TheMortgageandSaleofPrivateLandandthe OneLandTwoOwnersSystem"intheSongDynasty DaiJianguo (99) IntheSongdynastytheseparationoflandownershipandlanduserightswasacommon phenomenon.inthecaseofamortgagethereexisteddefactotwoownersofthesamepieceof land:theownerofthelandi.e.themortgagerandtheownerofthelanduserightsi.e.the mortgageeformingadefacto onelandtwoowners"system.ifthere were morethanone mortgageesforthesamepieceofprivatelandthenwhenthelandownershipwassoldtheorder ofpriorityforitspurchasewasbasedonthechronologicalsequenceofthemortgages.apartfrom re-mortgagingthelandthemortgageecouldalsoselofthelanduserightsalongwiththepre- emptiverighttobuythelandownership.iftheownersoldtheownershipofthelandtoathird partythe original mortgage relationship would not beinvalidated by the change ofthe ownership.accordingtothesongsystem ofleviesandhouseholdregistrationlandthathad beenmortgagedwasregardedaspropertythathadbeentransferredsooncetherightstousethe landhadbeenlostitwasonlynominaly property"andwasnotregisteredassuch.intermsof householdregistrationthegovernmentimplementeda onepieceoflandoneowner"system. Unlikethe onelandtwoowners"systemusedinthecirculationoflandtheone-ownershipform oweditsadoptiontotheexerciseoffiscalandadministrativefunctionsaimedatreducingthecost ofsocial managementto the government. The maturing and perfecting of means of and mechanismsforland mortgage and sale promoted the circulation ofland and also ofthe commodityeconomywithaprofoundinfluenceonlatersocialdevelopment. TheStructureandFeaturesoftheShujishiGroupintheMingDynasty GuoPeigui(8) Theshujishi ( HanlinBachelors)ofthe Ming Dynasty wereagroupofsuccessful candidatesinthehighestimperialexamination (nextonlytojinshi)whoconstitutedoneofthe sourcesofhigh-rankingoficialssuchascabinetmembers.thegroupcanbasicalybedividedinto sixclassesaccordingtotheir methodofselectionandduties.amongthemthoseselectedby examinationconstitutedthemainbody.theoriginsofshujishibothintermsofregionandfamily backgroundwereverydiverseandthegrouphadahighrateofsocialmobility.8.8% were from non-jinshi familiesand those who werefrom jinshi families were usualy thefirst generation.noshujishifamilies were maintainedfor morethanthreegenerations.shujishi selectionandexaminationbecamethemainchannelby whichthe Mingimperialcourtabsorbed intohighoficetalentfromalwalksoflifeandalregionsespecialythenorthnorthwestand southwestaswelasotherremoteprovinces.thegroupwasnotonlyimportantinenablingthe rulingclasstoachievecomplementarityamongtalentedrecruitswithdiferentstrengthsbutalso playedanirreplaceableroleinenhancingthe Mingcourt scohesionandsocialstabilityand consolidateitsunity. 9
