法学杂志 2014 年第 4 期 瑒瑨 瑒瑩 Institutional Determinism of Judicial Reform Theory Starting from the Provincial Unified Management of the Judiciary Human Resource Fiscal Guarantee and Material Logistics Zhi Zhenfeng Abstract On the issue of judicial reform there exists an institutional determinism in theory circle and practice circle which simplifies the complex situations for a long time. This understanding ignores the complexity of the judiciary as a political and social system simply thinks that almost all of problems of our judiciary are derived from the absence of the judicial independence. Accordingly as long as the establishment of judicial independence the problems respecting to the judicial fairness and judicial authority will be solved and the social justice will be realized. While this understanding has its insights but the cross - border comparative study of the effectiveness of operation of various countries judicial systems in the world shows that judicial independence is mainly the necessary condition for the fulfilling of the social justice but not the sufficient condition. On the respective of these findings we can better understand The Central Committee of CPC S Decision on Major Issues Concerning Comprehensively Deepening Reform which was adopted at the Third Plenary Session of the 18th CPC Central Committee.
