5 摘 要 摘 要 随着国际贸易的发展, 海关业务量急剧增长, 传统的偏重于 把关, 以怀疑一切 口岸设防 平均用力为特点的通关管理模式越来越无法适应现代经济贸 易发展的现实需要 政府和企业要求海关提高通关效率的呼声比以往任何时候都 更为强烈 有效监管 与 高效通关 的矛盾成为海关面临的主要矛盾, 海关 与企业合作, 推行 守法便利 海关通关管理成为世界各国海关改革的方向 但由于传统管理理念 管理模式的影响和束缚, 目前中国海关通关管理还未能改变与企业对立的管理制度和方法, 无法从根本上解决有效监管和高效通关的矛盾, 制约通关效率提高的瓶颈依然存在 在此背景下, 本文运用重复博弈有利于实现博弈双方的信用合作的理论, 对中国海关建立和完善 守法便利 海关通关管理提出相关建议 论文共分七个部分 : 第一部分是绪论, 说明了选题背景和动机 ; 第二部分介绍了海关 橄榄型 通关管理模式的局限性 ; 第三部分介绍了博弈论特别是重复博弈, 为后文的分析做理论准备 ; 第四部分运用博弈论对海关与企业在通关过程中的决策行为进行分析 ; 第五部分介绍美国 荷兰海关与企业的合作关系 ; 第六部分, 对中国海关推行 守法便利 海关通关管理提出相关建议 ; 第七部分是全文的结论 本文的结论是 : 解决目前海关所面临矛盾的途径是关企合作 重复博弈是海关与企业合作的路径选择 海关与企业的博弈应由一次博弈向重复博弈转变 ; 海 关 橄榄型 通关管理模式应向 纺锤型 通关管理模式转变 ; 稽查功能应由 查 案 和 补税 向企业诚信守法管理转变, 如此建立有效的激励制约机制, 发挥 声誉 的作用, 从而保证重复博弈基础上关企 守法便利 合作的形成 关键词 : 重复博弈 ; 海关 ; 守法便利

7 Abstract Abstract With the development of international trade, Customs business volume keeps booming. Traditional Customs clearance model emphasizes safeguarding the national gateway. This model, characterized by doubt everything, guard at port and balanced focus, has less and less fit the realistic demand of modern economic and trade. The voice of government agencies and enterprises calling for efficiency improvement of Customs clearance has been louder than any time before. The contradiction between effective surveillance and efficient operation is the major issue in the face of Customs. Customs-to-business partnership, Compliance and Facilitation has become reform target of the international community. However, several problems still exist due to the impact and restraint of traditional management concept and model. At present, Customs management system and method over enterprises has not been totally changed yet. The contradiction between effective surveillance and efficient operation has not been solved entirely. The bottleneck of clearance efficiency improvement still exists. Against the background, this paper applies game theory, which repeated game benefits trust cooperation between the two sides, to the operation of China Customs and put forward suggestions for Customs clearance management in terms of establishing and perfecting Compliance and Facilitation system. This paper is divided into seven sections. The first section illustrates background and motives of this topic. The second section introduces the limitation of the olive shaped Customs clearance model. The third section briefs game theory, especially repeated game, which provides theoretical methodology for the following analysis. Decision-making behavior of Customs and enterprises in the process of clearance is analyzed in the fourth section making use of game theory. In the fifth section, Customs-to-business cooperation relationships in the U.S. and Holland are introduced. The sixth section puts forward relevant suggestions on how China Customs could push forward Compliance and Facilitation clearance management reform. In the

The conclusion of this paper is that Customs-to-business partnership is one of the solutions addressing current contradiction. Repeated game is the alternative for Customs and enterprise cooperation. Gaming between Customs and business should be transformed from one-shot game to repeated game. Clearance management model should be changed from olive shaped to spindle shaped. The function of auditing should be adjusted from case check and make-up duty to enterprise honest, trust and law abidance management. Thus, effective encouragement and restraint mechanism should be established which makes full use of enterprises reputation. Compliance and Facilitation Customs-to-business cooperation model should be ensured on the basis of repeated game. Key Word: Repeated Game; Customs; Compliance and Facilitation.

13 第一章绪论 第一章 绪论 第一节 选题背景 一 海关通关管理工作面临的基本矛盾海关关徽是由一只商神杖和一把金钥匙组成的, 手杖代表国际贸易, 钥匙象征为祖国把关, 这意味着海关既要促进国际贸易的繁荣和发展, 同时要守住国家大门 即海关不但负有 把关 职责, 同时也担着 服务 的职能 但是传统的海关通关管理往往偏向于强调海关是国家进出境监督管理机关, 海关以守住关口 征收税款和实施贸易管制为基本职责, 正因为如此, 传统通关制度的设计是以 违法推定 为基础, 通关管理方式上采取口岸设防, 即大多数企业都有通过进出口非法牟利之嫌 由于海关对进出口企业各方面的情况缺乏全面的了解, 对企业进出口货物的监管没有足够的把握, 海关业务现场采取 平均用力 的方式对进出口货物逐票进行审核, 而没有根据各个企业的信用等级以及不同实际来确定监管重点, 在保护关税和财政关税为主导的传统经济体中, 这种传统的海关作业流程并无大碍 但随着贸易自由化程度的日益提高, 国与国之间经济联系的日益加深, 这种海关制度无法适应现代经济贸易发展的现实需要 从宏观层面看, 入世后我国政府将承担按照世贸规则全面调整国内法律 法规和政策的义务 而 WTO 的基本法则, 如非歧视原则 自由贸易原则 透明度原则 公平竞争原则等都与海关工作有关联 我国政府对入世后海关的行政效率和监管水平给予高度重视, 提 出了很高的要求 从微观层面看, 市场经济的微观主体对实现公开 公正 公平原则的要求也越来越强烈 入世后, 各行各业将直接面对激烈的竞争, 企业对海关提高贸易效率 降低贸易成本的呼声将日益高涨 另外, 随着 全球采购 现代物流 电子商务 等现代管理理念和先进生产经营方式的发展, 企业迫切要求海关简化手续 高效运作, 增强本国企业在国际市场上的竞争力 国家和社会各界要求海关通关管理实现 把关 与 服务 有效监管和高效通关的辨证统一 有效监管和提高通关效率这一对矛盾已成为海关通关管理工作面临的基本矛盾 1
14 重复博弈基础上建立和完善海关 守法便利 通关管理的研究 二 世界海关通关管理改革的方向为了海关的生存和发展, 改革成为各国海关的共同使命 世界海关组织 (WCO) 先后修订了 京都公约, 制定了 全球贸易安全与便利标准框架, 全面规范海关制度和标准做法 各国海关也纷纷制定发展战略规划 修订海关法 规 实施机构重组 调整人力资源配置 改革业务制度 拓展管理资源 推进信 息化应用 ; 同时广泛应用风险分析 信用管理 绩效考核和海关稽查等先进管理 方法和技术 海关改革出现 四个转变 的趋势, 即 : 管理理念从 行政主导 向 客户导向 转变 ; 管理对象从以物为主向物和人并重转变 ; 管理方法从单一模式向分类管理转变 ; 管理方式从各自为战向广泛合作转变 概括而言, 摒弃与企业对立的管理思想, 通过与企业合作, 建立 守法便利 的通关管理模式, 促进广大进出境企业的自觉守法来提高海关执法的有效性, 高质量地实现海关管理的基本职能已成为 20 世纪 90 年代以来世界海关通关管理改革的方向 守法便利 通关管理实质是一种信用管理 信用, 首先是经济学范畴的概念, 它伴随着商品经济的发展而产生, 指的是一种借贷行为, 表明债权人和债务人之间的债权债务关系, 当然也不可避免地包含债权人对债务人偿还能力的信任 本文所讲的 守法便利 信用管理, 就是海关基于社会成员之间 遵守诺言, 实践成约, 从而取得别人对其的信任 1 的信用关系, 对海关管理相对人特别是广大的进出口企业, 依据其诚实守信的程度, 按照海关与其之间的 管理契约, 实施不同贸易便利措施, 从而达到和实现严密监管和高效运作高度有机统一的目的 中国海关在 现代海关制度第二步发展战略规划 将 基本实 现建立企业进出口诚信守法体系 作为战略目标之一提出 把 坚持守法便利 列为海关改革应遵循的原则, 提出 守法便利是海关促进贸易便利 提高执法水平的必然要求 市场经济是法制经济 诚信经济, 必须大力规范企业进出口行为, 引导企业诚信守法, 维护企业合法权益, 为守法者提供最大的便利, 营造健康有序的进出口环境 1 夏征农. 辞海 [M]. 上海 : 上海辞书出版社,1999:
15 第一章绪论 第二节 选题的动机和意义 笔者作为进出口通关环节的海关一员, 深感海关现有的现场通关管理模式与我国进出口形势的发展不相适应, 大量守法企业与少数问题企业使用相同的通关手续, 程序较为复杂 烦琐, 近年来, 海关推行了多种便捷通关措施, 有很多都得到了 很好的社会效果, 但并没有形成整体良性通关环境, 通关压力依然巨大 究其原 因, 有些改革却并不适合企业需要, 企业并没有从中收益, 更重要的是, 海关的管理理念并未发生实质性的变化 在市场经济体制下, 海关与企业的关系理应从监管关系向伙伴关系转变 与现代企业建立一种新型合作伙伴关系, 从本质上反映了市场经济下政府与企业之间新的关系格局, 反映了企业的市场经济主体地位, 同时也反映了 严密监管与高效运作有机统一 把关与服务平衡 的海关工作方针 但由于传统管理理念 管理模式的影响和束缚, 目前中国海关通关管理还未能改变与企业对立的管理制度和方法, 无法从根本上解决有效监管和高效运作的矛盾, 制约通关效率提高的瓶颈依然存在 因此, 本论文将在政治 经济 军事等多领域应用广泛的博弈论特别是重复博弈的理论引入海关通关管理 通过借鉴重复博弈有利于博弈双方形成信用合作的思想说明海关和企业合作对解决海关通关管理面临的矛盾的意义, 探讨我国海关通关管理如何实现海关与企业 守法便利 的信用合作 这对海关现阶段的通关管理改革的顺利进行将有重要的意义 将博弈论引入海关通关管理领域, 在学术界不乏例子, 主要是通过建立海关 与企业的博弈模型, 分析博弈的纳什均衡, 提出海关应加大对违规或走私行为的 处罚力度, 提高对进出口货物的查验比率的政策建议 该类建议较偏重于强调海关的 把关 职能, 而忽视海关 服务 的职能 ; 仍然把海关与企业的关系定位在 命令 - 服从 或 管理 - 配合 阶段, 而未从 合作 - 共赢 的角度来理解关企关系 本文的创新之处主要在于运用重复博弈理论来解决关企的合作问题, 将非合作的博弈双方引向信用合作 3
