Gold Award US$10,000 Silver Award US$8,000 Bronze Award US$5,000 UOB Southeast Asian Painting of the Year Award US$10,000 This regional prize is awarded to the most outstanding of the four UOB Painting of the Year Award country winners from Indonesia, Malaysia, Singapore and Thailand. Emerging Artist Category The Emerging Artist category is open to aspiring artists who are pursuing an art education, taking their first steps to a career in art or simply painting for pleasure. 4 RULES AND REGULATIONS 2016 UOB Painting of the Year Competition 5.2 Artworks will be judged based on these criteria: message, creativity, composition and technique. 5.3 UOBM reserves the right not to award any of the awards stated in Clause 3.1 above should the entries fail, in the judges opinion, to meet the required standards. 1. ELIGIBILITY 1.1 The UOB Painting of the Year competition (the Competition ) is organised by United Overseas Bank (Malaysia) Bhd ( UOBM ). 1.2 The Competition is open to all Malaysian citizens and residents. Participation in the Competition is free-of-charge. 1.3 The parent or legal guardian of a participant who is 18 years of age or below, must consent to his/her participation in this Competition in the entry form and agree to the rules and regulations. 6. ANNOUNCEMENT OF RESULTS 6.1 All award winners will be notified by phone based on the contact number stated in the entry form (unless otherwise informed by the participants in writing to UOBM) before or by 17 October All awards (except the UOB Southeast Asian Painting of the Year Award and the Fukuoka Asian Art Museum Residency Programme) will be presented at an award ceremony in Kuala Lumpur in October The UOB Southeast Asian Painting of the Year award winner will be announced at an award ceremony in Singapore in November THE COMPETITION 2.1 The Competition is divided into two categories: (1) Emerging Artist and (2) Established Artist. a. The Emerging Artist category is open to aspiring artists who are pursuing an arts education; are taking their first steps to a career in art; or simply paint for pleasure. b. The Established Artist category is open to experienced professionals with an established portfolio of work. They must have shown their paintings in solo or group exhibitions (excluding school graduation shows); be represented by a gallery; or have achieved recognition through art awards. c. There are no age restrictions for either the Emerging Artist or Established Artist category. 2.2 Participants may enter their artwork in only one of the two categories. 2.3 Each participant may submit a maximum of three (3) entries for one category. 2.4 Paintings in acrylic, batik, Chinese brush, collage, crayon, ink, mixed media, oil, watercolour or any other media are accepted. 2.5 Paintings submitted should be two-dimensional. Collages, two-dimensional embossed paintings and three-dimensional paintings are acceptable, subject to a maximum thickness of 5 centimetres. 2.6 Framing is optional. 7. RETURN OF PAINTINGS 7.1 All photos submitted will not be returned to the participants. 7.2 With the exception of the award-winning paintings which will be exhibited, all other submitted paintings must be collected from UOBM between 28 to 31 October 2016 from 10am to 4pm daily. The paintings which are not collected by 4pm on 31 October 2016 shall become the property of UOBM and may be disposed of in whatever manner UOBM deems fit. 7.3 A proxy may collect the painting on a participant s behalf. The proxy must provide a signed authorisation letter (in UOBM s format which is enclosed with the entry form) from the participant and a copy of the participant s passport or identity card. 7.4 UOBM reserves the right not to allow the proxy to collect the painting in the event that the proxy fails to provide the duly executed authorisation letter in UOBM s format and/or a copy of the participant s passport or identity card. 8. COPYRIGHT/ INTELLECTUAL PROPERTY 2.7 Video artworks, installations and sculptures are not acceptable. 8.1 All submission materials submitted to UOBM in accordance with these rules and regulations must be the original works of the participant. The participant must also be the owner of all submitted materials. 2.8 Paintings submitted must be original and should not have been created more than two years prior to the submission date. 8.2 All award-winning entries including the documents and materials submitted to UOBM, shall be the sole property of UOBM. UOBM reserves the right to retain all winning artworks and any supporting documentation. Participants are advised to photograph their submissions for their own records prior to submission. 2.9 Participants should not submit works that have been offered for sale, published, or publicly exhibited. UOBM may, at its sole and absolute discretion, make exceptions for works by full-time art students which have been exhibited at their respective school graduation shows but which have not been offered for sale, published, or exhibited in any other form Paintings over 180 centimetres in height or width (inclusive of their frames) will not be accepted Paintings submitted as a series to make up a single artwork should not exceed three (3) individual pieces that make up the whole artwork, or if conjoined, are to be submitted as a triptych (3-panel artwork). The total dimensions of all the three (3) individual pieces combined that constitutes the whole artwork and/or the triptych (if conjoined) should not exceed 180 centimetres in total height or width. 8.3 All winners shall grant UOBM and members of the UOB Group (including but not limited to United Overseas Bank Limited and its subsidiaries and associated companies) ( UOB Group ) an unlimited worldwide, royalty-free and exclusive licence to exhibit, archive and reproduce images of their winning entries (including, but not limited to brochures, calendars, catalogues, greeting cards and websites). 8.4 Each participant undertakes to indemnify UOBM and its officers and agents and hold UOBM and its officers and agents harmless from and against any and all liability, loss, damage, costs and expenses in relation to any claim or action brought against UOBM or its officers and agents arising out of a breach of the warranty and representation set out in Clause 8 herein. 9. ACCEPTANCE OF RULES AND REGULATIONS 3. THE AWARDS 3.1 The awards for the two categories set out in Clause 2.1 above are as follows: ESTABLISHED ARTIST CATEGORY *UOB Painting of the Year Award US$25,000 *Gold Award US$10,000 *Silver Award US$8,000 *Bronze Award US$5,000 UOB Southeast Asian Painting of the Year Award US$10,000 This regional prize is awarded to the most outstanding of the four (4) UOB Painting of the Year Award country winners. Fukuoka Asian Art Museum Residency Programme One (1) of the four (4) UOB Painting of the Year Award country winners will be selected for a residency programme at the Fukuoka Asian Art Museum. The recipient will be selected through an interview process conducted by the judges of the Competition. 9.1 Submission of entries signifies the participants acceptance of the rules and regulations of the Competition. While all possible care will be taken of the entries submitted, UOBM assumes no responsibility for any loss of or damage to the entries before, during, and/or after the Competition. 10. DISCLOSURE AND USE OF PERSONAL DATA 10.1 By submitting an entry to UOBM, the participants and/or the award winners consent to UOBM disclosing the Personal Data (as defined below) and photographs of the participants and/or the award winners for (i) publishing in any mass media or marketing materials for advertising or publicity purposes; and (ii) any other purpose in relation to the Competition which is considered by UOBM to be in UOBM s interest, or the interest of the UOB Group, in any manner as and when UOBM deems necessary without further notice to the participants and/or the award winners The participants and/or the award winners agree that UOBM s branches, agencies, representative offices, affiliated, associated or related corporations, and their respective officers, servants or agents, whether situated in or out of Malaysia, and the UOB Group are permitted to process the participants and/or the award winners Personal Data. The term process shall include but is not limited to, collecting, recording, holding, storing, using and/or disclosing Personal Data may include, but is not limited to, the participants and/or the award winners name, age, address, occupation and contact details The purpose for which UOBM collect the Personal Data ( Purpose ) includes the following: *Most Promising Artist of the Year Award US$3,000 a. to establish the participants and/or the award winners identity and background; b. for communications with the participants and/or the award winners on any matters pertaining to the Competition, including but not limited to queries on the entry form, details on the award ceremony and notification to the winners on the awards; c. to contact the participants and/or the award winners to discuss any future exhibitions, publicity events related to their artworks and other art events; d. to create a UOB Painting of the Year alumni mailing list to update alumni members on activities relating to any future similar campaigns or competitions; e. to meet the disclosure requirements of any law binding on UOBM and the UOB Group; f. for any other purpose that is required or permitted by any law, regulations, guidelines and/or relevant regulatory authorities. *Gold Award US$2, The participants Personal Data will be collected from the information the participants have provided to UOBM in the entry form and any other documents provided in relation to the Purpose. *Silver Award US$1,500 *Bronze Award US$1,000 * One (1) award recipient per country. EMERGING ARTIST CATEGORY * One (1) award recipient per country. 4. SUBMISSION OF ENTRIES 4.1 Participants are required to submit three (3) copies of photos (in 8R size) for each artwork they wish to enter into the Competition. 4.2 All submissions must be accompanied by an official entry form and a write-up on each artwork. Only one entry form is required per participant. Photocopies of the form will be accepted. 4.3 Photos and entry forms are to be submitted by post to: 2016 UOB Painting of the Year competition United Overseas Bank (Malaysia) Bhd Strategic Communications Level 21, Wisma Bumi Raya No 10, Jalan Raja Laut Kuala Lumpur 4.4 All photos and entries will be deemed received by UOBM on the day UOBM receives the photos and entries. UOBM will not be liable in any manner whatsoever to the participants should any photo and/or entry is lost, missing or damaged in its course of delivery to UOBM. All photos and entries must reach UOBM latest by 2 September 2016 to be eligible to participate in the Competition. 4.5 The panel of judges will shortlist a number of artworks (which is to be determined at the sole and absolute discretion of UOBM) based on the photos submission. All shortlisted participants will be notified by phone based on the contact number stated in the entry form (unless otherwise informed by the participants in writing to UOBM) before 30 September All shortlisted participants are required to submit the actual shortlisted paintings to UOBM. The venue and deadline of submission will be informed by phone based on the contact number stated in the entry form (unless otherwise informed by the participants in writing to UOBM). If the shortlisted participants fail to submit the paintings by the deadline as informed, they will be deemed to have withdrawn from this Competition. 4.7 The shortlisted participants will be contacted during office hours (Monday to Friday, 9.00am to 6.00pm). If the shortlisted participants fail to be contacted after three (3) attempts for any reasons whatsoever, the shortlisted participants will be deemed to have withdrawn from this Competition. 4.8 Each painting submission must have a completed label (provided with the entry forms) attached to the top right-hand corner on the back of the painting. All information must be clearly written in block letters on the labels. 4.9 Paintings that have not dried completely will not be accepted A proxy may be appointed by the shortlisted participant to submit the painting on his/her behalf. The proxy must provide a signed authorisation letter (in UOBM s format which is enclosed with the entry form) from the shortlisted participant and a copy of the participant s passport or identity card UOBM reserves the right to reject the submission of the painting by the proxy in the event that the proxy fails to provide the duly executed authorisation letter in UOBM s format and/or a copy of the participant s passport or identity card. 5. Judging 5.1 Entries will be judged by a panel of local and/or overseas artists/ art connoisseurs/ art critics/ curators or other creative professionals appointed at the discretion of UOBM. The decision of the judges is final. No correspondence will be entered into on this subject before, during, and/or after the Competition The participants need to provide UOBM with the Personal Data UOBM requests from the participants, failing which UOBM may refuse to accept the participants registration/entry in the Competition The participants agree and consent that UOBM may disclose the Personal Data to the following parties: a. companies and/or organisations within UOB Group; b. companies and/or organisations that act as UOBM s and/or UOB Group s agents and/or professional advisers; c. panel of judges for the Competition including local and/or overseas artists/ art connoisseurs/ art critics/ curators or other creative professionals appointed at the discretion of UOBM; and/or d. any persons, authorities or regulators to whom UOBM and/or UOB Group is permitted or required to disclose to under the laws of any country The participants and/or the award winners agree and consent that UOBM may transfer the Personal Data outside of Malaysia. All Personal Data held by UOBM and the UOB Group will be accorded a reasonable level of protection against any loss, misuse, modification, unauthorised or accidental access or disclosure, alteration or deletion In the event the participants provide Personal Data relating to third parties, for the purpose of this Competition, the participants: a. confirm that they have obtained the third parties consent or are otherwise entitled to provide this data to UOBM and for UOBM to use it for the purpose of the Competition; b. have informed the said third parties: i. that UOBM may collect or verify their personal data with third party sources; ii. that UOBM may disclose their personal data to classes of third parties described in Clause 10.7 above; and c. agree to ensure that the personal data of the said third parties is accurate The participants are entitled to request in writing: a. for any information in relation to the participants Personal Data that UOBM hold or store, upon payment of a prescribed fee; b. for any information held or stored by UOBM to be updated, amended and/or corrected; c. for UOBM to limit the processing of the participants Personal Data held or stored by UOBM; d. to make an enquiry or complaint in respect of UOBM s processing of the participants Personal Data. The participants may direct all the requests to Strategic Communications, Level 21, Wisma Bumi Raya, No 10, Jalan Raja Laut, Kuala Lumpur. UOBM may charge a fee for processing the participants request for access or correction. UOBM may also refuse to comply with the participants request in respect of (a) and (b) above if the information supplied by the participants are insufficient (as determined by UOBM) or where such request may breach or violate any law or regulation or any other reason which UOBM deem not to be in UOBM s interest to do so. If UOBM refuse to comply with such request, UOBM will inform the participants of UOBM s refusal and reason for UOBM s refusal If the participants subsequently withdraw their consent to process their Personal Data as given earlier to UOBM, as UOBM will not be able to process and/or disclose the participants Personal Data in relation to the Purpose, UOBM will have the right not to accept the participants registration/entry in the Competition. 11. GENERAL 11.1 These rules and regulations shall be governed by laws of Malaysia and the participants hereby agree to submit to the non-exclusive jurisdiction of the courts in Malaysia and consent to service of process by mail or in any other manner permitted by the laws of Malaysia A waiver (whether expressed or implied) by UOBM of any of these rules and regulations or of any breach of or default by a participant in performing any of its obligations under these rules and regulations shall not constitute a continuing waiver and that waiver shall not prevent UOBM from acting on any subsequent breach of or default by the participants under these rules and regulations UOBM shall not be responsible nor shall accept any liabilities of any nature and however arising or suffered by the participants and/or any third parties resulting directly or indirectly from the Competition UOBM reserves the rights at any time to add, delete, suspend or vary the Competition and these rules and regulations, wholly or in part, at its absolute discretion, by way of posting on UOBM s website or in any other way deemed suitable by UOBM.

b. 与参赛者和/或得奖者之间保持联系 以传递所有与竞赛相关的事宜 包括但不仅限有关 参赛表格 颁奖仪式的各项查询 以及通知得奖者有关奖项和奖品的详细信息; c. 联络参赛者和/或得奖者以讨论与他们的各别画作相关的任何展览和宣传活动或其他艺术 活动等; d. 设立一份大华银行 年度之画 竞赛的赛友通讯碌 为曾参与这项竞赛的赛友们提供任 何类似竞赛或有关活动的资讯; e. 予遵守大华银行集团有关资料公开的任何具法律约束力之条规; 6 SYARAT & PERATURAN Pertandingan 2016 UOB Painting of the Year 6. PENGUMUMAN KEPUTUSAN 1.1 Pertandingan UOB Painting of the Year ( Pertandingan ) dianjurkan oleh United Overseas Bank (Malaysia) Bhd ( UOBM ). 6.1 Semua pemenang anugerah akan dimaklumkan melalui telefon berdasarkan nombor telefon yang dinyatakan dalam borang penyertaan (kecuali dimaklumkan oleh peserta secara bertulis kepada UOBM) sebelum 17 Oktober Kesemua anugerah (kecuali Anugerah UOB Southeast Asian Painting of the Year and Program Residensi Muzium Seni Asia Fukuoka) akan disampaikan kepada semua pemenang di suatu majlis penyampaian anugerah di Kuala Lumpur pada Oktober Pertandingan ini terbuka kepada semua warga dan penduduk Malaysia. Penyertaan di dalam Pertandingan ini adalah percuma. 6.2 Pemenang anugerah UOB Southeast Asia Painting of the Year akan diumumkan di suatu majlis penyampaian anugerah di Singapura pada bulan November KELAYAKAN 1.3 Ibu bapa atau penjaga yang sah bagi peserta yang berumur 18 tahun atau ke bawah mesti memberikan keizinan kepadanya untuk menyertai Pertandingan ini dalam borang permohonan dan bersetuju dengan syarat and peraturannya. 2. PERTANDINGAN 2.1 Pertandingan ini terbahagi kepada dua kategori: Pelukis Baru dan Pelukis Mapan. a. Kategori Pelukis Baru terbuka kepada pelukis beraspirasi yang mempelajari seni; baru sahaja menceburi kerjaya dalam bidang seni; atau sekadar melukis demi hobi. b. Kategori Pelukis Mapan terbuka kepada profesional yang berpengalaman dengan portfolio karya seni yang mapan. Mereka pernah mempamerkan karya seni secara solo atau kumpulan (tidak termasuk pameran graduasi); pernah mewakili galeri; atau telah menerima pengiktirafan melalui anugerah seni. c. Tiada had umur bagi kedua-dua kategori Pelukis Baru dan Pelukis Mapan. 2.2 Peserta hanya boleh menyertakan karyanya ke dalam satu daripada dua kategori tersebut sahaja. 2.3 Bilangan maksima karya yang boleh dihantar oleh setiap peserta adalah tiga (3) sahaja. 2.4 Karya dalam bentuk akrilik, batik, berus Cina, kolaj, krayon, dakwat, cat minyak, cat air atau media campuran adalah diterima. 2.5 Karya yang dihantar mesti berbentuk dua dimensi. Kolaj, lukisan timbul dua dimensi and karya tiga dimensi yang tidak melebihi ketebalan 5 cm adalah diterima. 2.6 Bingkai karya tidak diwajibkan. 2.7 Karya video, seni instalasi dan ukiran tidak diterima. 2.8 Karya yang disertakan mestilah asli dan tidak dihasilkan lebih daripada dua tahun sebelum tarikh karya. 2.9 Para peserta tidak boleh menyertakan karya yang pernah ditawarkan untuk jualan, diterbitkan, atau dipamerkan secara terbuka. UOBM boleh menggunakan kaedah pertimbangan dan kuasa mutlaknya untuk membuat pengecualian untuk karya-karya oleh pelajar seni sepenuh masa yang pernah dipamerkan di sekolah masing-masing semasa pameran konvokesyen tetapi belum pernah ditawarkan untuk jualan, diterbitkan, atau dipamerkan dalam sebarang bentuk Karya yang melebihi 180 cm ketinggian atau kelebarannya (termasuk bingkainya) tidak akan diterima Karya tunggal yang dipersembahkan secara bersiri tidak boleh melebihi tiga (3) panel yang berasingan. Sekiranya keseluruhan karya tersebut dicantumkan, ianya hendaklah dihantar dalam bentuk triptych (karya 3 panel). Ukuran keseluruhan bagi kesemua panel berasingan apabila dirapatkan tidak boleh melebihi ketinggian atau kelebaran 180 cm. 3. ANUGERAH 7. PEMULANGAN KARYA 7.1 Semua salinan gambar yang dihantar tidak akan dipulangkan. 7.2 Selain karya pemenang yang akan dipamerkan, semua karya yang lain mesti diambil balik pada Oktober 2016, dari jam 10 pagi hingga 4 petang. Karya yang tidak diambil balik pada jam 4 petang, 31 Oktober 2016 akan menjadi milik UOBM yang mungkin akan menghapuskannya dengan cara yang dianggap wajar oleh UOBM. 7.3 Peserta boleh melantik wakil untuk mengambil balik karya bagi pihaknya. Wakil tersebut mestilah menyediakan surat kebenaran (yang disediakan dengan borang penyertaan) daripada perserta dan salinan kad pengenalan atau pasport peserta. 7.4 UOBM berhak tidak mengembalikan karya peserta sekiranya wakil peserta tidak menyediakan surat kebenaran yang sah dan/atau salinan kad pengenalan atau pasport peserta. 8. HAK CIPTA / HARTA INTELEKTUAL 8.1 Semua karya yang dihantar ke UOBM mengikut syarat dan peraturan ini mestilah karya asli peserta. Peserta tersebut juga mesti merupakan pemilik bagi semua karya yang dihantar. 8.2 Semua karya yang memenangi anugerah termasuk dokumen dan bahan-bahan yang dihantar kepada UOBM akan menjadi hak milik UOBM. UOBM berhak menyimpan semua karya yang memenangi anugerah dan segala dokumentasi sokongan yang lain. Peserta dinasihatkan untuk mengambil gambar karya mereka untuk tujuan rekod peribadi sebelum dihantar ke UOBM. 8.3 Kesemua pemenang diwajibkan memberi izin kepada UOBM dan ahli UOB Group (termasuk, tetapi tidak terhad kepada United Overseas Bank Limited, subsidiarinya dan syarikat bersekutunya) ( UOB Group ) untuk mempamerkan, mengarkib dan menghasilkan semula imej-imej karya mereka yang menang (termasuk, tetapi tidak terhad, kepada brosur, kalendar, katalog, kad ucapan dan tapak web) tanpa had dan bayaran royalti. 8.4 Setiap peserta bersetuju untuk melindungi dan melepaskan tanggungjawab UOBM dan para pegawai dan ejennya daripada dan terhadap mana-mana dan semua liabiliti, kehilangan, kerosakan, kos dan perbelanjaan yang berkaitan dengan sebarang tuntutan atau tindakan yang dikenakan terhadap UOBM atau para pegawai dan ejennya yang timbul disebabkan pelanggaran perjanjian ini. 9. PENERIMAAN SYARAT DAN PERATURAN 9.1 Penghantaran karya menandakan penerimaan syarat dan peraturan Pertandingan ini. Walaupun semua karya akan dijaga dengan selamat, UOBM tidak akan bertanggungjawab terhadap sebarang kehilangan atau kerosakan kepada karya sebelum, semasa dan/atau selepas Pertandingan. 10 PELEPASAN DAN PENGGUNAAN DATA PERIBADI 3.1 Anugerah bagi kedua-dua kategori adalah seperti berikut: KATEGORI PELUKIS MAPAN *Anugerah UOB Painting of the Year US$25,000 *Anugerah Emas US$10,000 *Anugerah Perak US$8,000 *Anugerah Gangsa US$5,000 Anugerah UOB Southeast Asia Painting of the Year US$10,000 Hadiah serantau ini dianugerahkan kepada peserta yang terbaik di antara empat pemenang anugerah UOB Painting of the Year dari setiap negara. Program Residensi Muzium Seni Asia Fukuoka Seorang daripada empat pemenang anugerah UOB Painting of the Year dari setiap negara akan dipilih untuk menyertai program residensi di Muzium Seni Asia Fukuoka. Pemenang anugerah ini akan dipilih melalui satu proses temu duga oleh panel hakim Pertandingan UOB Painting of the Year. * Seorang pemenang daripada setiap negara. KATEGORI PELUKIS BARU 10.1 Dengan menghantar borang penyertaan kepada UOBM, peserta dan/atau pemenang anugerah memberi kebenaran kepada pihak UOBM untuk melepaskan Data Peribadi dan gambar peserta dan/atau pemenang untuk (i) menerbitkannya di media massa atau dalam bentuk bahan pemasaran seperti pengiklanan dan publisiti; dan (ii) apa jua tujuan berkait dengan Pertandingan yang dianggap oleh UOBM sebagai berkepentingan buat UOBM mahu pun anggota UOB Group, dalam apa cara pun mengikut keperluan UOBM pada bila-bila masa tanpa memaklumkan peserta dan/atau pemenang anugerah Peserta dan/atau pemenang anugerah bersetuju untuk membenarkan cawangan, agensi, pejabat wakil, serta korporasi-korporasi yang berkaitan dengan UOBM, termasuk pegawai-pegawai, kakitangan dan agennya di dalam atau luar Malaysia, dan juga anggota UOB Group untuk memproses Data Peribadi peserta dan/atau pemenang anugerah. Konsep memproses meliputi tetapi tidak terhad kepada kegiatan mengumpul, merekod, menyimpan, menggunakan dan/atau melepaskan data Data Peribadi termasuk dan tidak terhad kepada nama, umur, alamat, pekerjaan dan butiran perhubungan peserta dan/ atau pemenang anugerah Tujuan UOBM mengumpul Data Peribadi ( Tujuan ) termasuk yang berikut: a. untuk menentukan identiti dan latar belakang peserta dan/atau pemenang anugerah; b. untuk berkomunikasi dengan peserta dan/atau pemenang anugerah berkenaan hal-hal Pertandingan, termasuk dan tidak terhad kepada pertanyaan dalam borang penyertaan, maklumat terperinci tentang majlis penyampaian anugerah dan notifikasi kepada pemenang anugerah; c. untuk menghubungi peserta dan/atau pemenang anugerah untuk membincangkan pameran dan acara publisiti yang berkaitan dengan karya seni mereka dan acara seni yang lain; d. untuk membuat senarai alamat pos bagi alumni UOB Painting of the Year untuk memaklumkan ahli alumni tentang aktiviti yang berkaitan dengan kempen atau Pertandingan yang serupa pada masa hadapan; e. untuk menepati peraturan pelepasan data mengikut undang-undang yang bersabit dengan UOBM atau UOB Group; f. untuk apa sahaja tujuan lain yang dikehendaki atau dibenarkan oleh undang-undang, peraturan, garis panduan dan/atau pihak berkuasa yang berkaitan. *Anugerah Most Promising Artist of the Year US$3, Data Peribadi peserta dikumpul daripada maklumat yang dibekalkan oleh peserta kepada UOBM dalam borang penyertaan dan dokumen-dokumen lain yang diserahkan untuk Tujuan tersebut. *Anugerah Emas US$2, Peserta diwajibkan membekalkan Data Peribadi kepada pihak UOBM mengikut syaratnya, dan sekiranya tidak berbuat begitu, UOBM berhak menolak pendaftaran peserta untuk menyertai Pertandingan. *Anugerah Perak US$1, Peserta bersetuju dan memberi kebenaran kepada UOBM untuk melepaskan Data Peribasi kepada pihak-pihak yang berikut: *Anugerah Gangsa US$1,000 * Seorang pemenang daripada setiap negara. 4. PENGHANTARAN KARYA 4.1 Peserta mesti menghantar tiga salinan gambar (dalam saiz 8R) bagi setiap karya yang mereka ingin masukkan untuk Pertandingan. 4.2 Semua karya mesti disertakan dengan borang penyertaan rasmi dan ulasan bertulis bagi setiap karya. Hanya satu (1) borang penyertaan perlu dihantar bagi setiap peserta. Salinan borang juga diterima. 4.3 Gambar karya dan borang penyertaan hendaklah dikirimkan ke: 2016 UOB Painting of the Year competition United Overseas Bank (Malaysia) Bhd Strategic Communications Level 21, Wisma Bumi Raya No 10, Jalan Raja Laut Kuala Lumpur 4.4 Karya akan dianggap diterima oleh UOBM pada hari UOBM menerima pos tersebut. UOBM tidak akan bertanggungjawab kepada para peserta dalam apa cara sekalipun jika mana-mana karyanya hilang, tersalah letak atau rosak semasa dikirim. Semua karya mesti sampai ke UOBM selewat-lewatnya pada 2 September 2016 untuk layak menyertai Pertandingan ini. 4.5 Berdasarkan gambar yang dihantarkan, panel kehakiman akan menyenarai pendek sebilangan karya (yang bilangannya akan ditentukan oleh UOBM). Kesemua peserta yang disenarai pendek akan dimaklumkan melalui telefon berdasarkan nombor telefon yang dinyatakan dalam borang penyertaan (kecuali dimaklumkan oleh peserta secara bertulis kepada UOBM) sebelum 30 September Kesemua peserta yang disenarai pendek dikehendaki menyerahkan karya asli bagi karya yang disenarai pendek. Tempat dan tarikh akhir penyerahan akan dimaklumkan melalui telefon berdasarkan nombor telefon yang dinyatakan dalam borang penyertaan (kecuali dimaklumkan oleh para peserta secara bertulis kepada UOBM). Jika peserta yang disenarai pendek gagal menyerahkan karya asli sebelum tarikh akhir seperti yang dimaklumkan, mereka akan dianggap telah menarik diri dari Pertandingan. 4.7 Peserta yang disenarai pendek akan dihubungi semasa waktu pejabat (Isnin hingga Jumaat, jam 9.00 pagi hingga 6.00 petang). Sekiranya peserta yang disenarai pendek gagal dihubungi selepas tiga (3) cubaan atas apa-apa sebab sekalipun, mereka akan dianggap telah menarik diri dari Pertandingan. 4.8 Setiap karya mesti disertakan label (yang disediakan dengan borang penyertaan) yang dilekat pada sudut atas kanan di belakang karya. Semua maklumat mesti ditulis dengan jelas dalam huruf besar pada label tersebut. 4.9 Karya yang masih belum kering sepenuhnya tidak akan diterima Peserta yang disenarai pendek boleh melantik wakil untuk menghantar karya bagi pihaknya. Wakil tersebut mestilah menyediakan surat kebenaran (yang disediakan dengan borang penyertaan) daripada perserta dan salinan kad pengenalan atau pasport peserta UOBM berhak menolak penyertaan karya sekiranya wakil peserta tidak menyediakan surat kebenaran yang sah dan/atau salinan kad pengenalan atau pasport peserta. 5. PENGHAKIMAN 5.1 Kesemua karya akan dihakimi oleh sebuah panel yang terdiri daripada pelukis, pakar seni, pengkritik seni, kurator tempatan dan/atau luar negara atau mana-mana karyawan kreatif yang dilantik khas oleh UOBM. Keputusan hakim adalah muktamad dan tidak boleh dipertikaikan. Sebarang persoalan mengenai perkara ini tidak akan dilayan sebelum, semasa dan/atau selepas Pertandingan. 5.2 Karya seni akan dihakimi berdasarkan kriteria berikut: mesej, kreativiti, komposisi dan teknik. 5.3 UOBM berhak tidak memberikan mana-mana anugerah yang telah ditetapkan jika tiada karya dapat memenuhi piawaian yang diperlukan pada pendapat para hakim. a. syarikat dan/atau organisasi dalam UOB Group; b. syarikat dan/atau organisasi yang bertindak sebagai ejen dan/atau penasihat professional UOBM dan/atau UOB Group; c. panel kehakiman Pertandingan ini yang terdiri daripada pelukis, pakar seni, pengkritik seni, kurator tempatan dan/atau luar negara atau mana-mana karyawan kreatif yang dilantik khas oleh UOBM; dan/atau d. individu, pihak berkuasa atau pengawal selia yang mana UOBM dan/atau UOB Group dibenarkan atau diperlukan untuk mendedahkan Data Peribadi peserta di baawah undang-undang di mana-mana negara Peserta dan/atau pemenang anugerah bersetuju dan memberi kebenaran kepada UOBM dan UOB Group untuk menghantar Data Peribadinya ke luar Malaysia. Semua Data Peribadi yang dipegang oleh UOBM dan UOB Group akan diberi perlindungan wajar daripada kehilangan, salah guna, modifikasi, akses tidak sah atau tidak sengaja, pendedahan, perubahan atau terpadam Sekiranya Peserta membekalkan Data Peribadi pihak ketiga bagi tujuan menyertai Pertandingan, Peserta: a. memastikan bahawa mereka telah memperoleh keizinan pihak ketiga, atau berhak membekalkan Data Peribadi tersebut kepada UOBM, dan untuk UOBM memproses Data Peribadi; b. telah memaklumkan pihak ketiga bahawa: i. UOBM akan mengumpul atau mengesahkan Data Peribadi mereka dengan sumber pihak ketiga; ii. UOBM mungkin mendedahkan Data Peribadi mereka kepada kategori pihak ketiga sepertimana perkara 10.7 di atas; dan c. bersetuju untuk memastikan bahawa Data Peribadi pihak ketiga adalah tepat Perserta berhak membuat permintaan bertulis untuk: a. sebarang maklumat mengenai Data Peribadi Peserta yang dipegang onleh UOBM, selepas bayaran fi yang dikenakan; b. mengemaskini, meminda atau memperbetulkan maklumat yang dipegang oleh UOBM; c. mengehadkan UOBM daripada memproses Data Peribadi Peserta yang dipegang oleh UOBM; d. membuat pertanyaan atau aduan mengenai cara UOBM memproses Data Peribadi Peserta. Peserta boleh menujukan semua permintaan kepada Strategic Communications, Level 21, Wisma Bumi Raya, No 10, Jalan Raja Laut, Kuala Lumpur. UOBM boleh mengenakan fi pemprosesan atas permintaan Peserta untuk mengakses atau memperbetulkan Data Peribadi. UOBM juga behak menolak permintaan Peserta bagi perkara (a) dan (b) atas sekiranya maklumat yang dibekalkan tidak mencukupi (sepertimana yang ditentukan oleh UOBM), permintaan tersebut melanggar mana-mana undang-undang atau atas sebab-sebab lain yang tidak memenuhi kepentingan UOBM. Sekiranya UOBM tidak dapat memenuhi permintaan Peserta, UOBM akan memaklumkan Peserta sedemikian dan sebab-sebab tidak dapat memenuhi permintaan Peserta Sekiranya Peserta kemudiannya menarik balik persetujuan mereka bagi UOBM memproses Data Peribadi mereka, UOBM berhak menolak penyertaan karya Peserta dalam Pertandingan ini kerana UOBM tidak dapat memproses atau mendedahkan Data Peribadi Peserta bagi tujuan Pertandingan. 11. PERKARA AM 11.1 Syarat dan peraturan ini akan tertakluk kepada undang-undang Malaysia dan peserta bersetuju untuk tertakluk kepada bidang kuasa tidak eksklusif mahkamah-mahkamah di Malaysia dan memberi izin kepada penyerahan proses melalui pos atau lain-lain cara yang dibenarkan oleh undang-undang Malaysia Pengecualian (sama ada secara tersurat atau tersirat) oleh UOBM bagi mana-mana syarat and peraturan atau bagi mana-mana pelanggaran atau keingkaran seseorang peserta dalam melakukan mana-mana tanggungjawabnya di bawah syarat and peraturan ini tidak meliputi penerusan pengecualian. Pengecualian tersebut tidak akan menghalang UOBM daripada bertindak ke atas mana-mana pelanggaran atau keingkaran yang seterusnya oleh peserta tersebut di bawah syarat and peraturan ini UOBM tidak akan bertanggungjawab atau bersetuju untuk menanggung kerugian dalam apa jua bentuk, secara langsung atau tidak langsung, akibat penyertaan ke dalam Pertandingan ini UOBM memelihara haknya untuk menambah, mengeluarkan, menggantung atau mengubah cara Pertandingan dan syarat and peraturan ini, secara sepenuhnya atau sebahagiannya, pada bila-bila masa, mengikut keperluan dan mengumumkan tindakan itu melalui laman web UOBM atau dengan cara lain yang dianggap sesuai oleh UOBM. *Sekiranya terdapat sebarang percanggahan, versi Bahasa Inggeris akan diutamakan.

10 About UOB Painting of the Year competition Indonesia Malaysia Singapore Thailand Driven by a passion to encourage talented artists in their creative pursuits, United Overseas Bank (UOB) started the Painting of the Year competition in Singapore in Today, the annual art competition is the longest-running in Singapore and one of the most prestigious in Southeast Asia. Held in Indonesia, Malaysia, Singapore and Thailand, the UOB Painting of the Year competition has helped to discover many talented emerging artists and recognise several established professionals who have contributed significantly to the development of the Southeast Asian art scene. Mr Goh Beng Kwan, one of Singapore s masters of modern art, was the inaugural winner of the competition in Mr Goh went on to receive Singapore s most distinguished arts award, the Cultural Medallion, in Other well-known artists who won the competition are the late Mr Anthony Poon and Mr Chua Ek Kay in 1983 and 1991 respectively. Both artists are recipients of the Singapore Cultural Medallion. The competition s illustrious alumni include talented artists in the region, such as Indonesian artist Mr Anggar Prasetyo who won the 2015 UOB Southeast Asian Painting of the Year and 2015 UOB Painting of the Year, Indonesia awards with his piece, Exploitation of Fish. The painting conveys the importance of environmental conservation. The 2015 competition has also identified talents such as Singapore s Benjamin F.
