2013 2 瑑瑦 Abstract The legal norms on forest carbon sequestration are derived from the international law but its trading rules should be established on the basis of the domestic law especially the private law. The premise of turning the forestry carbon sequestration to rights is to confirm the objects of rights and their legal status. Increment of carbon sequestration and carbon emission reduction are two sides of one issue and unify quality and quantity. The natural attributes and interest relation of carbon emission reduction determine its eligibility as an object of rights the distinctions between carbon emission reduction and other objects of rights make it possible that the forestry carbon sequestration can be an independent right. The carbon emission reduction accords with the object specification and standard of the resource property which determines the rights of forestry carbon sequestration have the attribute of quasi-property right. 瑑瑦 1997 183 70
