24 2 瑒瑥 Abstract Information network includes public telephone network broadcast and television network and computer network. The subject of the crime of refusing to fulfill the obligation of information network security administration consists of network access provider network platform provider network content and product provider. The act of this crime must meet the conditions that refusing to fulfill the obligation of information network security administration refusing to take steps to correct their mistakes according to requirements of supervision authorities and acts belong to one of the four conducts stipulated in the Criminal Law. The author points out that subjective aspect of the crime must have direct intention and the recognition of violating the law and when the actor has wrong recognition of violating the law his act should not be convicted as this crime. In addition the author believes that the main distinction between the crime of refusing to fulfill the obligation of information network security administration and crimes relevant to jeopardizing state security is whether there exists the purpose of jeopardizing state security the crime must be a completed offense and information network service providers corresponding liabilities of refusing to fulfill the obligation of information network security administration should not be denied with the reason of neutral help act. 瑒瑥 255
