關於申請食物業及其他行業牌照所填報的個人資料 Collection of Personal Data in Connection with Application for Food Business and Other Trade Licences [ 按照個人資料 ( 私隱 ) 條例的規定處理 ] (In accordance with the Personal Data (Privacy) Ordinance) 目的說明 Statement of Purposes 1. 收集資料的目的 Purposes of Collection 你透過本申請表格所提供的個人資料, 會供發牌當局用於下述目的 : The personal data provided by means of this form will be used by the Licensing Authority for (a) 處理向發牌當局申請新簽發 / 轉讓 / 續發食物業及其他行業牌照 / 許可證的相關事宜 ; carrying out activities relating to the applications for the grant/transfer/renewal of food business and other trade licences/permits made to the Licensing Authority; (b) (c) 處理向發牌當局申請新簽發 / 轉讓 / 續發酒牌及會所酒牌的相關事宜, 其中包括按照酒牌局指定的辦法張貼告示, 或列出申請的有關細節, 以徵詢公眾意見 ; 以及 carrying out activities relating to the applications for the grant/transfer/renewal of liquor licences and club liquor licences made to the Licensing Authority. These may include posting of public notices in such manner as determined by the Liquor Licensing Board and setting out the particulars of the application for public consultation; and 方便發牌當局職員及其他政府部門的職員與你互相聯絡, 以便遵從有關食物業或行業的有關法例及規定 facilitating communication among staff of the Licensing Authority, other Government departments and yourself concerning the cooperation of your food business or trade in compliance with the relevant laws and regulations. 你透過本申請表格提供個人資料, 純屬自願不過, 如你不提供充分的資料, 則發牌當局恐怕不能處理你的牌照申請 The provision of personal data by means of this form is voluntary. However, if you do not provide sufficient information, the Licensing Authority may not be able to process your application for licences. 2. 接受資料轉介人的類別 Class of Transferees 在本申請表填報的資料可能會交給其他政府部門及機構, 以達致上文第 1 段所載的目的這些個人資料亦會被披露給其他政府部門作執法用途, 其中包括給予渠務署用作執行污水處理服務條例 ( 第 463 章 ) 及其附屬法例 The personal data which you have provided by means of this form may be disclosed to other Government departments and agencies in pursuance of the purposes mentioned in paragraph 1 above. The personal data may also be disclosed to other Government departments for law enforcement purposes, including Drainage Services Department for enforcement of the Sewage Services Ordinance, Cap. 463 and its subsidiary legislations.

3. 查閱個人資料 Access to Personal Data 根據個人資料 ( 私隱 ) 條例第 18 條第 22 條及附表 1 第 6 原則的規定, 你有權要求查閱及改正所提供的個人資料查閱的權利包括有權索取本申請表格所提供的個人資料的複本一份發牌當局應查閱要求而提供資料時, 可能徵收費用 You have a right to request access to and correction of the personal data provided in accordance with Sections 18 and 22 and Principle 6 of Schedule 1 of the Personal Data (Privacy) Ordinance. Your right of access includes the right to obtain a copy of your personal data which you have provided by means of this form. 附錄 F ( 第 28 及 36 段 ) 附註 : 本附錄所載的發牌條件及持牌條件樣本, 僅供 ㆒ 般參考之用, 並可按個別情況而更改通風 ( 空氣調節 ) 系統標準發牌條件注意倘擬使用自來水作冷卻用途, 必須獲得水務署署長許可, 並須向消防處處長申領通風系統符合規格通知書申請須自行申請述許可及通知書 1. 所安裝的通風系統, 須符合附表所列處所通風設施規例 ( 第 132 章 ) 第 4 條的規定 ( 該規例規定須符合的事項, 載於本附錄的附件 ) 2. 在本署批准裝設通風系統前, 申請須將顯示處所擬裝設的通風系統的最終設計圖則 ㆒ 式 ㆔ 份, 送交發牌當局批准圖則須盡量按比例繪製, 每份均須由申請簽署, 以證明正確發牌當局將保留其兩份, 另 ㆒ 份則在批簽後交還申請 ( 注意 : (1) 申請無須為履行此項發牌條件而聘用專業士繪製圖則但如要進行結構的改建工程, 則遞交建築事務監督的圖則, 須由認可士註冊結構工程師遞交 (2) 如與申請書 ㆒ 併遞交的原來圖則有任何修改, 則須再將修訂圖則 ㆒ 式 ㆔ 份, 送交發牌當局覆核請留意, 在這情況, 除原來圖則及修訂圖則外, 尚須遞交最終設計圖則 ) 3. 所有氣槽須能防止老鼠進入 4. 用以冷卻通風系統的井水, 必須流動於封閉式的循環系統內 - 53 -

5. 所有輸送井水至通風系統的供水管, 均須髹黑色 6. 通風系統須設有 ㆒ 個新鮮空氣入口, 位於戶外離面至少 2.5 米高的方 7. 通風系統所排放的空氣, 無論其溫度是高於或低於外間的氣溫, 均須以不會造成滋擾的方法, 排出戶外離面至少 2.5 米高的方如發牌當局有所規定, 亦須接駁排氣槽 8. 冷卻塔須裝設護罩, 以防水花濺出 9. 每部冷氣機均須設有排水管喉, 以便將冷氣機滴出的水排去 ; 排水的點須設在不會造成滋擾的方 ( 此條件只適用於窗口式冷氣機 ) 10. 必須向消防處處長取得裝設在表列處所的通風系統符合規定通知書標準持牌條件 1. 通風系統所排放的空氣, 無論其溫度是高於或低於外間的氣溫, 均須以不會造成滋擾的方法排出戶外 2. 冷卻塔必須時常維修妥當, 以防水花濺出 3. 由處所所安裝的冷氣機滴出的水, 必須以適當方式排去 ( 此條件只適用於窗口式冷氣機 ) - 54 -

附錄 F( 附件 ) 附表所列處所通風設施規例第 4 條 : (1) 附表所列處所內的每個通風系統, 須符合列條文規定 - (a) 通風系統的所有活動部分須加以安全圍封 ; (b) 通風系統的每部分須是可以觸及的, 以便進行檢查, 尤其是 (i) (ii) 每個風扇轉軸的位置, 須令該轉軸的外罩得以拆除, 以便裝轉速計 ; 及每個入氣口及排氣須是可以觸及的, 以便進行量度 ; (c) 通風系統的入氣口位置不可在述 (i) 消防處處長認為是構成火警危險的方 ; (ii) (iii) 相當可能積聚廢物或廢棄物的方 ; 或由於任何理由而使空氣變得污濁或相當可能變得污濁的方 ; (d) 每個入氣口穴孔須裝 ㆒ 個用防蝕物料製造的網罩, 其網孔不得超過 12 毫米闊 ; (e) 入氣口的氣閘須 (i) 調校至食物環境生署批准的調節位置 ; (ii) 藉不脫色的記號標明已批准的調節位置 ; 及 (iii) 穩固安裝以防干擾 ; (f) 通風系統的排氣不得設於任何對公眾造成或相當可能對公眾造成煩擾或不便的方 ; - 55 -

(g) 每條管道須符合述規格 (i) (ii) (iii) (iv) (v) 管道須全部用不易燃物料製成, 該等物料的強度及耐用度須與鍍鋅鐵片或鋼片的強度及耐用度相近 ; 整條管道的任何部分均須是可以觸及的, 以便進行清潔 ; 凡管道的大小足以容納任何進入, 該管道須設有通道口供入內進行清潔, 而該管道在構造須能承受任何入內進行清潔的的重量 ; 管道內壁須平滑及不透水 ; 及管道如經過任何面牆壁或花板, 即須裝設以可熔連杆操作的氣閘, 該可熔連杆須屬消防處處長所批准的類型, 而氣閘的設計則須在溫度升達攝氏 69 度時仍能操作, 至於管道的構造及防護性能, 亦須能抵受火力, 為時不少於該管道所經過的面牆壁或花板在設計所能抵受火力的時間 ; (h) 每條管道不能供多過 ㆒ 座建築物使用 ; (i) 空氣過濾器須符合述規格 (i) 須全部用鋼絲絨以外的不易燃物料製成 ; (ii) 其設計須屬食物環境生署所批准的設計 ; 及 (iii) 其安裝方式能使所有進入的空氣經過該過濾器後始分佈在處所內 ; (j) 每個靜電過濾器或聚塵器均須屬消防處處長所批准的類型 ; (k) 每把吹風式風扇須在風扇接觸器通電的 ㆒ 端裝設電路熔斷運轉計時錶, 錶內具有能按分鐘及小時, 或按十分之 ㆒ 小時或不足十分之 ㆒ 小時的分數記錄時間的設備 ; - 56 -

(l) 每個電路熔斷運轉計時錶, 均須設於容易觸及及顯眼的方, 以便進行檢查 ; (m) 通風系統內的每套過濾器, 均須以過濾儀過濾旗號顯示器或微差壓力開關掣標示 ; (n) 當過濾儀過濾旗號顯示器或微差壓力開關掣顯示過濾空氣壓力的降幅度較設定的過濾空氣壓力的降幅度超出 50 帕斯卡壓力單位時, 過濾器須予清潔或更換 ; 及 (o) 當過濾空氣壓力的降幅度較設定的過濾空氣壓力的降幅度超出 50 帕斯卡壓力單位時, 過濾旗號顯示器須顯示不潔字樣 - 57 -
