4 内容摘要 内容摘要 在我国, 检察机关作为法律监督机关, 依照法律规定对国家机关及其工作人员 国家工作人员的职务犯罪行使侦查权 职务犯罪侦查权是我国检察机关的一项重要职能, 它是检察机关法律监督职能的重要组成部分 检察机关通过履行这一法律职权发挥了应有的作用, 推进了我国和谐社会的建立以及人权维护工作的深入开展 近年来, 随着我国检察制度改革的逐步推进, 对是否保留检察机关职务犯罪侦查权, 以及在保留其侦查权的情况下如何进行改革和完善, 理论界和实务界都展开了广泛而深入的讨论 本文对我国检察机关职务犯罪侦查权的法律渊源 性质和特点进行介绍和分析, 并对现代国际司法实践的发展进行了考证, 认为赋予我国检察机关职务犯罪侦查权是具有合理性与现实意义的 同时, 本文将从中国国情出发, 对在现阶段如何改革和完善检察机关职务犯罪侦查权提出建议 论文分为前言 正文和结语三个部分, 正文共分为四章 第一章对检察机关职务犯罪侦查权的定义和性质进行了分析 在此基础上, 本章对我国检察机关职务犯罪侦查权的法律规定进行了概述, 并分析了我国检察机关职务犯罪侦查权的特点 最后, 本章对检察机关职务犯罪侦查权存废的论争进行了探讨 第二章主要介绍了外国及其它地区的职务犯罪侦查权制度, 具体从侦查权配 置的模式 侦查权主体与被侦查对象的关系模式 侦查主体独立性 侦查的特别 程序以及对侦查主体的监督等五个方面进行分析 第三章对我国检察机关职务犯罪侦查制度的理论基础及其合理性与现实意义进行了探讨 笔者认为, 在我国, 赋予检察机关职务犯罪侦查权是合理的, 并具有现实意义的 第四章在分析我国职务犯罪侦查权制度缺陷的基础上, 提出了改革我国现行职务犯罪侦查权制度的几点构想 关键词 : 检察机关 ; 侦查权 ; 完善

6 Abstract Abstract As an organ of legal supervision power, prosecutorial organ performs the function of scouting official crimes. It is an important function of prosecutorial organ to scout official crimes. And the power of investigation is an important part of the legal supervision function of prosecutorial organ. For many years, the prosecutorial organ has been playing an important role in scouting official crimes, promoting social harmony and protection of human rights. In recent years, as the progress of reform of prosecutorial organ system, scholars and practitioners have analyzed deeply and comprehensively as to whether the power of investigation should be kept in the prosecutorial organ and how the system of scout power should be perfected. In this thesis, the writer analyzes the legal origins, nature and characteristics of the power of investigation on official crimes. And based on analysis of the juridical practices in the world, the writer points out it is reasonable and of significances to endow prosecutorial organ with the power of investigation on official crimes. At last, the writer advances some suggestions as to how to perfect the system of power of investigation on official crimes. The thesis consists of the parts of preface, text and conclusion. The text is divided into four chapters. Chapter One introduces the definition and nature of the power of investigation on official crimes of prosecutorial organ, and analyzes the system of power of investigation on official crimes of prosecutorial organ, and discusses the characteristics of the power of investigation. And then, this chapter introduces the debates on power of investigation on official crimes of prosecutorial organ in China. Chapter Two introduces the system of investigation on official crimes in foreign countries and areas. In this chapter, the writer analyzes mode of allocation of power of investigation on official crimes, mode of relations of subjects and objects of power of investigation on official crimes, independence of subjects of power of investigation on official crimes, special procedures of official crimes, and supervision on subjects of power of investigation on official crimes in foreign countries and areas. Chapter Three discusses the reasonability and significances of power of investigation on official crimes of prosecutorial organ in China. The writer points out

12 前言 1 前言 虽然我国法律赋予检察机关对职务犯罪案件的侦查权, 但近年来有些人对我国这一法律制度提出了质疑, 认为应当取消检察机关的职务犯罪侦查权 而另一方面, 检察机关在改革和完善职务犯罪侦查权方面, 作出了许多探索与努力 法学界和司法实务界对检察机关职务犯罪侦查权研究与探索, 呈现百家争鸣 百花齐放的热烈氛围 应该看到, 是否赋予检察机关职务犯罪侦查权, 以及检察机关应如何正确行使这一职权, 不仅关系到检察工作能否健康发展, 影响着未来中国检察权的发展趋势, 而且涉及到国家权力应当如何配置这一重大理论问题 因此, 研究我国检察机关职务犯罪侦查权, 具有重大的理论和现实意义 笔者从从事检察实务的实际感受出发, 采用比较和实证的研究方法, 对中外职务犯罪侦查权的制度进行了分析, 论证赋予检察机关职务犯罪侦查权的合理性, 并对我国如何完善职务犯罪侦查权制度提出自己的粗浅看法
13 2 对赋予和完善我国检察机关职务犯罪侦查权的思考 第一章我国检察机关职务犯罪侦查权制度概述 第一节检察机关职务犯罪侦查权的定义和性质职务犯罪侦查, 是指职务犯罪侦查主体依照法律, 对可能已发生了的职务犯罪收集相关证据, 查找并抓获犯罪嫌疑人所进行的各种专门调查活动以及采取的强制措施 而所谓检察机关职务犯罪侦查权, 是指检察机关依照法律对职务犯罪案件进行专门调查工作和采取有关强制措施的权力 长期以来, 理论界对检察机关职务犯罪侦查权的性质问题一直争论不休 有的学者认为, 检察机关职务犯罪侦查权是一种司法权, 因为检察机关在行使职务犯罪侦查权时表现出一定的独立判断权和处罚权等司法特征 有的学者则认为, 检察机关职务犯罪侦查权应是一种行政权, 因为检察机关代表国家主动对犯罪进行侦查, 这表明检察机关的案件侦查权不具有中立性和消极性 而司法权具有中立性和消极性, 所以检察机关的案件侦查权是一种行政权 1 还有的学者则认为检察机关职务犯罪侦查权是一种法律监督权 2 笔者同意检察机关职务犯罪侦查权是一种法律监督权的意见 首先, 从职务犯罪侦查权的权力制衡功能上看 人民检察院是国家的法律监督机关, 检察机关的职务犯罪侦查权是以权力制衡为基点的, 即以国家权力监督享有国家管理权的国家工作人员的职务活动 从权力制衡理论看, 它具有法律监 督的性质 具体而言, 检察机关通过对职务犯罪进行侦查, 从而使有罪的犯罪嫌 疑人得到应有的惩罚, 最终达到权力制衡的目的 可以说检察机关职务犯罪侦查权的行使本身就是一种刑事强制监督, 体现了权力制衡的一般原理 其次, 从检察监督权的内容看 一般认为, 检察监督权包括侦查权 侦查监督权 公诉权 审判监督权以及执行监督权 检察机关对某些案件行使侦查权, 正是其履行检察职能 实现法律监督权的体现 实践表明, 执法不严 司法不公现象的背后往往隐藏着职务犯罪, 执法人员的职务犯罪必然造成执法不严 司法 1 汪漳龙. 论检察机关案件侦查权 [EB/01] 王桂五. 中华人民共和国检察制度研究 [M]. 北京 : 法律出版社, 1991, 365.
14 第一章我国检察机关职务犯罪侦查权制度概述 3 不公 检察机关对诉讼活动的监督必须与查办执法不公背后的职务犯罪结合起来, 才能有效地清除执法领域中的腐败现象, 这是检察工作多年来积累的一条重要经验 因此, 职务犯罪侦查权是法律监督权不可分割的重要组成部分 综上所述, 检察机关对职务犯罪刑事案件所享有的侦查权, 与其他侦查机关对一般刑事案件的侦查权具有质的区别 检察机关对职务犯罪的侦查, 具有对国家机关及其工作人员 国家工作人员行使权力进行监督的性质 尤其是对执法工作人员职务犯罪的侦查, 不仅体现了检察机关对国家工作人员职务活动的监督, 更是一种对诉讼活动实行强有力的法律监督的重要保障 职务犯罪侦查权是法律监督权的一种实现方式, 职务犯罪侦查权是一种手段而非目的 法律监督权与职务犯罪侦查权是整体权力与要素权力的关系, 两者的基本功能和主要任务是一致的 法律监督权是国家政权结构中独立于行政权 审判权的一项国家权力 职务犯罪侦查权是检察机关法律监督权的组成部分, 也是实现法律监督整体职能的体现 第二节我国检察机关职务犯罪侦查权的法律渊源许多国家和地区均以立法的形式, 对职务犯罪侦查机构及其侦查权作了特殊规定 本节将简要介绍我国检察机关职务犯罪侦查权的法律渊源 一 我国检察机关职务犯罪侦查权的法律规定新中国成立之后, 在很长的一段时间内, 我国一直是依靠政治运动的方式来 打击国家工作人员的职务犯罪 直到 1979 年 刑法 及 刑事诉讼法 颁布后, 我国的职务犯罪侦查制度才逐步走上法制化的轨道 我国检察机关享有职务犯罪案件的侦查权, 主要体现在我国的 刑事诉讼法 和 人民检察院组织法 中 刑事诉讼法 的第一编 总则 第二编 立案 侦查和提起公诉 以及 人民检察院组织法 第一章 总则 第二章 人民检察院行使职权的程序, 对检察机关职务犯罪侦查权作了较为明确 详细的规定 二 我国检察机关职务犯罪侦查权的其他法律渊源在我国法律体系中, 检察机关职务犯罪侦查权的其他法律渊源主要包括最高
15 4 对赋予和完善我国检察机关职务犯罪侦查权的思考 人民检察院对 刑事诉讼法 所作的司法解释及其工作规定 这主要体现在 人民检察院刑事诉讼规则 检察机关贯彻刑诉法若干问题的意见的通知 等法律文件中 首先, 人民检察院刑事诉讼规则 1 作为司法解释, 对检察机关职务犯罪侦查权作了进一步的明确规定 其中对侦查职务犯罪案件的工作规则作了详细规定 其次, 关于查办要案党内请示报告制度 2 规定, 各级检察机关在行使职务犯罪案件的初查 立案侦查权之前, 应向同级党委请示汇报, 取得同级党委的同意和支持后, 才能开展侦查工作 最后, 最高人民检察院在 检察机关贯彻刑诉法若干问题的意见的通知 3 和 人民检察院办案工作中的保密规定 4 中, 对职务犯罪侦查措施做了限制性规定 它要求各级检察机关严格区分视听技术手段与技侦手段, 其指出依照法律规定的取证程序 运用现代视听技术 公开或秘密地获取视听资料证据与依照专门的程序 运用专有技术 由技侦专门人员秘密进行的技术侦查是不同的 对个别案件, 需要使用技侦手段的, 要严格按规定审批, 并由有关部门实施 ; 通过技侦手段获取的证据材料不准公开使用 第三节我国检察机关职务犯罪侦查权的特点职务犯罪的侦查制度作为一种特殊的犯罪侦查制度, 有别于普通犯罪侦查制 度 现代职务犯罪侦查制度的产生和发展正是由于职务犯罪不同于普通犯罪 在 我国, 检察机关职务犯罪侦查权, 除具有一般刑事侦查权的合法性 强制性及秘密性等普遍特征外, 还具有其独特属性 具体而言, 主要表现在以下几个方面 一 侦查对象的特定性检察机关在行使职务犯罪侦查权的过程中, 侦查对象的身份是特定的 我国 刑事诉讼法 等法律法规对检察机关案件侦查权的侦查对象作出了明确规定, 年 12 月 16 日最高人民检察院 人民检察院刑事诉讼规则 年 8 月最高人民检察院 关于查办要案党内请示报告制度 年 12 月最高人民检察院 检察机关贯彻刑诉法若干问题的意见的通知 年 9 月最高人民检察院 人民检察院办案工作中的保密规定
16 第一章我国检察机关职务犯罪侦查权制度概述 5 即检察机关案件侦查权的侦查对象只能是国家机关工作人员和国家工作人员, 以及与其共同实施职务犯罪的公民 1 二 侦查客体的法定性 检察机关对案件管辖范围必须是法律明确列举规定的, 即 刑事诉讼法 第 18 条所列举的犯罪 检察机关不能超越职权侦查管辖范围以外的案件, 如遇到 不在列举范围的刑事案件, 应移交其他侦查机关办理 根据我国相关法律规定, 检察机关享有侦查权的犯罪包括 : 贪污贿赂犯罪 国家工作人员渎职犯罪 国家机关工作人员利用职权实施的非法拘禁 刑讯逼供 报复陷害 非法搜查等侵犯公民人身和民主权利犯罪 对于国家机关工作人员利用职权实施的其他重大的犯罪案件, 需要由人民检察院直接受理的时候, 经省级以上人民检察院决定, 才可以由人民检察院立案侦查 三 侦查主体的唯一性从侦查权的主体看, 我国的职务犯罪侦查是以检察机关为主导的 除刑事拘留 逮捕由公安机关执行外, 对职务犯罪的其他侦查活动及有关职权都必须由检察机关行使 在我国, 依照法律授权, 检察机关是侦查国家机关工作人员和国家工作人员职务犯罪的唯一主体 其他任何机关 团体均无权对职务犯罪行使侦查权 如果其他侦查机关在侦查工作中, 发现国家机关工作人员或国家工作人员利用职务之便实施的贪污贿赂 渎职 侵犯公民人身和民主权利等职务犯罪案件, 应及时移送有管辖权的检察机关 纪检监察机关在查处党员干部 国家工作人员 违法乱纪案件中发现其存在触犯刑法的犯罪行为时, 也应将其移交检察机关办 理 四 侦查过程的特殊性和侦查手段的一般性首先, 检察机关对职务犯罪的侦查过程具有特殊性 具体包括以下两个方面的特点 第一, 职务犯罪侦查工作必须经历初查再进入立案程序, 初查和立案工作之前, 应履行必要的党内请示报告手续 2 检察机关在发现有关线索后, 必须先分析线索的可查性后, 才能展开初查, 且必须获取有罪基本证据后才能立案 1 陈兴良. 职务犯罪认定与处理实务全书 [M]. 北京 : 中国方正出版社, 1996, 年 9 月 17 日最高人民检察院 关于检察机关反贪污贿赂工作若干问题的决定
