4 摘要摘要未成年人犹如旭日东升, 是国家的未来民族的希望家庭的寄托, 但也因年幼, 往往心智不成熟, 容易受到外界环境的影响而误入歧途, 身陷囹圄, 耽误了大好的青春年华正因为此, 世界各国各地区都十分重视研究未成年服刑人员的改造问题, 多方寻求预防和矫正未成年服刑人员的有效办法正是在这样一个背景下, 未成年服刑人员的社区矫正工作便应运而生, 并受到了各界人士的普遍关注对比国外此项制度的发展, 我国在这方面的研究还比较零散, 没有形成体系因此有必要对未成年服刑人员的情况有较全面的了解和分析, 从而寻找到构建我国未成年服刑人员司法矫正体系的契合点, 推动此项工作得到实质的深入和发展本文共分为四个部分 : 第一部分 : 概括介绍社区矫正和未成年社区服刑人员的基本概念, 并阐述了开展未成年服刑人员社区矫正工作的必要性和危险性, 深入分析了未成年服刑人员社区矫正的理论基础和依据, 从而得出开展未成年人社区矫正工作的刻不容缓第二部分 : 比较分析未成年服刑人员社区矫正在国外的实践情况, 寻找各国在此项工作中的差异处和独创点, 从而有所启发, 思考其值得我国学习和借鉴的地方第三部分 : 分析我国未成年服刑人员社区矫正的法律基础和矫正现状, 对比国外先进经验, 查找工作中存在的困难和原因, 为此项工作的改进和完善找到突破口第四部分 : 立足实践工作中存在的困难和不足, 提出完善未成年服刑人员社区矫正的设想和建议, 逐层推进, 从加强立法, 构建矫正机构审前调查专业化提高矫正质量帮难扶困以及解除矫正后的转变公众观念, 到前科消灭制度等方面进行论述关键词 : 未成年 ; 服刑人员 ; 社区矫正

5 Abstract Abstract The juveniles symbolize the sunrise.they are the future of the family, nation, and country. Due to their tender age, they are mentally immature and vulnerable to the impact of the surroundings.thus they go astray, get themselves in jail and misspend the best years of their lives. Because of this, all the countries and regions in the world attach importance to the study of the correction for the juvenile prisoners, and seek effective ways of prevention and correction. Under this background, the community correction for the juvenile prisoners emerging as time goes on requires and draws the attention of the public.in contrast to the system in foreign country, our research in this area is still fragmented and not systematic. Therefore, it is necessary to fully understand and analysis the condition of the juvenile prisoners, so as to find the linking spot of building the system of the community correction for the juvenile prisoners, and promote this work to develop virtually and deeply. The main body of this thesis consists of four parts: The first part introduces juvenile prisoners community correction briefly, defines the concept of community correction and juvenile prisoner, and describes the necessity and dangerousness of the juvenile prisoner community correction, deeply analyzes juvenile prisoners community correction rationale, thereby concludes that carrying out this work is of great urgency. The second part is based on comparing and analyzing the practice of community correction for the juvenile prisoners of extraterritorial application which merits our reference and study. The third part analyzes the legal foundation and present situation of chinese community correction for the juvenile prisoners by comparing the advanced experience of foreign countries, and finds out difficulty and reason during the work to seek a breakthrough for the improvement of the work. The forth part proposes some suggestions on how to constructed and consummates the system of juvenile prisoner community correction based on the difficulties and problems in practical work, such as strengthening the legislation, building corrections institute, specializing the pretrial investigation, improving the correction quality, assisting the poor, changing the public perception after correction, and abolishing the criminal record etc. Keywords: Juvenile; Prisoner; Community correction

13 引言引言随着最高人民法院最高人民检察院公安部司法部 ( 以下称两院两部 ) ( 司发通 [2009]169 号 ) 文件关于在全国试行社区矫正工作的意见的颁布, 我国社区矫正工作在全国范围内全面铺开 2012 年 1 月, 两院两部联合印发的社区矫正实施办法, 标志着我国的社区矫正工作进入了一个崭新的阶段未成年人是祖国的未来和希望, 整个社会对他们的成长都给予了很多的关爱和关注, 但他们的成长需要历练磨难, 这就不可避免的会遭受挫折, 甚至可能违法犯罪, 如何教育感化挽救好他们, 将决定着我们国家的命运和前途但是, 由于起步较晚, 我国的未成年服刑人员社区矫正制度还存在诸多方面的不足和困惑, 不能较好的适应未成年人犯罪所呈现的新形势新特点, 不能较好的实现矫正和回归社会的功能因此, 笔者认为应立足我国国情和立法司法工作的实际, 总结国外先进经验思考其制度的先进性之根源和本质, 从而进一步完善未成年服刑人员的社区矫正制度, 达到更好地教育并挽救未成年人的目的 1

14 未成年服刑人员社区矫正分析及完善第一章未成年服刑人员社区矫正概述第一节基本概念一社区矫正的定义社区矫正 (community correction,community-based correction) 是一个翻译的外来术语, 是近代西方国家推行的一种刑罚执行方式, 社区矫正最早起源于 19 世纪英美法系国家, 在美国犯罪学家克莱门斯巴特勒斯的犯罪矫正概述 (1987 年 ) 一书中, 其第二部分就专门论述了以社区为基础的矫正 1 但是, 不同国家学者给社区矫正所下的定义都有所差别以至于美国纽约州立大学刑事司法学院教授杜菲 (Duffee) 指出, 社区矫正的概念如此模糊, 使人如盲人摸象, 未能一窥全貌 2 一般来说, 社区矫正越发达的国家, 其适用的对象和范围就越广, 种类或形式就越多我国在社区矫正研究方面比较有建树的学者, 他们各自对其定义也有所不同 : 如王顺安在社区矫正的法律问题一文中认为, 社区矫正是指国家和社会专门矫正组织依法对法院和其他矫正机关裁判为非监禁刑及监禁刑替代措施的罪犯予以在社区中行刑与矫正活动的总称 ; 3 刘强在各国 ( 地区 ) 社区矫正法规选编及评价一书中指出 : 社区矫正, 是指对犯罪性质比较轻微和社会危害性较小的罪犯在社区执行刑罚活动的总称, 它已在世界范围内被越来越多的人所接受和认可社区矫正的内容包括对刑事犯罪当事人的监管有针对性地教育和改造以及对他们的服务 4 笔者认为, 社区矫正是依法在社区中监督改造和帮扶犯罪人的非监禁刑执行制度 5 具体而言, 就是 2003 年 7 月两院两部联合下发关于开展社区矫正试点工作的通知 ( 以下简称通知 ) 中指出的 : 社区矫正是与监狱矫正相对的行刑方式, 是指将符合社区矫正条件的罪犯置于社区内, 由专门的国家机关在相关社会团体和民间组织以及社会志愿者的协助下, 在判决裁定或决定确定的期限 1 [ 美 ] 克莱门斯巴特勒斯. 犯罪矫正概述 [M]. 龙学群译, 北京 : 群众出版社, 转引自冯卫国. 行刑社会化研究开放社会中的刑罚趋向 [M]. 北京 : 北京大学出版社, 王顺安. 社区矫正的法律问题 [J]. 政法论坛,2004,(2). 4 刘强. 各国 ( 地区 ) 社区矫正法规选编及评价 [M]. 北京 : 中国人民公安大学出版社, 吴宗宪, 主编. 社区矫正导论 [M]. 北京 : 中国人民大学出版社,

15 第一章未成年服刑人员社区矫正概述内, 矫正其犯罪心理和行为恶习, 并促进其顺利回归社会的非监禁刑罚执行活动它契合了人类对正义的不懈追求, 兼顾了刑法的报应和功利目的, 体现了刑法的个别化, 满足了各方当事人的利益诉求 1 二未成年服刑人员社区矫正的含义社区服刑人员是指在实施犯罪行为后依法被判处非监禁刑并在社会上接受监管和矫正的罪犯, 未成年人社区服刑人员是社区服刑人员的一个组成部分, 是指在社区中服刑的已满 14 周岁, 不满 18 周岁的犯罪人 2 从社区矫正的发展历史来看, 社区矫正的主要形式实际上是从未成年服刑人员社区矫正开始的在我国, 社区矫正的最初尝试也是从未成年服刑人员开始的 2001 年 5 月, 河北省石家庄市长安区人民检察院审查起诉部门向涉嫌盗窃的未成年犯罪嫌疑人下达了一个特殊的法律文书社会服务令, 它被认为是开创了我国社区矫正之先河开展社区矫正是提高罪犯改造质量的需要刑罚的最终目的就是将罪犯改造成为守法公民未成年服刑人员社区矫正的根本目标是矫正违法犯罪未成年人的犯罪意识和行为恶习, 消除未成年服刑人员的逆反心理, 增强自律意识, 提高自我约束能力, 减少重新犯罪, 使其对前途重拾希望, 实现顺利回归社会第二节未成年服刑人员社区矫正的必要性一未成年服刑人员身心特征的要求对未成年服刑人员实行社区矫正, 符合其身心的发展特点未成年服刑人员生理心理整体发育尚不成熟, 其正确的世界观人生观价值观尚未定型, 自我控制能力缺乏, 易受外界的影响 ; 未成年服刑人员的人格也未定型, 较之成年人具有更大的可塑性, 其接纳外界信息的敏感性和兼容性较强, 这就决定了未成年服刑人员通常具有易于矫治的特点再者, 由于未成年服刑人员的心理发育不成熟, 心理承受力较弱, 惩罚过重可能会加深其内心深处的罪犯烙印, 导致其理想信念价值观等的严重扭曲, 形成完全的犯罪人心理 ; 另一方面, 过于严厉 1 周国强. 社区矫正制度研究 [M]. 北京 : 中国检察出版社, 吴宗宪, 主编. 未成年犯矫正研究 [M]. 北京 : 北京师范大学出版社,

16 未成年服刑人员社区矫正分析及完善的刑罚执行也可能造成他们内心的封闭和压抑, 缺乏自信, 情感冷漠, 这些心理状况及与之相关的行为方式同样无益于他们将来顺利地回归社会因此对他们采取社区矫正的刑罚执行方式, 提供较为宽松的改过环境, 进行正面的感化引导教育沟通疏导, 能逐步促使其恶习及不良行为得到矫正 1 二预防重新犯罪的需要对未成年服刑人员实行社区矫正, 可以避免监禁未成年服刑人员所产生的负作用监禁刑切断未成年服刑人员与家庭社会的联系, 隔离其与家人朋友的情感, 使之心理上处于无所依附的迷茫状态, 导致其正常社会化的中断或者畸变而严格约束的人身自由, 给未成年人烙上了犯罪标签, 将严重影响他们服刑之后的正常生活发展同时在监狱内, 未成年服刑人员由于其自身心理和认知的盲目性模仿性易感染性等特点, 不可避免的会受到交叉感染他们在同狱友的交流中可能会学习到更多的作案方法更老练的犯罪技能, 埋下重新犯罪的种子并且因为受到监狱社会内部不健全的价值意识以及不正常的监狱文化的感染同化, 未成年服刑人员的道德心衰退, 羞耻心丧失, 这些隐患无疑转变成为未成年服刑人员重新滋生犯罪的温床正如著名的意大利犯罪学家切萨雷龙勃罗梭 (Cesare Lombroso, ) 所说 : 监狱是犯罪的学校, 特别是结伙犯罪的学校, 而这类犯罪是所有犯罪中最危险的犯罪年联合国通过的联合国少年司法最低限度标准规则 ( 以下简称北京规则 ) 第 19 条特别强调 : 进步的犯罪学主张采用非监禁办法代替监禁教改办法就其成果而言, 监禁与非监禁之间, 并无很大或根本没有任何差别任何监禁机构似乎不可避免的会对个人带来许多消极影响 ; 很明显, 这种影响不能通过教改努力予以抵消少年的情况尤为如此, 因为他们最易受到消极影响的侵袭此外, 由于少年正处于早期发育成长阶段, 不仅失去自由而且与正常的社会环境隔绝, 这对他们所产生的影响无疑较成人更为严重因此, 让未成年人回到罪行发生的社会实际环境中去, 在社区环境中对他们进行矫正, 努力促进服刑人员与社会保持良好的互动关系, 感受家庭社会的温暖, 疏导他们的消极情绪, 形成正确的思维模式, 促进其犯罪心理的转化, 重返社会, 1 张苏军, 主编. 宽严相济刑事司法政策与刑法执行方式改革研究 [M]. 北京 : 中国检察出版社, [ 意 ] 切萨雷龙勃罗梭. 犯罪及其原因和矫治 [M]. 吴宗宪等译, 北京 : 中国人民公安大学出版社,
