The Purview and Paradigm of Judicial Criminal Law LIU Yuan Nanjing Normal University Nanjing 210046 China Abstract Judicial criminal law is a concept characterized by differentiation and division of the theory of criminal law which endeavors to incorporate elements of criminal justice into criminal law so as to ensure that empirical facts be appropriately attended to. As such the present accuser-oriented criminal law should be converted into defender-oriented one that is to turn from pursuing scientific objectivity to seeking for interactive objectivity. Only with the change in purview and paradigm can we have judicial criminal law in the real meaning. And the interpretation and restatement of the concept crime in the perspective of judicial criminal law is expected as an illustration to demonstrate the significance of such kind of change.
