5 内容摘要 近年来, 我国机关事业单位的养老保险制度与企业职工的养老保险制度备受 社会各界关注, 这源于两种制度的不统一, 也就是所谓的 双轨制 双轨制产 生于特定的历史时期, 有它的历史作用, 但是随着中国经济社会的发展, 双轨 制的养老保险制度已经造成了两个退休群体养老待遇差距越来越大, 也影响了劳 动力的自由流动, 不符合当今社会公平公正的共识 人们不断呼吁两种养老保险 制度进行改革, 实现统一和公平 本文在对我国现行的事业单位养老保险制度的 研究基础上, 选取 C 市事业单位养老保险制度作为切入点, 深入分析该市现行的 事业单位养老保险制度的特点和改革进展情况, 并就改革过程中出现的问题提出 改革建议, 旨在为我国机关事业单位养老保险制度的完善提供一定的理论参考 本文选择了我国的事业单位养老保险制度作为研究对象, 是因为 事业单位 在我国是一个特殊的公共部门, 它既有行政部门的职能, 又有企业经营的性质, 有的甚至还有执法权力 这一特殊的地位, 决定了它是国家建立养老保险制度的 试金石 论文第一部分阐述了本文研究的背景和研究的意义, 简述其他国家 养老保险制度的特点, 并介绍了我国养老保险制度改革的主要研究成果 ; 论文第 二部分介绍了事业单位的分类制改革以及事业单位养老保险制度的改革进程, 重 点分析了 2009 年国家布点五个省市的改革试点情况 ; 论文第三部分结合 C 市的 案例, 深入分析了该市事业单位养老保险制度的现状以及改革成效 ; 论文第四部 分提出了 C 市事业单位人员养老保险改革在实施过程中存在的问题, 并且结合实 际情况提出了解改革建议 本文在对事业单位养老保险制度的研究过程中, 着重选取了具有一定代表性 的案例, 使得论文提出的问题比较切合实际, 解决对策具有较好的可行性 关键词 : 事业单位 ; 养老保险制度 ; 改革

7 Abstract These years, people have showed their high-profile on the endowment insurance system of both public institutions and enterprise units. which is due to the differences between the two systems,called the Two Sides Stystem. The Two-side System is originated in the special time, it has its history role. But, following the development of the economy and the social, this system leads to forming the gap in their benefits situation after retirement and affecting the free movement of labor, which can not adjust with the consensus of the fair and the justice.people call for the reforming of the two systems to achieve the fair and the justice..in order to consummate the endowment insurance system in public institutions, this paper will take City C as an example to analysis its endowment insurance system, and offers some reform suggestions. This paper chose the endowment insurance system of public institution in our country as the research object, because the "institution" is a special public sector in our country, it has not only the administrative functions of the Department, but also has the nature of enterprise management, and some even master the law enforcement power. This special status determines that it is the "touchstone" of establishing a pension insurance system in a country. This paper will divide into four parts. Firstly, we will show some background about the endowment insurance system in other countries and the situation of endowment insurance system reform in China. Secondly, we will focus on the situation in the 5 key reforming cities since the year 2009 to review the road of reforming. Thirdly, we will see some examples in City C to highlight the result of system reform. And finally, we can find the problems in endowment insurance system reform and give some suggestions. All the examples chosen in the paper is representative, so that we can make the problems we proposed more practical and make solutions more effective. 13 一 绪论 一 绪论 社会保障是最重要的民生问题, 也是最突出的社会矛盾, 其中, 又以养老 金的 双轨制 问题最受关注 目前, 机关事业单位与企业退休人员领取养老金 的差异, 被称为养老金 双轨制 不同人群之间养老金待遇差距过大, 实际上 拉大了各类群体收入分配的差距, 社会保障调节收入分配功能未能得到体现, 这 是养老保险 双轨制 备受质疑的原因, 也是我国社会保险体系 碎片化 特征 的表现之一 养老保险是社会保障制度体系的核心部分, 该项改革势必成为社会 保险乃至社会保障制度改革的关键一环 本文以广东省 C 市事业单位的养老保险 制度为研究对象, 通过对该地养老保险改革历程的梳理和分析, 力求寻找到一条 符合当地实际的事业单位养老制度改革途径 ( 一 ) 研究背景 我国的企业职工养老保险制度是经历了 企业 区域 全国 的演变, 目 前已初步形成了具有统一缴费比例 统一账户规模 统一养老金支付结构和统一 计发办法的制度安排 然而, 事业单位人员养老制度改革虽然从上个世纪 90 年 代改革试点开始, 经过了多年的历程, 总体来看还是相对滞后, 大多数事业单位 的养老金还是靠财政吃饭 不同地区之间 不同单位之间养老保险制度不统一的 现象比比皆是, 而且从 2009 年开始在五省市进行事业单位养老保险改革试点工 作以来, 各地普遍出现 推进难 阻力大 的现象, 不仅改革进程受阻, 而且还 出现了很多消极抵制的行为 作为养老金 双轨制 的受益者, 机关 事业单位 工作人员当然不愿意放弃这只退休后的金饭碗 中国社会科学院发布的 社会保障绿皮书 和 中国社会保障收入再分配状况调查 中的数据也佐证了这一观点 数据显示, 被调查者中约有 75.4% 的职工养老金低于 2000 元, 然而相对之下, 92.3% 的机关事业单位退休人员养老金却都高于 4000 元 在养老金差距方面, 根据 2011 年 8 月份的有关数据显示在养老金领取人员中 最低为 200 元, 最高 1
14 事业单位养老保险制度改革探析 基于 C 市为研究对象 为 1 万元, 相差 50 倍 1 如此大的收入差距, 与现阶段国家努力缩小贫富差距的目标是背道而驰的 养老金双轨制在一定程度上成为拉大居民收入差距的 推手 因此, 改革养老金双轨制 推进养老保险制度更加公平和可持续发展势则成为题中之义 ( 二 ) 研究意义 我国事业单位养老保险制度碎片化的特征明显, 在相关问题的认识和理解 上面各方观点不一 当前国家层面已经有了事业单位养老保险制度改革试点方 案, 但是各地方缺乏相应的实施方案和配套措施, 改革进程各异, 效果不一 因 此, 事业单位养老保险制度改革是当务之急, 也是大势所趋 本选题根据现实需 要, 在尽可能汲取国内外专家学者研究成果的基础上, 通过对养老保险制度的基 础理论研究, 对当前事业单位养老保险制度现状进行分析, 结合笔者目前工作生 活的城市实际, 期望探索出一条符合当前实际情况的养老保险改革道路, 以期为 国家制定科学合理的事业单位养老保险政策体系和改革方案提供一定的理论参 考和可资借鉴的政策建议, 促进事业单位养老保险制度的长足发展, 实现中国社 会保障制度公平可持续发展 ( 三 ) 国内外研究成果述评 1. 国外研究成果 目前西方国家是没有事业单位这种行政性机构的 2, 外国的公职人员对应我 国的机关事业单位干部职工, 因此研究国外 事业单位 的养老制度就只能从他 国的公职人员养老制度开始 许多国家尤其是西方发达资本主义国家, 相对较早地建立起了现代社会养老保险制度, 经过一个多世纪的发展, 一些国家的养老保险制度发展较为成熟 按照公职人员养老保险制度的独立性与否进行划分, 国外的公职人员的养老保险 制度主要有两种模式 : 一是单独建制的公职人员养老保险制度, 主要代表国家有 1 新浪网 : 2 朱庆芳等 : 现代事业人事管理, 中国人事出版社,1997 年版, 第 2 页. 2
15 一 绪论 法国 澳大利亚 德国等 据国际社会保障协会统计, 全世界大约有 78 个国家建立了单独的公职人员养老保险制度, 占已建立养老保险制度国家总数 45%, 但是在欧盟国家, 这个比例就只有 29% 1 ; 第二类模式是将公职人员纳入国家统一的基本养老保险制度, 此模式中存在着两种不同的方式, 区别在于是否同时设立补充性养老保险金 以英国和瑞典为典型代表的国家的做法就是一方面要求公职 人员参加本国统一的养老保险制度, 另一方面又专门为其设立具有职业优越性的 补充性的养老保险, 以瑞典为例, 在该国符合一定条件的公职人员退休后, 养老 金替代率一度可以可达到 100% 2 而以新加坡和智利为代表的国家则实行无差别 的养老保险制度安排, 即公职人员与本国其他人员一道在养老保险制度上只享受 国家统一的养老保险待遇机制, 前者有 中央公积金计划, 后者实行 个人缴 费 完全积累 私营化运营 的机制 3 总的来看, 将公职人员纳入国家统一的 基本养老保险制度的做法还属多数, 它在一定程度上主导着当今世界养老保险改 革的趋势所在 综观各国公职人员养老保险现行模式, 可以看出存在以下几方面的优点 : 一是立法相对完善 坚持立法先行是各国建立养老保险制度的特点, 一些国家在 同一的养老保险制度基础上相应地制定了实施法规, 例如瑞典的福利津贴制度 ; 有的国家对养老保险单独立法, 比如德国的 联邦官员供养福利法, 日本的 公 务员年金法 和智利的 养老保险法 等, 完善的立法使得制度的运行变得顺畅 二是建立起多层次的养老保障体系 这种多层次性表现为, 除了养老金外, 还有 职业年金 个人储蓄累计等配套补充的养老金, 不仅是养老金的筹资来源, 在制 度层面 待遇水平等方面都体现出了多层次性 三是强调公平, 兼顾优待 各国 基本都将公职人员纳入本国统一的养老保险制度层面, 与其他公民一样, 体现出 了基本的公平性, 同时有某些国家为了强调公职人员的身份地位的特殊性, 还设 有补充津贴, 但为了防止公职人员与其他社会群体的收入差距太大, 公职人员的补充津贴会采取相应的手段来调控, 比如降低替代率或者对其他社会群体进行补 贴等, 这种适度的差别即能让非公职人员接受, 又可以体现公职人员的优越性 1 华登峰. 我国事业单位养老保险制度改革对策研究.[D]. 青岛大学, 赵江利. 王裕明. 王金涛. 国外公职人员养老保险制度研究及启示 [J]. 劳动保障世界.2010(6). 3 V Carvalho Pinheiro,Pension Funds for Government Workers in OECD Countries,2004,p3. 3
16 事业单位养老保险制度改革探析 基于 C 市为研究对象 总体看来, 各国公职人员养老保险制度框架已基本成型, 然而随着人口老龄化问题的加剧 以及各国内外部环境的变迁, 公职人员养老保险制度也面临着改革压力, 需要各国根据自身的国情不断做出调整和完善 首先, 西方国家公职人员的高水平的养老金制度随着全球经济危机的加深影响而面临严重的财政危机, 特别是实现收现付制养老保险制度的国家 ; 其次, 社会经济体制的改革和结 构的调整, 使公职人员的不再享有 终身雇佣 的权利 比如我国的公务员, 现 行除了常规的终身制人员以外, 还有一部分是雇佣制的公务员 传统的公职人员 养老制度就有改革的潜在动力 ; 再次, 人口老龄化要求各国必须积极探索和完善 养老保险制度, 以应对养老金体系的巨大压力 面对新时期公职人员养老保险制度存在的问题和挑战, 当下国外学者重点 在于研究现行的养老保险制度实施效果以及改进方向 一是探讨逐步扩大雇员自身责任及发展商业保险的空间 实际上就是养老 金领域非常热点的 DB( 确定给付型计划 ) 和 DC( 确定缴费型计划 ) 问题 前者 雇员单位需要承担养老金的金融风险, 而后者的养老金金融风险更多地由雇员承 担 二是探索走出养老金财政支付困境 帕拉西奥斯认为, 政府对养老金资产 的投资管理必然影响到养老金收益及参保者潜在的待遇水平, 为此他提出了如何 提高养老金效益的看法 1 有其他学者还通过公共部门与私人部门的养老金管理模式的比较, 突出强 调养老保险基金的管理与投资, 以期通过对养老基金进行管理使之与资本市场间 进行充分的衔接, 实现养老金的保值增值的问题 2. 国内研究成果 国内关于养老保险制度改革的研究可以追溯至上世纪 90 年代, 研究的重点 和热点主要集中于养老保险理论和相关制度建设 然而相比城镇企业职工和农民养老保险研究而言, 以机关事业单位人员养老保险为研究对象的文献数量较为有 限 近年来, 双轨制体系下两种养老保险制度造成的退休群体养老待遇差距过大 的问题引起了人们的热烈讨论和不满 养老保险 已经连续四年 ( R Palacios and E Whitehouse, Civil-service Pension Schemes around the World,2006,pp
