication systems, including software and handheld electronic devices. The investigation is based on a complaint filed by Prism Technologies LLC., on
December 2, 2009. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain authentication systems, including software and handheld electronic devices that infringe a patent asserted by Prism Technologies. The complainant requests that the USITC issue an exclusion order and a cease and desist order. The USITC has Research In Motion, Ltd., Canada and Research In Motion Corp, as the respondents in this investigation. (4) On December 31, 2009, The U.S. International Trade Commission (USITC) decided to institute an investigation of certain surface mount MEMS devices and products containing the same. The investigation is based on a complaint filed by Analog Devices, Inc. on December 1, 2009. The complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the United States and sale of certain MEMS devices and products containing the same that infringe patents asserted by Analog Devices. The complainant requests that the USITC issue exclusion orders and cease and desist orders. The USITC has identified Knowles Electronics LLC and Mouser Electronics, Inc. as the respondents in this investigation. IP Strategy of Enterprises Coolpad s Patent Applications in 2009 Exceeded 1,000 In 2009, the number of patents applied by Yulong Coolpad in the field of mobile phone had broken 1,000, which made Yulong Coolpad one of the fastest-growing companies in terms of patents in the field of mobile communications. Yulong Coolpad regards intellectual
property as an important strategic resource to achieve its business objectives, and attaches great importance to the investment in technological innovation and R & D. IP Cases Trademark Case Between SANY and Benz Recently, the British High Court in London delivered its decision over the trademark case between SANY Group and Daimler-Benz Motor Company. The Court rejected Benz s claim that SANY s trademark infringed on Benz s logo. This win means that China SANY Group achieved substantial success in the trademark battle with Benz Company. Background: In 2006, SANY Group applied to register the company s graphical logo and the text of SANY with British Trademark Office. Within the time limit of the announcement period, Benz Company requested that SANY s logo should go through examination. Moreover, Benz Company filed a lawsuit with the British High Court in London against SANY Group for trademark infringement. Trade News Revision of the Detailed Rules for the Patent Law Implementation On December 30, 2009, Executive Meeting of the State Council examined and principally approved the Decision of the State Council on Amending the Detailed Rules for the Implementation of the Patent Law of the People s Republic of China (Draft). The Draft complements and refines the patent application procedures and authorization rules, improves the confidential review system of Chinese patent application in foreign countries, and defines the disclosure requirements for information of inherited resources and the administrative
penalties for acts of counterfeiting patents, etc. revision. The Meeting decided that the Draft will be promulgated by the State Council after further IP Cooperation Website of Five IP Offices Launched After a long period of negotiation and joint efforts, the State Intellectual Property Office of the People's Republic of China (SIPO), the United States Patent and Trademark Office (USPTO), the European Patent Office (EPO), the Japan Patent Office (JPO), and the Korean Intellectual Property Office (KIPO) recently have launched a new website: www.fiveipoffices.org. The website will contain news and background information on cooperation, particularly on ten joint "Foundation Projects" agreed at the second meeting of directors of the five offices in October 2008 in Jeju Island, South Korea. The "Foundation Projects" mainly concerns database construction, patent examination and search strategy, patent classification, computer translation as well as personnel training, etc. They aim to coordinate the procedures of patent examination and review and to share the fruits of cooperation between the five offices.
