1 kintone mobile for Android 使用许可合同对使用才望子株式会社 ( 以下称 Cybozu ) 的上述软件 ( 以下称本软件 ) 的法人团体的各位 ( 以下称客户 ) 的提醒 : 本使用许可合同 ( 以下称本合同 ) 是关于本软件客户及 Cybozu 间签订的法律合同客户于使用本软件产品时, 被视为同意受本合同条款的约束, 本合同成立本软件受以著作权法及关于著作权的条约为首的, 及其它关于知识产权的法律以及其条约的保护本软件产品是被许可其使用的, 并非被销售的另, 本软件中可能包含 Cybozu 不享有著作权的第三方的程序本合同的效力不涉及该等程序关于各程序的使用条件, 请于使用本软件前按照本合同最后第三方程序的使用条件一览的记载确认各程序的许可证文件不能同意该等使用条件的, 则不能使用本软件, 因此请迅速卸载 1. 使用范围 Cybozu 于本合同中对客户许可以下权利 (1) 客户在本软件方面, 已经在客户访问对象的服务中注册的 ( 以下称访问对象服务 ) 用户中, 作为本软件的试用或使用用户仅限客户指定的人员, 可安装并使用本软件但是, 客户关于本软件的使用, 各用户也需遵从本合同 (2) 客户在使用本软件时需遵从访问对象服务相关的使用许可合同等, 有必要购买相关访问对象服务的使用权等 2. 关于使用本软件的信息等发送为改善以及提高产品, 客户同意将使用本软件等相关的以下信息发送于才望子被发送的信息为收集 / 解析该使用状况等在必要的范围内可在才望子集团内使用另外, 本软件的产品式样规定了以下记载的所有信息不会关联并使用到客户的个人信息关于 crash log crash log 本身设备的型号与版本的信息会被发送才望子为收集 crash log 使用 Fabric, 每次向客户确认是否可以发送信息后, 信息将被发送到 Fabric 另外,Fabric 的式样规定了会将使用本软件的客户的终端 OS 的类型版本设备的类型等信息定期发送通过 Fabric 获取的信息的相关处理请参考 Fabric 的服务协议 3. 其他的权利与限制 (1) 客户仅可为备份客户输入的数据之目的复制本软件但, 以除为了复原所备份的数据, 不论为客户所拥有的或第三方所拥有的, 以备份为目的之复制品在任何计算机上不并行使用本软件为条件 (2) 客户不得将本软件除为备份之目的以外进行复制分发租赁传播 ( 包括自动向公众传播向公众提供 ) 出借设定担保等且不得将使用本软件的权利转让转卖或再许可其使用 (3) 客户不得对本软件或本软件的文档进行修正翻译逆向工程反编译分解或制作本软件的衍生软

2 件且, 客户不可将本软件的构成部分分开使用 4. 本合同的解除及终止 (1) 客户违反本合同的即使一个条款及条件的,Cybozu 可不经任何催告而立即解除本合同 (2) 本合同被解除的, 客户应将本软件构成部分文档及其一切复制品销毁从计算机的记忆媒体上完全删除, 不得继续使用 (3) 对于伴随本合同的解除而不能使用本软件的全部或一部分, 致使客户或第三方遭受的损害等,Cybozu 不负一切责任 5. 保证的限制 (1) Cybozu 对本软件包含的机能满足客户的要求本软件的正常运行本软件存在瑕疵 ( 包括所谓程序缺陷构造上的问题等 ) 时对其进行修正的任何一项不进行保证 (2) Cybozu 会有不经客户事先的同意而变更中止本软件的机能及附随于本软件的服务等不保证与本合同签订时的本软件同等的使用环境的永远持续 (3) Cybozu 的口头或书面等的一切信息或建议不为进行新的保证, 或不为于其他任何意义上扩大本保证的范围 6. 责任的限制 (1) 客户应在此确认及同意, 基于使用本软件及使用附随于本软件的服务而发生的一切直接间接的损害 ( 数据的丢失服务器停机业务停滞第三方的投诉等 ) 及危险, 全部仅由客户承担另, 于使用本软件及使用附随于本软件的服务包括 Cybozu 为修正本软件的瑕疵而提供修正程序时客户不适用此修正程序 Cybozu 未提供服务或者提供时客户未使用或使用等 (2) 在任何情况不法行为根据合同及其他法律依据的情况下,Cybozu 本软件的供应方再销售商及各提供信息内容的公司, 不向客户及其他第三方就包括营业价值的丧失业务停止计算机故障引起的损害其他所有商业损害损失等的一切直接的间接的特殊的附随性或结果性的损失损害负责并且, Cybozu 不对第三方的任何投诉负责 7. 著作权等 (1) 本软件 ( 包括 HTML 程序部分及各画面表示部分在内的全部 ) 以关于与本软件有关的文书图纸文档等的文书的所有权著作权为首的其它一切知识产权 ( 以下称本知识产权 ) 归属于才望子株式会社 (Cybozu, Inc. 日本国 ) 及其供应方 (2) 本知识产权受著作权法及其他关于知识产权的法律以及条约保护因此, 客户应将其与其他的著作物同样处理 (3) 关于本软件存取的被表示使用的各内容的知识产权, 为各提供信息内容的公司之财产, 受著作权法及其他关于知识产权的法律以及条约保护 8. 准据法及附则 (1) 本合同除适用关于法律抵触的原则, 以日本国的法律为准据法

3 (2) 在日本国内进行的交易就关于本合同及本软件当事人之间产生纠纷时, 应于东京地方法院作为初审管辖法院且, 在日本国外进行的交易就关于本合同及本软件, 当事人之间会产生的全部纠纷争论或意见的不一致应根据 ( 社 ) 日本商事仲裁委员会的商事仲裁规则通过仲裁最终解决 9. 其他客户获取的本软件中附有与本合同不同条款的使用许可合同及条件时, 除 Cybozu 特别明确记载为与本合同不同的, 客户于使用本软件时应优先适用本使用许可合同本合同为双方当事人之间关于使用许可的唯一的协议, 仅通过双方当事人签名或签章的书面文件可以变更且, 销售店向客户准备的订货单上记载的条件不对本合同具有效力, 不能对本合同的内容带来哪怕是稍微的影响本合同的任何条款之一被适用的法令限制其效力的, 该条款应于所涉的法令许可的范围之内有效且, 本合同的任何条款之一因适用的法令而无效的, 其它规定应仍继续有效第三方程序的使用条件一览包含在 kintone mobile for Android 中的第三方程序 android-support-v4 This product includes android-support-v4. jackson-core jackson-annotations jackson-databind This product includes jackson-core 2.1.4, jackson-annotations and jackson-databind android-support-v4 This product includes android-support-v4.
