(5) Preparing responses to administrative lawsuits filed against administrative review decisions. ( 四 ) 办理一并请求的行政赔偿事项 ; ( 五 ) 拟订 制作和发送行政复议法律文书 ; ( 六 ) 办理因不服行政复议决定提起行政诉讼的应诉事项 ; ( 七 ) 督促行政复议决定的履行 ; ( 八 ) 办理行政复议 行政应诉案件统计和重大行政复议决定备案事项 ; ( 九 ) 研究行政复议工作中发现的问题, 及时向有关部门提出行政复议意见或者建议 Article 3 The Department of SIPO in charge of the legal affairs (hereinafter referred to as the Administrative Review Institution ) which deal with administrative review issues is responsible for performing the following duties of administrative review: (1) Accepting applications for administrative review; (2) Conducting evidential investigations involving relevant organizations and persons, and consulting relevant documents and materials; (3) Examining whether an administrative act is lawful and proper; (4) Dealing with the administrative compensation claim brought at the same time; (5) Drafting, formulating and delivering legal documents on administrative reviews; (6) Preparing responses to administrative lawsuits filed against administrative review 3

4 decisions; (7) Urging the enforcement of the administrative reconsideration decision; (8) Conducting administrative reconsideration, statistics of the cases heard by competent authority and backup of important administrative reconsideration decision; and (9) Studying the issues occurred during the process of administrative reconsideration and providing competent authority with administrative reconsideration opinions or suggestions in time. 4

5 第四条 有下列情形之一的, 可以申请行政复议 : ( 一 ) 专利申请人对不予受理其申请不服的 ; ( 二 ) 专利申请人对申请日的确定有争议的 ; ( 三 ) 专利申请人对视为未要求优先权不服的 ; ( 四 ) 专利申请人对其专利申请按保密专利申请处理或者不按保密专利申请处理不服的 ; ( 五 ) 专利申请人对专利申请视为撤回不服的 ; ( 六 ) 专利申请人对视为放弃取得专利权的权利不服的 ; ( 七 ) 专利权人对专利权终止不服的 ; ( 八 ) 专利申请人 专利权人因耽误有关期限导致其权利丧失, 请求恢复权利而不予恢复的 ; ( 九 ) 专利申请人对不予受理其复审请求不服的 ; ( 十 ) 专利申请人对复审请求视为未提出不服的 ; ( 十一 ) 无效宣告请求人对不予受理其无效宣告请求不服的, 但本规程有特别规定的除外 ; ( 十二 ) 无效宣告请求人对无效宣告请求视为未提出不服的 ; ( 十三 ) 专利权人对给予实施强制许可的决定不服的 ; ( 十四 ) 强制许可请求人对终止实施强制许可的决定不服的 ; ( 十五 ) 国际申请的申请人对国家知识产权局根据专利法实施细则第一百零五条终止其国际专利申请不服的 ; 第四条 除本规程第五条另有规定外, 有下列情形之一的, 可以依法申请行政复议 : ( 一 ) 对国家知识产权局作出的有关专利申请 专利权的具体行政行为不服的 ; ( 二 ) 对国家知识产权局作出的有关集成电路布图设计登记申请 布图设计专有权的具体行政行为不服的 ; ( 三 ) 对国家知识产权局专利复审委员会作出的有关专利复审 无效的程序性决定不服的 ; ( 四 ) 对国家知识产权局作出的有关专利代理管理的具体行政行为不服的 ; ( 五 ) 认为国家知识产权局作出的其他具体行政行为侵犯其合法权益的 Article 4 An administrative review application may be filed in any of the following cases, except as otherwise specified in Article 5: (1) a patent applicant objects to the specific administrative act in respect of patent application and patent rights conducted by the SIPO; (2) a patent applicant objects to the specific administrative act in respect of layout-design registration, layout-design compulsory license conducted by the SIPO; (3) a patent applicant objects to the procedure decision in respect of patent re-examination and invalidity conducted by the SIPO s Patent Review Board (hereinafter referred as the Patent Review Board ); 5

(16) an international applicant objects to the decision of re-examination made by the SIPO under Article 116 of the Implementing Regulations of the Patent Law. 7

8 (17) a layout-design registration applicant objects to the non-acceptance of his layout-design application; (18) a layout-design registration applicant objects to being deemed to have withdrawn his layout-design application; (19) a layout-design registration applicant, or a layout-design rights holder requests the recovery of his right which was forfeited as a consequence of failing to meet any time limit, but is refused; (20) a layout-design rights holder objects to the decision of non-voluntary license; (21) a layout-design rights holder or an alleged patent infringer objects to the administrative penalty for infringement of the exclusive layout-design rights; (22) a patent agency objects to the penalty of dissolving the agency; (23) a patent agent objects to the penalty of revoking his patent agent certificate; (24) Citizens, legal entities and other organizations allege that their legitimate rights and interests have been infringed by the SIPO s other administrative acts. 第五条 对下列情形之一, 不能申请行政复议 : ( 一 ) 专利申请人对驳回专利申请的决定不服的 ; ( 二 ) 专利申请人对复审请求审查决定不服的 ; ( 三 ) 专利权人和无效宣告请求人对无效宣告请求审查决定不服的 ; 第五条 对下列情形之一, 不能申请行政复议 : ( 一 ) 专利申请人对驳回专利申请的决定不服的 ; ( 二 ) 复审请求人对复审请求审查决定不服的 ; ( 三 ) 专利权人或者无效宣告请求人对无效宣告请求审查决定不服的 ; 8

9 ( 四 ) 无效宣告请求人对专利复审委员会因以同样的理由和证据再次提出无效宣告请求而不予受理不服的 ; ( 五 ) 专利权人或实施强制许可的被许可人对实施强制许可使用费的裁决不服的 ; ( 四 ) 专利权人或者专利实施强制许可的被许可人对强制许可使用费的裁决不服的 ; ( 五 ) 国际申请的申请人对国家知识产权局作为国际申请的受理单位 国际检索单位和国际初步审查单位所作决定不服的 ; ( 六 ) 国际申请的申请人对国家知识产权局作为国际申请的受理单位 国际检索单位和国际初步审查单位所作决定不服的 ; ( 七 ) 布图设计登记申请人对驳回登记申请的决定不服的 ; ( 八 ) 布图设计登记申请人对复审决定不服的 ; ( 九 ) 布图设计权利人对撤销布图设计登记的决定不服的 ; ( 十 ) 布图设计权利人 非自愿许可取得人对非自愿许可报酬的裁决不服的 ; ( 十一 ) 布图设计权利人 被控侵权人对布图设计专有权侵权纠纷处理决定不服的 ( 六 ) 集成电路布图设计登记申请人对驳回登记申请的决定不服的 ; ( 七 ) 集成电路布图设计登记申请人对复审决定不服的 ; ( 八 ) 集成电路布图设计权利人对撤销布图设计登记的决定不服的 ; ( 九 ) 集成电路布图设计权利人 非自愿许可取得人对非自愿许可报酬的裁决不服的 ; ( 十 ) 集成电路布图设计权利人 被控侵权人对集成电路布图设计专有权侵权纠纷处理决定不服的 ; ( 十一 ) 法律 法规规定的其他不能申请行政复议的情形 Article 5 An administrative review application may not be filed in any of the following cases: (1) a patent applicant objects to the decision of rejecting his patent application; (2) a patent applicant objects to the decision on his re-examination application; (3) a patentee or a person requesting invalidation objects to the examination decision on his request for invalidation; (4) a person requesting invalidation objects to non-acceptance of his invalidation request by the Patent Review Board on the ground that the application was re-filed for the same reason and evidence; (5) a patentee or a licensee to whom a Article 5 An administrative review application may not be filed in any of the following cases: (1) a patent applicant objects to the decision of rejecting his patent application; (2) an administrative review applicant objects to the decision on his re-examination application; (3) a patentee or a person requesting invalidation objects to the examination decision on his request for invalidation; (4) a patentee or the licensee under compulsory license objects to the decision in respect of compulsory license fees; (5) an international/pct applicant objects 9

If the SIPO is aware, after accepting an administration review application, that the applicant has filed an administrative lawsuit to a people s court and the people s court has accepted his lawsuit, the SIPO shall reject his administration review application. 12
